About this file

This is Addendum #8 to Bid Invitation 484-26 issued by the State of New Hampshire Division of Procurement and Support Services for Energy Performance Contracting Services. The addendum revises the vendor question response deadline from April 8, 2026 to April 10, 2026, with bid closing scheduled for April 16, 2026 at 12:00 PM. The addendum addresses three requested changes to bid language regarding contract terms: modifications to the Contract Price/Price Limitation/Payment section limiting liability to monetary damages not exceeding total fees paid and restricting claims to those asserted within one year of completion; revisions to the Limited Warranty & Disclaimer section establishing a one-year warranty period for professional performance with refunds as the sole remedy for deficient work; and clarifications to the Force Majeure section detailing circumstances excusing contractor performance delays or failures, including acts of God, natural catastrophes, labor disturbances, governmental actions, utility service interruptions, equipment failures, and other causes beyond reasonable contractor control.

All changes specified in this addendum supersede previously submitted documents and must be included with bid submissions. Respondents are required to complete and submit the acknowledgment section with their business name, address, contact information, and authorized signature. All other specifications from the original bid solicitation remain unchanged and valid. Additional bid documentation and addendums are available on the New Hampshire Department of Administrative Services purchasing website, with inquiries directed to purchasing agent Ryan Fuller at NH.Purchasing@das.nh.gov.
