Amend 005 AG-32SC-S-13-0008 08/09/2013

1) Will the contractor be exempt from paying the deductible for repairs performed on IDL items. The IDL shall be reviewed/negotiated and accepted by the Gov. The Government shall provide a scope(s) of work (if necessary) to the Contractor to pursue as additional work items to repair the items on the list.

2) Was Attachment A.3.1.2 non-specialty gases included in the Summary of Attachments? We could not locate it. This attachment reference will be deleted via Amendment.

3) PWS 2.1 Routine Work – Section lists Contractor’s liability for all Routine Work. It is assumed that contractor is to complete work without seeking government approval for any and all Labor and/or Material costs over the thresholds listed herein, and submit the overages to the government for reimbursement via the “Additional Work” CLIN. Is that correct? Incorrect, See Answer to question #8. The contractor must include the approval process in the schedule to ensure the work is completed within the time requirements for that routine task. The government does not anticipate a significant amount of routine tasks exceeding the thresholds.

4) PWS 2.1 Routine Work – Section lists Contractor’s liability for all Routine Work It is assumed that Routine work only applies to that equipment listed in Attachment 2.2.1. Is that correct? Incorrect. Attachment 2.2.1 is believed to be largely inclusive, but as in any large complex the equipment utilized changes over time. The routine work applies to any equipment, components, systems, etc. that are utilized to operate the facility.

5) PWS 2.1 Routine Work – Section lists Contractor’s liability for all Routine Work It is assumed that all Subcontractor/Service Subcontractor costs utilized for Routine Work will be considered Material for threshold purposes. Is that correct? Incorrect. All Labor (regardless or origin) shall be counted against the Labor Threshold. See Answer to Question #6

6) PWS 2.1 Routine Work – Section lists Contractor’s liability for all Routine Work It is assumed that all equipment, supplies, materials, other direct costs utilized for Routine Work will be considered Material for threshold purposes. Is that correct? Incorrect. Anything NON-LABOR would apply to the material Threshold

7) PWS 2.1 Routine Work – Section lists Contractor’s liability for all Routine Work It is assumed that all equipment, facilities, structures, buildings, rooms included in this contract will be in full operational and certified condition before the start of this contract. Is that correct? Incorrect. It is understood that there will be some unresolved issues when the Contract changes hands. The building will never be functioning at 100%. This language was installed to ensure that the Outgoing Contractor put forward their best effort towards resolving issues instead of leaving them for the follow on Contractor. As an example if a piece of equipment is broken the Outgoing Contractor should order the parts, the incoming Contractor May need to install the parts after they come in.

8) PWS 2.4 Additional Work Please provide a process for tasks that grow into Additional Work. There are two primary types of additional work

a. Routine work which exceeds the thresholds established in PWS 1.2 and then migrates into AW’s.

i. These limitations generally only apply to corrective work.

ii. The government will cover costs that exceed the thresholds.

iii. It is not required that both thresholds are met.

iv. As the Contractor becomes aware that the thresholds will/may be surpassed they shall notify the Gov. for direction and possibly the allocation of funds.

v. The intent of the limitations was to limit the Contractors exposure or risk due to the malfunctioning of large pieces of equipment and/or significant unforeseen issues which require a large effort by the Contractor associated with maintaining the facility.

b. Elective work which has a defined scope of work and is separately funded 100% by the government.

*All additional work shall have PRIOR APPROVAL of the government to proceed in all occasions.

**All Additional work shall be separately negotiated and shall be subject to using the Fully burdened Labor rates included in the Schedule B for ALL Labor pricing.

*** All additional work shall be separately funded and not priced within the fixed price.

9) PWS 2.4 Additional Work – section defines Additional Work. It is assumed that all minor construction tasks would be considered “Additional Work”. Is that correct? Incorrect, Any Minor Construction done within the umbrella of the Routine work shall be considered in the fixed price.

10) PWS 2.4 Additional Work – section defines Additional Work. Any and all repair work for Equipment not included in Attachment 2.2.1 would be reimbursed, in total, as Additional Work. Is that correct? Incorrect. See above response to question #04

11) Will the contractor be allowed to defer IDL inspections on equipment/systems that are seasonally off line or have a later in the year annual testing date? No. The inspections will be conducted during the transition period. Unless the successful offeror makes the government aware of such a situation during the transition period the government may make an exception at its discretion.

12) Does the current water treatment equipment convey the incoming contractor or belong to the Government and/or the incumbent contractor? The government owns the water treatment equipment.

13) For the monthly & annual load bank generator test, is the O&M contractor required to provide a load bank or can the buildings load be used? Please clarify per building. There is no requirement for load bank testing.

14) Are there current roof warranties in place for each building? If so please identify each building. The VSB has a new roof and a warranty that extends beyond the contract dates. Sections of the main building have warranties on the membrane.

15) Section L.5.c Business Proposal Instructions According to the price proposal instructions, offerors shall justify all direct labor prices, including a breakdown by labor category of the hours proposed for each discrete piece of work. Does the government consider each discrete piece of work the 5 functional areas listed on the Price Schedule (Work Management, Administrative Services, Safety, Utilities Services, and Facility Services)? YES

16) PWS Section 3.2.3 Watchperson Services Section 3.2.3 of the PWS discusses Watchperson Services. Many states require individual state licensing in order to provide watchperson (security guard) services. Is there a requirement for the individuals to be licensed in the state of PA to provide watchperson services? There is no licensing requirement. Watchpersons need to pass the security clearance per SOW para 3.2.2. Current watchpersons are classified SCA Guard 1.

17) PWS Section 3.2.3 Watchperson Services Section 3.2.3 of the PWS discusses Watchperson Services. Many states require corporate state licensing in order to provide watchperson (security guard) services. Is there a requirement for the company to be licensed in the state of PA to provide watchperson services? See 18 above.

18) RFP Section F RFP Paragraph F.3, “REPORTING REQUIREMENTS”, states in part: The Contractor shall provide the following deliverables/reports to the ACO by the specified due dates. Unfortunately, section F of the RFP includes no dates. Would the Government please publish a list of due dates for the contract deliverables? The frequency requirements specified in the PSW should be adequate for pricing purposes. The detailed dates required to meet the government’s own reporting requirements will be conveyed to the successful offeror during the transition period.
