About this file
This is a Massachusetts Department of Transportation (MassDOT) Request for Determination of Applicability under the Massachusetts Wetlands Protection Act and Chapter 91 (Public Waterfront Act), prepared by BSC Group on behalf of the City of Peabody for the Independence Greenway Multi-Use Path project. The project involves construction of a 1.25-mile shared-use pedestrian and bicycle path extending from Lt. Ross Memorial Park to the existing Independence Greenway trailhead at Peabody Road, including a new 179-foot single-span pedestrian bridge crossing Proctor Brook between Interstate 95 and Peabody Road in Peabody, Massachusetts. The proposed bridge will be a prefabricated Pratt Truss steel structure with cast-in-place concrete foundations on either side of the brook, measuring 14 feet 7 inches in outside width with a 12-foot clear interior width for the trail. The City is requesting a formal determination from the MassDEP Waterways Program regarding whether the specific section of Proctor Brook at the crossing location is navigable and therefore subject to Chapter 91 jurisdiction.
The applicant submits that the approximately 1,065-foot isolated section of Proctor Brook where the bridge crossing is proposed is not normally navigable during any season due to three primary factors: the section is bounded by non-navigable culverts upstream (under Interstate 95) and downstream (under Peabody Road) that restrict vessel passage; water depths at the crossing are typically 1 to 1.5 feet even at bankfull conditions, insufficient for navigation by canoe, kayak, raft, or rowboat; and a previous informal determination by MassDEP found downstream sections of the same waterway to be non-navigable. The project is funded by MassDOT and involves coordination with multiple agencies including the U.S. Army Corps of Engineers and Massachusetts Department of Fish and Game. Site photographs and USGS StreamStats data are provided as supporting documentation, with preliminary bridge design plans included. The determination request was submitted in May 2024, with notification provided to municipal officials, conservation commission, planning board, cemetery property holders, and relevant state and federal agencies.

RE: WW04 – Request for Determination of Applicability under Chapter 91
Independence Greenway Multi-Use Path – New Pedestrian Bridge
MassDOT Project #610544
Proctor Brook between I-95 & Peabody Road crossing in Peabody, MA.
Dear Chapter 91 Reviewer, On behalf of City of Peabody, BSC Group (BSC) is submitting this BRP WW04 Request for
Determination of Applicability for whether a particular section of Proctor Brook is considered jurisdictional under M.G.L. Chapter 91 the Public Waterfront Act, and whether Waterways program authorization is required under implementing regulations 310 CMR 9.00. This application is also being submitted under the MassDOT ISA.
The City of Peabody (with funding from MassDOT), is proposing to construct a section of new multi-use trail that will extend the Independence Greenway and Border-to-Boston trail network.
The 1.25-mile section of shared-use path will begin at Lt. Ross Memorial Park and terminate at the existing Independence Greenway trailhead at Peabody Road. As part of the trail route, a new pedestrian bridge crossing is proposed over Proctor Brook, in a stretch of the waterway between
I-95 and Peabody Road. The proposed bridge over the Proctor Brook will consist of a 179-foot, single span, prefabricated truss steel superstructure supported on cast-in-place concrete foundations located on either side of the Brook. No permanent fill will be required below the High
Water Mark but the bridge will span over the perennial stream channel. Based on the evidence that this section of Proctor Brook is limited to approximately 1,065 linear feet between existing culverts, and typical ordinary high water depths are 1 to 2 feet, the City is requesting advisement from the Waterways Program on the jurisdictional navigability at this location.
Project Summary and Project Location
The new section of multi-use trail will typically be a 12-ft-wide paved trail, with 2-ft wide grass shoulders. The majority of the Project follows an abandoned railroad bed and existing State
Highway Layout, but a new pedestrian crossing is required over Route 1 as well as over Proctor
Brook in a location without an existing bridge. As noted, the Proctor Brook bridge is proposed in an isolated area between the outlet of a closed-drainage culvert that carries the stream under I-
95 and an existing culvert and headwall at Peabody Road
The bridge will span Proctor Brook in a north/south direction, from approximately 42°32'31.5"N
70°58'56.7"W (south side of Proctor Brook), to 42°32'33.3"N 70°58'57.4"W (north side of Proctor
Brook) (Please see Attachment A for USGS Locus and aerial Environmental Resource
Figures).
Proposal No. 610544 - 135966
A00850 - 5 mailto:DEP.Waterways@mass.gov
Determination Being Requested
The City is respectfully requesting that the MassDEP Waterways Program provide a determination as to whether the section of Proctor Brook within the proposed Project crossing is considered navigable, and therefore jurisdictional, under M.G.L. Chapter 91 and implementing regulations. Per 310 CMR 9.04(1) Geographic Areas Subject to Jurisdiction extends to:
(e) any non-tidal river or stream on which public funds have been expended for stream clearance, channel improvement, or any form of flood control or prevention work, either upstream or downstream within the river basin, except for any portion of any such river or stream which is not normally navigable during any season, by any vessel including canoe, kayak, raft, or rowboat.
Based on field surveys of the site, the isolated section of this stream, publicly available data from
USGS StreamStats, and a recent informal determination the Waterways Program made for a section of Proctor Brook located downstream from the Project location, BSC submits this evidence that the Brook would not be normally navigable at the Project crossing location, and therefore does not fall under the jurisdiction of Chapter 91. There is not an existing crossing in this location, and no known history of Chapter 91 License records in this area.
Existing Conditions
Land Use
Land classification in the area of the proposed crossing generally consists of transportation uses, forests, wetlands, managed open space, and single-family residential development. Areas of publicly and privately-owned land are situated within proximity of the crossing, but these areas will not be adversely affected from the proposed project activities. The work will remain in the Abandoned Railroad ROW owned by the City, a permanent easement from the Beth El Cemetery, and on approach from the State Highway Layout of I-95.
Watershed
Proctor Brook is located within the North River watershed, and generally flows west to east, before discharging into the North River, and then into Beverly Harbor more than 2 miles southeast of the project area. According to the USGS StreamStats Report (Attachment C) for this area, Proctor Brook would be categorized as an intermittent stream until just east of the Route 1 and I-95 crossing. The USGS topographic map depicts the stream as intermittent west of the highways and then perennial to the east. USGS Streamstats confirmed that the drainage area is 0.41 square miles (less than the ½ square mile threshold required by the Wetlands Protection Act implementing regulations) between Route 1 and I-95. The drainage area increases to 0.72 square miles by the eastern end of the project limits and in the vicinity of the crossing.
Proctor Brook - Waterway
BSC Wetland Scientists delineated the boundary of existing wetland resource areas within and in the immediate vicinity of the project limits along the proposed Greenway route in late 2021
(supplemented in April 2024). Wetlands and streams were delineated in accordance with the methods developed by the Massachusetts Department of Environmental Protection’s (MassDEP)
Delineating Bordering Vegetated Wetlands Under the Massachusetts Wetlands Protection Act
(WPA), updated 2023, as well as definitions set forth in the implementing Regulations 310 CMR
10.00. Wetland and water resources were also evaluated for federal jurisdiction using the United
States Army Corps of Engineers (USACE) Wetland Delineation Manual (Environmental
Laboratory, January 1987) (“1987 Manual”) and the USACE Regional Supplement to the Corps
A00850 - 6 of Engineers Wetland Delineation Manual: Northcentral and Northeast Region (version 2.0)
(USACE Supplement) (January 2012). Existing conditions, wetland resource areas, and environmental constraints in relation to the proposed activities are shown on the attached Map
(Attachment A), and site photographs (Attachment B).
Within the Project area, the Mean Annual High Water (MAHW) line of Proctor Brook was delineated from the I-95 culvert (~225-ft upstream of the crossing location), to the Peabody Road culvert (~770-ft downstream of the crossing location). The MAHW line is assumed to be generally consistent with the Waterways program High Water Mark and the federal Ordinary High Water
Mark based on observed characteristics. Proctor Brook flows parallel to and south of the Beth EI
Cemetery in a fairly straight channel. The river banks consist of low, well-defined embankments, with significant undercutting (see site photos in Attachment B). The banks are bordered by mixed deciduous trees and shrubs, including red maple (Acer rubrum), Eastern white pine (Pinus strobus), and multiflora rose (Rosa multiflora). Asiatic bittersweet (Celastrus orbiculatus) vines are also present. Within the crossing area, Proctor Brook is bordered by a palustrine forested
(PFO) wetland. Dominant vegetation within this wetland includes red oak (Quercus rubra), and cinnamon fern (Osmundastrum cinnamomeum).
According to the USGS StreamStats Report for this area, the bankfull width is 12.6-feet, while field measurements average just under 20 feet wide. Immediately upstream and downstream of the crossing, the bankfull channel width averages 34 feet wide. The substrate consist of a silty muck and observed water depths were between 6-24 inches, while the USGS StreamStats report estimated the stream depth as approximately 0.8 feet during bankfull conditions. The profile elevation at the crossing also puts the water depth at approximately 1.5 feet during times of
Ordinary High Water). The section of the stream is approximately 1,065 linear feet in length before entering another culvert under Peabody Road. BSC made an additional field visit in July 2022
(see site photos in Attachment B), during critical drought conditions. Water levels within the
Brook were extremely low, and portions of the Brook had entirely dried out.
Structures and Culverts
The culvert carrying Proctor Brook under I-95 is part of a several hundred-foot long, closed drainage system. Dense vegetation and debris is partially obstructing the single culvert at its outlet to the Proctor Brook channel.
The culvert carrying Proctor Brook under Peabody Road consists of three, 48-inch diameter reinforced concrete pipes. The stream daylights again on the other side of Peabody Road.
Proposed Conditions
The proposed bridge over the Proctor Brook will consist of a 179-ft, single span, prefabricated, Pratt Truss steel superstructure supported on shallow, reinforced, cast-in-place concrete foundations located on either side of the brook. The outside width of the superstructure is proposed to be 14’-7” and inside clear width for the trail is proposed to be 12’-0”. The bottom of the bridge will be approx. 3.5-ft above Ordinary High Water (OHW), 2.56-ft above the predicted
100-Year Design Flood level, and 2.11-ft above the calculated 100-Year Base Flood Elevation
(BFE).
Navigability under existing conditions
The City submits that the section of Proctor Brook where the crossing is proposed (described above), is not normally navigable during any season. This is due to:
A00850 - 7
1. The approx. 1,065-ft length section of Proctor Brook where the Project is proposed is isolated by non-navigable culverts both upstream and downstream of the Project area. While a vessel could potentially be lifted from the water and transported across Peabody Road culvert, navigability would still be restricted (see 2 and 3).
2. Within the Project crossing area, the majority of Proctor Brook is too shallow for navigation by any vessel including canoe, kayak, raft, or rowboat. Even at bankfull or annual high water, the stream was profiled at a maximum of 1 to 1.5 feet deep at the crossing. During the majority of the year, Proctor Brook is likely to be considerably shallower.
3. Downstream of the current Project area, Proctor Brook was informally determined by MassDEP to be non-navigable directly in the crossing locations (determination issued on 3/12/24 by email, in response to a request regarding a separate section of the Peabody Independence Greenway [MassDOT project # 609211]). While the proposed crossing area (described herein) is a straighter and more channelized section of Proctor Brook, the predicted flows and generally low water depths are substantially similar to those described in the previous determination request downstream.
Based on the compiled evidence and site photos provided in Attachment B, the City submits that the Project crossing area of Proctor Brook is not normally-navigable during any season by any vessel. As such, the City requests a determination whether Chapter 91 jurisdiction is applicable to a new pedestrian bridge crossing.

Application Contact Commented [WDL1]: Will be me once we post on ePlace
A00850 - 31
Project description reads: The application is being submitted under the MassDOT ISA due to their role in funding and construction for the Project. The City is respectfully requesting that the
MassDEP Waterways Program provide a determination as to whether the section of Proctor
Brook within the proposed Project crossing is considered navigable, and therefore jurisdictional, under M.G.L. Chapter 91 and implementing regulations. A detailed description of the existing site conditions and the proposed Project (pedestrian bridge construction), is provided in the attached cover letter. The evidence submitted indicates this location is not normally navigable in any season.
See Below
A00850 - 32
Project location reads: The Project crossing is located between I-95 and Peabody Road in
Peabody, MA. A new pedestrian bridge is proposed to span Proctor Brook in a north/south direciton, from approximately 42°32'31.5"N 70°58'56.7"W (south side of Proctor Brook), to
42°32'33.3"N 70°58'57.4"W (north side of Proctor Brook). The bridge crossing will be on a permanent easement owned by the City over the Temple Beth El Cemetery parcel and will connect to an abandoned railroad bed owned by the City and the MassDOT state highway layout for I-95. Please refer to the attached cover letter for further details.
See Below
Commented [WDL2]: The property owner is currently listed as the City in the form, but if this agreement is still in progress, there might be some limitations to what we can submit without involving the cemetery
