APPENDIX NO. 1

GLOSSARY

Definitions. As used throughout this document, the following terms will have the meaning set forth below.

Acceptable Quality Level (AQL). The expected level of performance. The Government shall reject performance that does not meet the AQL. The AQL for routine work each quarter is 90%. The AQL for all Additional Work (funded via Time and Material) is 100%. If the Contractor’s unacceptable performance exceeds 10%, the Government will take appropriate deduction from the monthly payment in that functional area (See Performance Requirement Summary for each functional area and deduction schedule). The designation of an AQL, however, does not imply, nor should it be interpreted to mean, that the Government expects the Contractor to attempt to meet all standards at all times.

Administrative Contracting Officer (ACO). A government employee with authority to enter into and administer contracts and enter into contracts, make determination and finding with respect thereto, or with any part of such authority.

Alteration. The work required to adjust/modify interior arrangements, location, or other physical characteristics of an existing real property facility so that it may be more effectively adapted to or utilized for its designated purpose. Additions, expansions, and extensions are not included in alteration.

Biosecurity. The procedures (including maintenance), equipment and facilities that prevent intentional or unintentional escape of infectious agents from the Location or introduction of a pathogen from outside to animals housed or plants maintained in the Location.

Biosafety. Procedures (including maintenance, equipment), and facilities that prevent intentional and unintentional infection of employees by agents used in research laboratories at the Location.

Conduct of Contractor Employees. Each employee is expected to adhere to standards of competency, conduct, appearance, and integrity that reflect credit to the employee, the Contractor, and the Government. The Contractor is responsible for disciplinary action with respect to their employees as necessary.

Construction. The erection, installation, or assembly of a new facility; the addition, expansion, extension, alteration, conversion, or replacement of an existing facility: or the relocation of a facility from one installation to another. This includes equipment installation as part of facilities, related site preparation, excavating filling and landscaping or other land improvement, or upgrading of an existing, single, real property facility.

Contract Discrepancy Report. A written documentation of Contractor non-conformance or lack of performance for contracted work. This document will reflect the time the contractor was notified of unacceptable performance. If the contract fails to meet the Correction Time, this report will reflect the deduction to be taken on the contractors invoice.

Critical Equipment and Facilities. Equipment and facilities that must operate continuously to support critical missions. Failure of the equipment or facilities in meeting the design requirements may affect the Government mission capabilities; the health and welfare of Government personnel; or damage Government equipment, property, or research programs. Emergency or urgent service calls are often required to restore the critical equipment to optimum operating condition and to provide the output required.

Davis-Bacon Work. The Government will make determinations as to the applicability of the Davis-Bacon Act to specific work. Davis-Bacon work exceeds $2,000 (labor, material and overhead) for construction, alterations or repair (including painting and decorating) of all buildings or facilities. All work of this type will be subject to the provisions of the Davis-Bacon wage determination. The Contractor shall be responsible for ensuring that the minimum wages specified in the wage determination is paid to the employee working on this type of work.

A request for the correction of failure or deficiencies which constitute an immediate danger or are a health hazard to persons or which threaten damage to property or research projects. Some example are gas leaks, unacceptable temperatures during work hours, electrical malfunctions endangering life or property, running water that can damage property, plugged drains, stopped-up commodes where only one commode is available, sewage backup, and storm damage with broken windows.

Emergency Work. Emergency work shall be any unforeseen circumstance or combination of circumstance resulting in failure of electrical power or problem with any facility covered by this contract and requiring immediate action. An emergency may be declared by the Administrative Contracting Officer or designated government official at any time, day or night.

Government Furnished Equipment (GFE). All government facilities, equipment/property, and supplies provided to the Contractor to be used and/or expended by the Contractor carrying out responsibilities set forth in this contract (See Appendix 8). The Quality Control System used to implement the plan shall be automated using current computer aided techniques that are compatible with existing on-site Government systems.

Remedial Maintenance. Repair of buildings and structures and their installed equipment, utility system, and process and non-process equipment, in accordance with manufacturers, recommendations, or standards within the industry, to restore it to its proper operating condition. This term may be used interchangeably with “repair.”

Repair may be overhaul, reprocessing, or replacement of constituent parts or materials that have deteriorated by action of the elements or usage and have not been corrected through maintenance. In replacing constituent parts of utility systems, improvements can be made in the design of materials utilized, provided that such improvement will result in lower maintenance or operating costs over the projected life of the system equal to or greater than the cost of improvement over replacement in kind. The cost involved in the modernization of utility systems to improve the production or use of utilities, within the existing plant, shall be chargeable as a repair.
