Use a third party laboratory accredited by the AASHTO accreditation program. Provide proof of the laboratory’s accreditation for the test procedures to be used. Do not use the same laboratory that produced the disputed
Appendix A-4, Supplemental Specifications, Page 8 of 23
Government test results or that produced the test results used as a basis for the dispute.
The CO will review the proposed resolution protocol and may modify it before final approval and execution.
The Government will use the approved resolution protocol test results to determine the validity of the disputed testing. If the Government test results are validated, the Contractor will be responsible for all costs associated with developing and performing the resolution protocol. If the Government test results are not validated, the Government will be responsible for all costs associated with developing and performing the resolution protocol. If the validity of the Government test results cannot be determined, the Contractor and Government will equally share all costs associated with developing and carrying out the resolution protocol.
(b) Alternatives to removing and replacing non-conforming work. As an alternative to removal and replacement, the Contractor may submit a written request to:
(1) Have the work accepted at a reduced price; or
(2) Be given permission to perform corrective measures to bring the work into conformity.
The request must contain supporting rationale and documentation. Include references or data justifying the proposal based on an evaluation of test results, effect on service life, value of material or work, quality, aesthetics, and other tangible engineering basis. Test results from a certified seed analyst and seed analysis labels attached to the bags will be provided to the COR. Lab testing for noxious weeds will be conducted prior to seed mixing. Only after a finding and documentation in writing of no weeds on the current "All States Noxious Weeds List" will the seed be accepted and used.
To avoid weed contaminated seed, each lot must be tested by a certified seed laboratory against the all State noxious weed lists and documentation of the seed inspection test provided.
Appendix A-4, Supplemental Specifications, Page 20 of 23
The origin of Wildland native seeds is verified by a certification of the Source Identified Class with an attached yellow tag.
When using commercially purchased seed check with the supplier for the seed source point of origin. Point of origin should be as close to the revegetation project as possible.
Seeding elevations should be within 1000 feet below or 500 feet above the seed origin elevation.
625.08 Mulching
Mulch material will be certified (tagged) weed free straw or grass hay only.
Wood cellulose fiber or paper mulch may be applied by hydraulic equipment with water as the carrying agent. Continuous agitation of the mulch will be maintained to provide uniform suspension and distribution of the material. Apply mulch from the top of the slope to the toe of the slope at a rate of 2,000 pounds/acre.
Commercially available tackifiers can be used as mulch binders. Application should be evenly distributed over the revegetation site. Refer to manufactures product guidelines for recommended uses, application methods and rates.
Determine the pounds of seed to be furnished per acre by dividing the pounds of pure live seed required per acre by the product of the percent purity and percent germination.
Example 5 lbs. pure live seed/acre . commercial =
0.90 x 0.85 seed per acre; purity = 90% and germination = 85%

Tanacetum vulgare common tansy
Materials
680.02 Requirements. The following herbicides are approved for use:
Picloram (Tordon 22-K, or approved equal)
2,4-D (Weedar 64, Formula 40, or approved equal)
Construction
680.03 General. Spray all roads designated for decommissioning prior to move-in of construction equipment.
Notify the Forest Service 48 hours prior to spraying. Do not begin application without authorization from the CO.
680.04. Safety. Comply with all Worker Protection Act Guidelines.
At least 28 days before beginning spraying operations, submit a written plan for acceptance that details the measures to be used for protecting the environment, public, private property and workers. Include in the plan the following:
(a) Manufacturer’s material safety data sheets and product data sheets for all herbicides.
(b) Emergency spill procedures
Appendix A-4, Supplemental Specifications, Page 22 of 23
680.05 Applicator Qualifications and Supervision. Mix and apply herbicides under the direct supervision of a person licensed by the State of Montana Department of Agriculture for commercial application of restricted chemicals.
680.06 Mixing. Use safe handling practices that conform to the manufacturer’s safety data sheet and instructions. Transport herbicides daily to the project site. Transport only the quantity needed for that day’s work. Transport concentrate in containers that will hold 150 percent of the amount of concentrate, in a manner that will prevent tipping, or spilling. Transport concentrate in a compartment that is isolated from food, clothing and safety equipment.
Transport mixing and cleaning water in labeled containers separate from water used for other purposes. Water may be used from live streams. If streams are used, provide a method by which water can be pumped into the holding vehicle at least 100 feet from the stream. Include a valve to prevent back siphoning. Attend equipment at all times during pumping.
Mix all herbicides onsite. Do not mix or load equipment within 200 feet of any stream, open water or private land. Do not mix or load equipment near areas of concentrated public use (i.e.
dispersed recreation sites, etc.). Include purple dye in all herbicide mixtures at a rate of 1 ounce per gallon. Load hand equipment on a double layer of 5-mil plastic large enough to contain any spills. Load and mix motorized equipment on an impervious surface that will not allow mix to flow toward water.
Where two herbicides are to be sprayed at the same site, clean tanks prior to changing herbicides.
Use water to triple rinse tanks and spraying equipment. Dispose of rinse residue according to herbicide label restrictions.
680.07 Application. The Contractor is responsible for selection of appropriate chemicals for site-specific conditions with the following restrictions:
a.) Do not apply Picloram (Tordon 22-K) within riparian areas, in ditches that lead to creeks or areas with shallow ground water tables as evidence by local vegetation.
b.) Do not spray open water with any chemical.
Select application methods and rates to minimize potential for drift and non-target impacts while meeting the weed control objectives. Do not exceed the following application rates:
a.) Picloram (Tordon 22-k); 2 pints herbicide per acre.
b.) 2,4-D (Wedar 64, Formula 40): 2 quarts herbicide per acre.
Monitor weather conditions before and during all spraying operations. Do not spray when any of the following conditions exist:
a. Hand-held equipment: Temperature exceeds 98 degrees F.; humidity is less than 20 percent; wind exceeds 15 miles per hour.
b. Truck-mounted equipment: Temperature exceeds 95 degrees F.: humidity is less than 30 percent; wind exceeds 10 miles per hour.
Appendix A-4, Supplemental Specifications, Page 23 of 23
Do not spray herbicides when rain is expected within six (6) hours of completion of the treatment.
Do not spray within 30 feet of open water without prior approval from the CO.
Use backpack sprayers or hand-held sprayers from mobile tanks to apply liquid herbicides. Do not use truck-mounted sprayers unless approved by the CO. Use equipment that is in good mechanical condition. Inspect all equipment prior to beginning work. Calibrate all equipment and furnish calibration documentation to the CO prior to beginning work. Submit equipment for spot inspection by the CO if requested.
Use nozzles and other technology that will minimize drift and potential for non-target impacts.
Use nozzles made of stainless steel or ceramic material. Do not exceed 20 psi spray pressure to avoid drift.
Use a tight fitting lid on all spray tanks.
Inspect all equipment for leaks daily.
Remove all herbicide containers from National Forest Land and dispose of them in accordance with all local, state and federal requirements.
680.08 Method. Use the method of measurement that is DESIGNATED IN THE
