About this file
This is a Section 3 Clause attachment for the 407 Foulk Road Renovation project in Delaware, a HUD-assisted contract subject to the Housing and Urban Development Act of 1968. The clause establishes mandatory compliance requirements for employment and economic opportunities generated by the project, requiring that training and employment opportunities be directed to low- and very low-income persons, particularly HUD assistance recipients. The contractor must notify all relevant labor organizations and workers' representatives of Section 3 commitments, post notices at the work site describing the Section 3 preference and minimum number of positions to be filled, and include equivalent Section 3 clauses in all subcontracts. The contractor certifies compliance with HUD regulations in 24 CFR Part 75 and warrants no contractual impediments to such compliance.
HUD has established safe harbor benchmarks requiring that 25 percent of total labor hours on the covered project be performed by Section 3 workers and 5 percent by Targeted Section 3 workers. The contractor is prohibited from subcontracting with any subcontractor known to have been found in violation of 24 CFR Part 75 regulations. Noncompliance may result in contract termination for default, debarment, or suspension from future HUD-assisted contracts. For projects involving Indian housing assistance, Section 7(b) of the Indian Self-Determination and Education Assistance Act also applies, requiring preference and employment opportunities be given to Indians and preference in contract awards be given to Indian organizations and Indian-owned Economic Enterprises to the greatest extent feasible.
