Minority Business Enterprise Goal and Subgoals, MBE Liquidated Damages and Veteran Small Business Enterprise Goal

The MBE goal of this contract is 30%, with subgoals of 2% for Hispanic American-owned, 3% for Asian American-owned and 10% for Women-owned MBE firms.

This is a state funded contract. Certified MBEs bidding as Prime Contractors may utilize themselves towards the MBE Goals of this contract. MBEs bidding as a Prime may count the distinct, clearly defined portion of the work of the contract that falls within its certification that it performs with its own forces towards fulfilling up to 50% of the established MBE participation goal and up to 100% of not more than one of the MBE participation subgoals, if any are established. If an MBE prime wishes to count itself, it must be identified on the MBE participation schedule and include the certification category under which it will self-perform the work and indicate the percentage of the contract value to be attributed to that work. An MBE prime is required to adhere to the good faith effort requirements for the portion of the contract goal it is not self-performing and is subject to all other MBE contract compliance requirements.

Please note that this is a State funded contract, therefore subcontractors proposed under this contract for purposes of meeting the MBE goal and subgoals, shall be MBE certified at time of proposal submittal.

Records Retention (COMAR 21.06.05.03): The contractor or subcontractor shall maintain books and records that relate to the cost of pricing data for 3 years from the date of the final payment under the contract, unless a longer period is otherwise specified in the contract.

Prompt Payment to Subcontractors (COMAR 21.07.02.05-2§B-C): The contractor shall promptly pay a subcontractor any undisputed amount to which a subcontractor is entitled to under a State procurement contract for construction. This payment shall be made within ten (10) days of receiving a progress payment or final payment from the state. “Undisputed amount” includes the retainage on a contract.

Amendment of MBE Participation Schedule (COMAR 21.11.03.12) Amendment for Unforeseen Circumstances: Any proposed changes to the approved MBE Plan must be submitted in writing to the Socioeconomic Manager for approval prior to commencement of work. Substitution or modification of the approved MBE Plan can only be approved by the MVA’s Administrator.

Policy Directive: Upon request from the procuring agency or MBE Compliance Office, the offeror/contractor will submit copies of canceled checks, if those documents are needed to resolve payment disputes.

Liquidated Damages (COMAR 21.07.01.14): There will be a mandatory provision for all contracts with certified MBE participation goals and any other contracts deemed appropriate by the procurement officer in consultation with the Office of the Attorney General. The contractor/subcontractor will be required to submit payment reports in full compliance with COMAR 21.11.03.13B(4). Liquidated damages will be assessed per day until the monthly report is submitted as requested.

The five key items to look at are when utilizing the MBE forms are:

• MDOT MBE Form A, Certified MBE Utilization and Fair Solicitation Affidavit

Scope of Work

Mr. Alan Holloway will speak on the Scope of Work.

The Maryland vehicle emission inspection program (VEIP) consists of 18 centralized inspection stations, 10 self-serve kiosks, a Fleet Inspection Station (FIS) program. It shall be noted that the State owns all the VEIP station properties and buildings. The selected Offeror, either directly or through its subcontractor(s), must be able to provide all goods and services and meet all the requirements requested in this solicitation. While maintaining responsibility for Contract performance regardless of subcontractor participation in the work.

The VEIP program is jointly managed by the MDOT MVA and Maryland Department of the Environment (MDE), with MDOT MVA currently managing daily operational aspects of the program. It is a highly visible program that has a strong track record of environmental benefits, motorist convenience, and low motorist fees. VEIP is an integral part of the State’s mission to reduce air pollution. Emissions reductions achieved by VEIP are crucial to meeting national health-based air quality standards for ozone, a pervasive air pollutant. The ongoing effectiveness of the VEIP is in no small part due to Maryland’s high operational standards and keen attention to motorist acceptance and convenience. Maryland will continue to require exemplary customer service, initiating with the planning and execution of the Contract transition. Technology advances and changes in fleet composition necessitate several key test procedure modifications that will improve customer convenience as well as program efficiency.

Key Features

1. 6 model year exemption beginning day 1,

2. OBD testing, when possible, and idle testing in the 14-jurisdication VEIP area, on a biennial test cycle, of vehicles weighing up to 26,000 lbs. day 1.

3. Motorist fees shall remain unchanged. The motorist fee for R-OBD and hybrid station inspections is identical to that for centralized station traditional inspections.

4. Vehicle repair effectiveness/MAC activities shall be implemented.

5. A Dedicated ROBD program as described in Section 2.3.4.2 shall be implemented.

6. A Hybrid Station component shall be implemented with a motorist fee of $14 per test, and consist of:

i) R-OBD testing method (consisting of one stand-alone R-OBD test unit that can be utilized to test multiple vehicles); and

ii) Traditional workstation testing methods.

7. Replacement of the 10 self-service OBD kiosks for a motorist test fee of $10 (no change in late fees), with possible additional kiosk deployment.

The selected contractor of this RFP will be expected to do the following:

a. Provide Emission inspection equipment, personnel, and operational services for the centralized portion of the program.

b. Provide all equipment, computer systems, hardware, and software to operate the system and work in unison with MVA’s Customer Connect System.

c. Reconfigure, retrofit, and operate the State-owned emissions inspection stations.

Going forward the MVA will focus its efforts on management of the contract, as no staff will be dedicated to assist with the management of the stations.
