THIS SOLICITATION IS SET-ASIDE FOR HUBZONE SMALL BUSINESS CONCERNS. IF WE DO NOT RECEIVE ENOUGH COMPETITION FROM THE HUBZONE SMALL BUSINESS CONCERN SET-ASIDE, WE WILL THEN EVALUATE QUOTES AND CONSIDER FOR AWARD SMALL BUSINESS CONCERNS. MINIMUM AND MAXIMUM CONTRACT AMOUNTS (FEB 1988)
During the period specified in FAR clause 52.216-18 ORDERING, the Government shall place orders totaling a minimum of $2,000_, but not in excess of $990,000 _
B-1 BONDING REQUIREMENTS
Bonding requirements are based on the total offer (both at initial award and subsequent Task Orders).
•For total offers that are greater than $100,000 a bid bond, a performance bond, and a payment bond are required. FAR 52.228-1, 52.228-2, 52.228-11, 52.228-14, and 52.228-15 are applicable. See Section I.
•For total offers that exceed $30,000 but do not exceed $100,000 a payment bond or an irrevocable letter of credit are required. FAR 52.228-2, 52.228-11, and 52.228-13 are applicable.
•For total offers that are less than $30,000 no bonding is required and no bonding clauses are applicable.

This contract is mandatory use for the Umatilla National Forest, and optional use by the Malheur and Wallowa-Whitman National Forests and applicable Region 6 Economic Recovery Operations Centers (EROC).
Task orders may be issued verbally, by facsimile, or by electronic commerce methods. Warranted Contracting Officer’s in the Blue Mountain Acquisition Area and in the EROC supporting Region 6 can place orders against this contract.
Offerors are not required to offer on all Items on the Schedule. Offerors may choose to limit the number of Items for which they wish to receive award.
A number of contracts will be awarded as a result of this solicitation. The actual number of awards will be dependent on offers received and the best value analysis process, but the intent is to have a sufficient number of awardees to provide a pool for competition of task orders.
A task order will be placed with each contractor at time of award. Initial individual task orders will meet or exceed the minimum order amount (including award of any combination of Items from the Schedule).
After initial award, task orders will be competed among the awarded contractors, throughout the life of the contract, in accordance with the “Task Order Issuance and Fair Opportunity” clause in the contract. Contractors are not bound to compete for these task orders. These task orders will usually be competed based on a best value analysis using price and past performance with the factors approximately equal. An emphasis will be placed on past performance of previous task orders under this contract. The Government reserves the right to add evaluation factors in circumstances it deems appropriate. In all cases price will remain approximately equal to all other evaluation factors.
If a contractor is awarded multiple task orders work shall be completed concurrently unless otherwise specified in a task order.
Section C - Description/specifications/Statement of Work
C-1 DESCRIPTION OF WORK
General
This solicitation is for repair or minor construction/reconstruction work on existing Government-owned buildings at various locations on the Umatilla, Malheur, and Wallowa-Whitman National Forest in the states of Idaho, Oregon and Washington. The Government anticipates making sufficient multiple awards to accommodate adequate task order competition.
This is an indefinite delivery, indefinite quantities contract spanning 5 years.
Performance activities:
Task orders may be issued for project work on, but not limited to, Forest Service rental cabins, bunkhouses, offices and single family residences, guard stations, warehouses, lookout towers, and other storage facilities such as tree coolers, vehicle garages and bays on the Umatilla National Forest which includes the states of Oregon and Washington.
Project work includes, but is not limited to, roof repair or replacement, truss repair or replacement, siding repair or replacement, interior and exterior painting, repair or installation of exterior and interior doors, floor installation or repair, window and pane repair or replacement, construction to meet Americans with Disabilities Act (ADA) standards for accessibility, building demolition and disposal, minor site work such as tree removal, brush trimming, site drainage, and placement and compaction of aggregate on walkways and driveways.
Bunkhouse facilities scheduled for repair/reconstruction will not be occupied. Warehouses may be in daily use; Project warning signing shall be required.
Rental and bunkhouse facilities may have a mandatory performance period to insure vacancy. Restrictions shall be noted on the Task Order.
Contractor will be provided access to existing Utility systems for camping and project use; this will be a discussion item at the pre-work. Camping permit may be issued at District Ranger discretion.
Applicable specifications:
Standard or Special Project Specifications will be shown in the specification listing contained in the task order. All specifications not included in the specification listing but referenced by listed specifications, are applicable. Each Task Order will include the applicable Special Project Specifications.
Government-furnished Property:
If the Government provides property (GFM) for use in the performance of this contract, it will be designated in the task order. This property shall be used and maintained by the Contractor in accordance with the provisions of the "Government Property" FAR clause contained elsewhere in the contract.

At the Athena junction, take State Highway 204 towards Tollgate/Elgin for approximately 20 miles to Forest Road 64. Turn onto Forest Road 64 and proceed for approximately 500 feet and turn left into the Tollgate Information Center parking area. Period of performance will be 30 days from the notice to proceed date. |

Turn left off Highway 244 into District office parking lot. Warehouse and Tree Cooler are located behind the main office. Period of performance will be 30 days from the notice to proceed date. |
Site 3 Ukiah Tree Cooler, North Fork John Day Ranger District Directions from Pendleton: Proceed south on State Highway 395 (towards John Day) for approximately 55 miles to junction State Highway 244; Turn onto State Highway 244 and proceed one mile to Ukiah, OR and North Fork John Day Ranger District office. Turn left off Highway 244 into District office parking lot. Warehouse and Tree Cooler are located behind the main office. Period of performance will be 30 days from the notice to proceed date.
Site 4: Option item – award based on availability of funding Godman Cabin, Pomeroy Ranger District Directions from Dayton, WA: Enter Dayton WA northbound via State Highway 12; turn right (as if you are going to Bluewood Ski area); in approximately 0.5 miles turn left onto Ekler Mountain Road (County road 9124). Proceed approximately 10 miles to junction County Road 1424 and 1931. Continue on County Road 1424 (Skyline Road) to Forest Boundary 2.5 miles ahead. Continue on Forest Road 46 Kendall-Skyline Road for approximately 10 miles to Godman Guard Station. Period of performance will be 30 days from the notice to proceed date.
Site 5: Option item – award based on availability of funding Long Meadows Guard Station, Walla Walla Ranger District:
Directions from Pendleton: Proceed north on State Highway 11 (towards Milton-Freewater) for approximately 20 miles. At the Athena junction, take State Highway 204 towards Tollgate/Elgin for approximately 20 miles to Forest Road 64. Turn left onto Forest Road 64 and proceed for approximately 10 miles to Forest Road 63; turn right onto Forest Road 63 and proceed approximately 9 miles to junction Forest Road 62. Site 6: Option item – award based on availability of funding Umatilla NF Radio 1411 SE Byers, Pendleton, OR
Directions from Pendleton: From I-84 Exit 210 (near Red Lion) proceed north on Hwy 11 to overpass and Court Street intersection with stop lights. Proceed ahead through the stop light; onto Court Place road curves slightly to the right; proceed two block to 12th Street; turn left and proceed ahead one block to Byers; turn right onto Byers; proceed ahead past Washington Elementary School. Umatilla National Forest Warehouse Compound is first left past the school yard. Note: Compound is gated and locked weekends and after 4:30 pm on weekdays. Period of performance will be 30 days from the notice to proceed date.

For service work:
All work shall be performed in accordance with the attached performance based standard specifications unless otherwise specified in a task order.
Acceptable Quality Levels (AQLs) for each performance standard are also established in the attached documents. AQLs may vary between forests. These AQLs will apply to all ordered work unless otherwise specified in a task order.
The attached performance standards, typical drawings, and AQLs are part of this solicitation and any resulting contract.
E-3 CONTRACTOR QUALITY CONTROL INSPECTION

Contractor Quality Control
The successful Offeror(s) shall provide a written Quality Control Plan satisfactory to the Government describing how contractor will control work quality and document inspection results for awarded pay items.
Contractor shall conduct ongoing quality control inspections in accord with the approved plan. Contractor shall also provide written certification for all invoiced work that was accomplished in accordance with the terms and conditions of the contract.
Inspection shall be maintained concurrent with contract work. Contractor inspection results shall be available to the Contracting Officer at all times

The Government may make periodic inspections while work is in progress. After completion of a pay item, the Government may also inspect to determine compliance with performance standards and acceptable quality levels. F-2 52.211-10 Commencement, Prosecution, and Completion of Work. (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than the time specified in the task order or as described in the "Schedule". Work is estimated to begin on June 15, 2009. Contract time will be determined for each task order issued depending on work windows, environmental issues, and the amount of work ordered. The time stated for completion shall include final cleanup of the premises.
F-3 FOR INDEFINITE-QUANTITY CONTRACTS:
Contract time will be determined for each roofing task order issued allowing minimum of one contract day for each 50 square feet of roofing to be replaced. Other factors that may affect number of days allowed are mobilization distances greater than fifty miles, need to schedule/block out work days, complexity of project work such as requiring multiple installation of ridge and utility caps, flashing and underlayments, heights above ground requiring additional safety measures, such as scaffolds.

F-5 SCHEDULES FOR SERVICE CONTRACTS
Contractor shall, within ten (10) days from receipt of a request from the Contracting officer, submit a time chart or schedule of proposed progress to ensure completion of the work within the time set forth in this contract. If the Contractor's progress falls behind the schedule, Contractor shall take such action as necessary to improve progress; in addition the Contracting Officer may require the Contractor to submit a revised schedule and proposed plan of work to ensure completion of the work within the time specified.
F-6 452.236-75 Maximum Workweek - Construction Schedule. (NOV 1996)
Within five calendar days after receipt of a written request from the Contracting Officer, the Contractor must submit the following in writing for approval:
(a) A schedule as required by FAR clause 52.236-15, Schedules for Construction Contracts, and
(b) The hours (including the daily starting and stopping times) and days of the week the Contractor proposes to carry out the work.
The maximum workweek that will be approved is: 6:00 AM to 7:00 PM Monday through Friday; no work to occur on major holidays from 12 noon the Friday before the holiday through Monday of the designated holiday. For the purpose of this contract, designated holidays are Memorial Day, Fourth of July, and Labor Day.
Section G - Contract Administration Data
G-1 452.215-73 Postaward Conference. (NOV 1996)
A post award conference with the successful offeror is required. It will be scheduled within 15 days after the date of contract award. The conference will be held at: the Umatilla National Forest Headquarters office or other location agreed upon.
G-2 MEASUREMENT AND PAYMENT
1) Service Task Orders: All measurements and payments are as defined in the forest service performance based maintenance Specifications (as included elsewhere in this document).
2) Construction Task Orders: All measurements and payments are as defined in the Task Order. Payment shall be made for completed and accepted quantities of work under the designated pay item(s). Payment for all contract work will be made, either directly or indirectly, under the pay items shown in the Task Order.
Work incidental to a designated pay item includes but is not limited to safety signing and fencing, equipment and labor mobilization, material loading and haul, site clean up, bonding (if required), and other work required to accomplish the designated Task(s).
Payment will be made for the actual quantities of work performed and accepted. No payment will be made for unauthorized items.
Compensation provided by the pay items included in the task order(s) is full payment for performing all contract work in a complete and acceptable manner. All risk, loss, damage, or expense arising out of the nature of prosecution of the work is included in the compensation provided by the task order pay items.
G-3 CONTRACT RELEASE
When submitting final payment, Contractor shall provide a signed and dated contract release that includes the following information: "In consideration of receipt of final payment in the amount of $__________ Contractor hereby releases the United States of America from any and all obligations arising under this contract and any modifications thereof except as reserved herein. Reservations:______________".
G-4 GOVERNMENT-FURNISHED PROPERTY

H-1 PRODUCT SUBSTITUTION
Any modification of other items, designs, materials, products or equipment (including Government-furnished property), made necessary because of a substitution, will be the responsibility of the Contractor without adjustment in contract price or time. The Contracting Officer's approval of any substitute will not affect the Contractor's responsibility for such modification. Any and all substitutions will be requested by the Contractor after award of the contract has been made. No approvals will be made prior to award.
A. When submitted within 30 days after contract award, the Contracting Officer will consider formal requests for substitution of products, equipment and methods, in place of those specified. Requests submitted after 30 days will be considered only in case of product unavailability or other conditions beyond the control of Contractor. Requests shall provide the information and be in the format as specified in paragraph B below.
B. Submit separate request for each substitution. Support each request with:
1. Complete data substantiating compliance of proposed substitution with requirements stated in contract documents:

F. Number of Substitution Submittals: Only one proposed alternative will be considered for each item. Provide specified item if substitution proposal is rejected.
H-2 CONTRACTOR'S REPRESENTATION & RESPONSIBILITY
A. In making formal request for substitution the Contractor represents he/she:
1. Have investigated proposed product and determined that it is equal to or superior in all respects to that originally specified.
2. Will provide same warranties and bond for substitute as for originally specified product.
3. Will coordinate installation of accepted substitution into the work, and will make such changes as may be required for the work to be complete in all respects.
4. Will waive claims for additional costs caused by substitution, which may subsequently become apparent.
5. Cost data is complete and includes related costs under the contract, but not:

H-4 LANDSCAPE PRESERVATION
The Contractor shall give attention to the effect of contract operation upon the landscape, shall take care to maintain natural surroundings undamaged, and shall conduct the work at all times in compliance with the following requirements.
a. Prevention of the Landscape Defacement. The Contractor shall not remove, deface, injure, or destroy trees, shrubs, lawns, or other natural features or any other improvements in the work area unless specifically authorized by the Contracting Officer. Unless otherwise provided herein, the Contractor shall confine contract operations to within the areas designated in contract documents.
b. Protection of Streams, Lakes, and Reservoirs. The Contractor shall take sufficient precautions to prevent pollution of streams, lakes, small ponds, and reservoirs with fuels, oils, bitumens, calcium chloride, silt, or other harmful materials. Mechanical equipment shall not be operated in live streams without written approval of the Contracting Officer.
H-5 ROAD USE AND MAINTENANCE

(a) The Contractor is authorized to use roads that are a part of the construction project and those Forest Service roads designated below for performance of work under this contract.

(b) If the Contractor requests use of a National Forest road or segment not designated for his use, the Forest Service may authorize such use if not in conflict with the current Road Rules document. Authorization to use such additional roads may include maintenance requirements and use limitations.
(c) The roads authorized for use will be subject to the following provisions.
1. The Road Rules in the current Umatilla National Forest Road Rules Document are applicable to all commercial road users. This document is available for inspection at the office of the Forest Supervisor and shall be applicable except when modified by provisions of the contract.
2. State laws governing traffic rules and equipment requirements on State and County highways.
3. Federal regulations contained in 36 CFR 261.12. These regulations prohibit use of vehicles or equipment in excess of State legal highway loads or posted limits without valid State and Forest Service overload permits, damaging a road while using it, and blocking a road open to use by others, except as may be otherwise provided in the contract.
Load Limits - All vehicles and equipment shall not exceed State legal highway loads and widths or posted limits without valid State and Forest Service overload, overwidth permits. Forest Service overload permits for this project may be obtained from the District Ranger.
4. Federal Regulations contained in 36 CFR 261.54 as applied to the area by an order issued under 36 CFR 261.50. These regulations authorized the Forest Service, as a sovereign act, to issue additional restrictions and closures any time conditions warrant. Such closures will be in addition to those shown in the current Road Rules Document and will be posted on the road.
H-6 TRAFFIC CONTROL
The Contractor shall provide, erect and maintain all necessary barricades, suitable and sufficient lights, danger signals, signs, and other traffic control devices, and shall take all necessary precautions for the protection of the work and safety of the public. Roads closed to traffic shall be protected by effective barricades, and obstructions shall be illuminated during the hours of darkness. Suitable warning signs shall be provided to properly control and direct traffic.
The Contractor shall erect warning signs in advance to any place on the project where operations may interfere with the use of the road or trail by traffic and at all intermediate points where the new work crosses or coincides with an existing road or trail. All road barricades, warning signs, lights, temporary signals, flagman and pilot car operators and equipment, and other protective devices, except for special devices, shall conform with Part VI of the Manual on Uniform Traffic Control Devices for Streets and Highways, published by the Federal Highway Administration and applicable safety codes.
The Contractor shall furnish, erect, maintain, and remove when notified any project identification signs shown on the drawings
Necessary warning signs and guards shall be posted during blasting operations to safeguard the public.
H-7 SAFETY
Project work environment may include working around machinery, climbing on roofs or scaffolding, dismantling buildings and components, exposure to flying/moving debris, stepping/tripping hazards among demolished/removed materials are part of the inherent hazards of facility maintenance and construction work. The risk of injury by contractors and employees repairing, reproofing, painting or performing other construction and repairs on government facilities includes falling hazards when working above ground level on roofs or scaffolding, fumes from materials such as paint, and impact injuries from hammers or other equipment.
Long drives to project sites via Federal, State and local jurisdiction road systems with varying degrees of maintenance potentially increases Contractor and employee risk of motor vehicle accidents. Public and commercial use of these same road systems adds an additional hazard to Contractor and employee safety. Equipment operation on project sites and contractor traffic is a potentially hazardous condition for public traveling through or adjacent to the construction sites.
Contractors shall provide a project specific safety plan at the post-award conference for all work activities. Safety signing, barricades, fencing, and traffic control in compliance with Manual on Uniform Traffic Control Devices (MUTCD) will be required.

H-8 PERSONAL PROTECTIVE EQUIPMENT
The contractor will train in the safe operation and use of equipment to all workers using such equipment.
Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards or processes encountered in a manner capable of causing injury or impairment in the function of any part of the body.
Defective or damaged personal protective equipment shall not be used.
The contractor shall provide, at no cost to the employee, to each employee who operates a chain saw, chain saw chaps and assure the chaps are worn during saw operations. These chaps must be approved by Underwriters Laboratory or meet Forest Service specification 6170-47. The chaps shall cover the full length of the thigh to the top of the boot on each leg.
The contractor shall assure that each employee wears foot protection that provides adequate traction and ankle support. Employees operating chain saws shall wear foot protection that is constructed with cut-resistant material which will protect the employee against contact with a running chain saw.
The contractor shall provide, at no cost to the employee, and assure that each employee who works in an area where there is potential for head injury from falling objects or flying objects wears a hard hat that meets the minimum requirements of American National Standards Institute (ANSI) standard Z89.1-1997.
The contractor shall provide, at no cost to the employee, eye protection where there is potential for eye injury due to flying objects. This eye protection must meet the minimum requirements of ANSI standard Z87.1-2003.
The contractor shall provide, at no cost to the employee, hearing protection where there is a potential for hearing loss due to high intensity noise e.g., chain saw operation.
H-9 Suspensions for Other Than Government’s Convenience
The Contracting Officer may issue orders to suspend the work wholly or in part for such period of time as deemed necessary because of: (1) Weather or ground conditions when further prosecution of the work might cause environmental or resource damage to the project, access roads to the project, or adjacent property. Such action would include but not be limited to instances such as siltation of streams, damage to access roads, rutting of project roads which causes otherwise suitable soils to become muddy or unsuitable; or (2) Failure of the Contractor to comply with Specifications such as but not limited to placement of frozen material in fills, placing of asphalts at temperatures lower than those specified, performing work prior to prerequisite approvals, operating equipment not meeting fire requirements, or when conditions exist which do not meet safety requirements. Whether or not a suspend work notice is issued, the Contractor shall be responsible for correcting any damage caused by his/her operation, whether inside or outside project limits, at no cost to the Government. Such suspensions shall not be considered as suspensions for the Convenience of the Government under FAR 52.242-14, Suspension of Work, and shall not qualify for equitable adjustment.

52.216-18 Ordering. (OCT 1995)
(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from date of award through April 30, 2014.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.
52.216-19 Order Limitations. (OCT 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,000 for construction or $2500 for service, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor -
(1) Any order for a single item in excess of $50,000.00;
(2) Any order for a combination of items in excess of $150,000.00; or
(3) A series of orders from the same ordering office within 3days that together call for quantities exceeding the limitation in subparagraph (b)(1) or (2) of this section.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 3days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons.
