About this file
This document is a Maintenance Bond for a Bridge Rail Unit Price Contract issued by the City of Fort Worth, Texas. The contract involves repair and replacement of bridge handrail, guardrail, and attenuators, with the primary purpose of establishing unit prices for potential work. The contract allows for potential renewal up to two additional terms, with a total contract duration not exceeding five years from the initial effective date. The City's contract budget may be less than the bid amount, and they are not obligated to award the full bid amount.
The maintenance bond specifically requires the Principal to guarantee the work's quality for a two-year period after final acceptance, with an obligation to repair or reconstruct any defective work upon receiving notice from the City. The bond covers all materials, equipment, labor, and accessories related to the project, with the Surety providing financial backing for potential repairs or reconstructions. The bond is continuous in nature, allowing for successive recoveries for multiple breaches, and specifies that any legal actions must be filed in Tarrant County, Texas, or the United States District Court for the Northern District of Texas, Fort Worth Division.
