About this file
This document is an Army Corps of Engineers General Permit verification letter issued by the U.S. Army Corps of Engineers New England District to the City of Taunton, Massachusetts, in coordination with the Massachusetts Department of Transportation Highway Division regarding bridge replacement work on Old Colony Avenue over the Taunton River in Raynham and Taunton, Massachusetts. The project involves replacement of the bridge deck while retaining the substructure, with associated scour protection installation consisting of a 2'-8" layer of natural streambed material over 2'-0" of riprap over 1' of crushed stone for a total depth of 5'-8". The project authorizes permanent discharge of fill material within 8,570 square feet below the Ordinary High Water mark and temporary impacts within 4,699 square feet due to cofferdams and dewatering. The work is authorized under Nationwide Permit 14 (Linear Transportation Projects) pursuant to Section 404 of the Clean Water Act. The Corps verification authorization is valid until March 14, 2031, with an extension to March 14, 2032, if work has commenced prior to the expiration date. The permittee must submit a Work-Start Notification Form at least two weeks prior to construction commencement and a Completion Certification Form at least one month following project completion.
The verification is subject to eleven special conditions addressing environmental protection measures including seasonal time-of-year restrictions on in-water work from March 1 to July 15 and September 1 to November 15 to protect diadromous fishes, dewatering requirements with fish screening and relocation protocols, erosion and sediment control specifications, native vegetation requirements, downstream flow maintenance, construction debris management, and recreational boating access provisions. The project must comply with the Commonwealth of Massachusetts Water Quality Certification decision and all applicable local, state, tribal, and federal permits. Equipment must be cleaned of invasive species prior to mobilization, and containment measures must be implemented during any painting, blasting, or bridge maintenance activities. The project manager is Daniel Vasconcelos of the U.S. Army Corps of Engineers New England District, located at 696 Virginia Road, Concord, Massachusetts 01742.

Katherine Nunes City of Taunton 90 Ingell Street Taunton, Massachusetts 02780 knunes@taunton-ma.gov
Dear Katherine Nunes:
This letter is in response to a request made by BETA Group, Inc., on behalf of the City of Taunton, dated June 2, 2026, to modify a project that is authorized under the Nationwide Permits. Our Department of the Army verification letter number NAE-2025- 02437, dated May 14, 2026, authorized the permanent discharge fill material within 8,570 square feet below the Ordinary High Water (OHW) mark of the Taunton River associated with the replacement of the bridge conveying Old Colony Avenue over the Taunton River in Raynham and Taunton, Massachusetts, at latitude 41.886117° and longitude -71.030069°. The bridge deck will be replaced, while the substructure will be retained. Scour protection will be installed below the bridge to protect the abutments and center pier. Scour protection will consist of a 2’-8” layer of natural streambed material over a 2’-0” layer of dumped riprap over 1’ of crushed stone for a total depth of 5’-8”. The project also includes temporary impacts within 4,699 square feet below OHW due to cofferdams and associated dewatering. This letter supersedes the verification letter issued by this office dated May 14, 2026.
The proposed changes are limited to revising the special conditions. The proposed regulated activities associated with this project remain unchanged and are detailed on the attached drawings titled “PRE-CONSTRUCTION NOTIFICATION TAUNTON AND
RAYNHAM, MASSACHUSETTS OLD COLONY AVENUE OVER TAUNTON RIVER
BRIDGE R-02-003=T-01-004,” on 10 sheets dated February 3, 2026.
Based on the information provided, the Corps has verified that the proposed actions are authorized under Nationwide Permit (NWP) NWP 14, Linear Transportation Projects, pursuant to authorities under Section 404 of the Clean Water Act (33 U.S.C. § 1344). You must ensure the proposed work is performed in accordance with the enclosed applicable terms and conditions. You can find a copy of these permits at:
https://www.nae.usace.army.mil/Missions/Regulatory/State-General-Permits/.
Proposal No. 613642 - 136413
A00831 - 3 https://www.nae.usace.army.mil/Missions/Regulatory/State-General-Permits/
Special Conditions
In addition, this verification is subject to the following special conditions:
1. The permittee shall complete and return the enclosed Work-Start Notification Form to this office at least two weeks prior to the anticipated construction start date.
2. The permittee shall complete and return the enclosed Completion Certification
Form to this office at least one month following the completion of the authorized work.
3. To protect diadromous fishes, no in-water work shall take place during the spring time-of-year (TOY) restriction from March 1 to July 15 or the fall TOY restriction from September 1 to November 15 of any year(s).
4. Work may take place during the above-mentioned TOY restrictions provided it is done in phases behind dewatered cofferdams. Cofferdams shall be installed outside of the TOY restrictions and be designed to ensure adequate water depth for safe fish passage throughout the TOY restrictions. Dewatering pumps shall include a two-part screen designed to limit entrainment and entrapment of sensitive diadromous fish species that may be present during the construction period. Any diadromous fishes observed within the dewatered area shall be removed and relocated to the water. Hand nets shall be kept onsite, and any fish relocation reported to the Massachusetts Division of Marine Fisheries.
5. Scour Protection (abutments, piers, etc.): Rock riprap shall be used in the stream bed only where a shear stress analysis has determined that scour protection is necessary to ensure stability of the structure. All stone fill shall be depressed (recessed) to a minimum of 2 feet and the overlying stream bed reconstructed to its pre-construction contours, elevations, and substrate sizes and types using existing stockpiled native substrate.
6. Erosion Control: No hay bales shall be used for erosion and sediment controls;
certified weed-free, chemical-free straw bales are acceptable.
7. Fabrics: Woven and mechanically bound biodegradable erosion control matting shall be used to stabilize all slopes steeper than 3H:1V. No plastic netting or welded joint poly-based matting shall be used.
8. Revegetation: Native seed mixes and plant species shall be used to reestablish vegetation. Plantings shall include a mix of woody shrub and tree species. No borrow, loam, or fill material shall contain invasive species.
9. Flow Maintenance: Downstream flows shall always be maintained, with water from dewatering operations filtered to remove excessive sediments and
A00831 - 4 discharged in a manner that prevents a release of turbid water into downstream areas. Entrapped fish or mussels shall be timely collected and relocated to the stream channel in a manner that promotes their safe recovery.
10. Construction:
a. Prior to moving construction equipment into the project area, the contractor must take reasonable measures to ensure that each piece of equipment is free of soil, seeds, vegetative matter, or other debris that may contain seeds of non-native terrestrial and aquatic invasive species.
b. If painting, sand or water blasting any portion of the bridge is necessary, appropriate aprons shall be utilized to provide for complete containment of all paint, and/or sealant over-spray particles and other debris during bridge removal, installation, or maintenance operations.
c. Aprons, tarps, shrouds, and/or other containment devices must be in place during bridge demolition, bridge maintenance, bridge construction and/or bridge surfacing activities to capture falling debris, paints, welding slag, sealant overspray, asphalt deck materials, or other debris.
d. All concrete chunks, asphalt, grindings, concrete materials, wood, rebar, and other debris generated during demolition or construction that enters the river shall be immediately removed and taken to an appropriate disposal facility outside of the floodplain.
e. All tools, equipment, barricades, signs, surplus materials, and rubbish from the project work limits shall be removed upon project completion. All construction debris and litter must be completely removed off site and disposed of properly upon completion of the project.
f. All debris, excess fill material and material excavated shall be disposed of at an approved upland location (above 100-year flood elevations).
Disposal in wetlands, floodplains or within 1000 feet of the Taunton River is prohibited.
11. Recreational Access: Boating (canoe/kayak or other) shall be safely maintained throughout the duration of the project either through the existing river channel or through a temporary portage trail. If this boating cannot be safely maintained, signage must be posted at the upstream and downstream boating access sites to inform the public of the river closure.
A change in location or project plans may require re-evaluation of your project.
Proposed changes must be coordinated with this office prior to construction. Failure to comply with all terms and conditions of these permits (NWP) invalidate this authorization and could result in a violation of Section 301 of the Clean Water Act or Section 10 of the Rivers and Harbors Act of 1899. You must also obtain all local, state, Tribal, and other Federal permits that apply to this project.
A00831 - 5
Water Quality Certification (WQC)
The Commonwealth of Massachusetts issued a conditioned WQC decision for your project (enclosed). You must comply with the conditions specified in the WQC decision for this NWP authorization to be valid.
Permit Expiration
The Corps verification of this NWP authorization is valid until March 14, 2031, unless the NWP is modified, reissued, or revoked prior to that date. If the authorized work for the NWP authorization has not been completed by that date and you have commenced or are under contract to commence this activity before March 14, 2031, you will have until March 14, 2032, to complete the activity under the enclosed terms and conditions of this NWP.

RE: 401 WATER QUALITY CERTIFICATION
BRP WW 10, Major Fill Project
BRP WW 08, Minor Dredge Old Colony Ave Bridge (R-02-003=T-01-004) replacement over the Taunton River Raynham and Taunton, MA
401 WQC Filing Number: 26-WW26-0004-APP
USACE Application No. NAE-2025-02437
MassDOT File Number: 613642
Dear Mr. Niro:
The Massachusetts Department of Environmental Protection (MassDEP) has reviewed your application for a Water Quality Certification (WQC), as referenced above. The WQC application was deemed complete on March 20, 2026. In accordance with the provisions of MGL Ch. 21, §§26-53 and Section 401 of the Federal Clean Water Act as amended (33 U.S.C. §1251 et seq.), it has been determined there is reasonable assurance the proposed project will be conducted in a manner which will not violate applicable water quality standards (314 CMR 4.00) and other applicable requirements of state law.
The project proposes the replacement of the existing Old Colony Avenue Bridge (R-02-003=T-
01-004) superstructure over the Taunton River, as well as scour protection installation, full depth road reconstruction, and stormwater improvements in Raynham and Taunton (the
Project).
The original bridge, constructed in 1945, consists of a two-span reinforced concrete deck supported by reinforced concrete abutments and timber piles with an overall bridge span of 90 feet and width of 35 feet. This bridge carries two 10-foot travel lanes, two 2.5-foot shoulders, and a 5-foot sidewalk. The bridge rests on two concrete abutments and a single pier. The
A00831 - 20

Address: 100 Cambridge Street, Suite 900, Boston, MA 02114 Phone: 617-292-5500 project currently collects stormwater through two closed catch basins at the southern end of the bridge that discharge to the Taunton River through a 12-inch reinforced concrete pipe. The remainder of the site consists of country drainage.
The Project will occur within a diadromous fish run and is habitat for Atlantic Sturgeon
(Acipenser oxyrinchus). Accordingly, in order to protect diadromous fish migration, MassDEP has conditioned this WQC to require compliance with the conditions outlined in the MA
Division of Marine Fisheries (DMF) letter of February 24, 2026. This includes a prohibition of in-water work between March 1st and July 15th for the spring and September 1st to November 15th for the fall.
The Project will occur within a Federal Emergency Management Agency (FEMA) 1% annual chance of flooding zone (Zone AE) associated with the Taunton River but will not impact the
Base Flood Elevation or regulatory floodway. The Taunton River is classified as a “Wild and
Scenic River”.
The Project will replace the bridge superstructure while retaining the existing bridge substructure. The new bridge width will have the same span and increase the width by one foot to incorporate a bicycle lane. The sidewalk will be relocated to the west side of the roadway. To avoid anticipated scour, 8,570 square feet (sf) of riprap will be installed across the river at a depth of 2 feet, and will be topped with 2 feet, 8 inches of streambed material. A wildlife shelf will be provided along the streambank via a 3-foot level riprap landing adjacent to the face of the south abutment. Approximately 790 feet of full depth roadway construction will occur, which includes the bridge and two approaches.
In total, 8,570 sf of permanent impacts and 4,699 sf of temporary impacts to Land Under Water
(LUW) are required to complete the project. Permanent impacts are due to the placement of riprap scour countermeasures, and the temporary impacts are due to dewatering for access and riprap placement.
Installation of riprap scour protection will require dredging of approximately 2,075 cubic yards
(cy) of material. The Project area is anticipated to have elevated levels of contamination.
Sampling was conducted but did not adhere to the approved sampling plan due to hazardous water conditions at the time of sampling. The samples that were collected show low levels of contaminants, but nothing above the reportable limit. To verify these samples and also collect the number of soils samples as required by 314 CMR 9.07, additional sampling is proposed.
Prior to dredge work, a Phase II Sampling and Analysis Plan shall be submitted for approval and implemented.
A00831 - 21
An alternatives analysis was completed in accordance with 314 CMR 9.00. Four alternatives were considered, and the chosen alternative was picked to minimize impacts to the Taunton
River while still implementing scour protection. The chosen alternative also minimizes the increase in impervious area. The no-build alternative is not practicable to meet the project goal of replacing the bridge superstructure.
The Project qualifies as a redevelopment project as defined at 314 CMR 9.02 and meets the
Stormwater Management Standards to the maximum extent practicable. The one foot widening of the bridge to incorporate a bike path will increase impervious surface within the
Project limits by 781 sf. The proposed stormwater improvements include eight new deep sump catch basins. Two existing catch basins will be replaced with deep sump catch basins on the south side of the bridge and the remaining six new deep sump catch basins will be installed at the northern and southern approach. Curbing will be added to direct flow to these new closed systems. A 45-foot-long infiltration trench will also be installed at the northwestern limit of the project. These new drainage systems will direct water to the Taunton River. Due to steep slopes and adjacent private property, no other stormwater control measures could be considered.
The Project will comply with the Stream Crossing Standards to the maximum extent practicable.
All standards will be met except for Standard 3. Bankfull width of the Taunton River is 99.5 feet, requiring a span of 119.42 feet to satisfy 1.2 times bankfull width. The current span of 79 feet will not change because the existing abutments will be utilized for the proposed bridge.
Based on a review of information provided by the applicant, MassDEP finds that this project complies with the standards described under 314 CMR 9.06 and 9.07. Public notice was provided in the Taunton Daily Gazette on January 28, 2026. No comment letters were received during the public comment period.
Therefore, based on information currently in the record, MassDEP grants a WQC for this project subject to the following conditions to maintain water quality, to minimize impact on waters and wetlands, and to ensure compliance with appropriate state law. MassDEP further certifies in accordance with 314 CMR 9.00 that there is reasonable assurance the project or activity will be conducted in a manner which will not violate applicable water quality standards (314 CMR 4.00) and other applicable requirements of state law. Finally, the Department has determined that upon satisfying the conditions and mitigation requirements of this approval, the project provides a level of water quality necessary to protect existing uses and accordingly finds that the project to be implemented satisfies the Surface Water Quality Standards at 314 CMR 4.00.
A00831 - 22
Pursuant to 314 CMR 9.09(1)(d); 314 CMR 9.06(6)(a); 310 CMR 9.06(2); 314 CMR 9.07; 314 CMR
