About this file
This is a construction contract agreement between the City of Fort Worth, Texas, for a Bridge Rail Unit Price Contract. The project involves repair and replacement of bridge handrail, guardrail, and attenuators, with the primary purpose of establishing unit pricing for these services. The contract allows for work to be completed through task orders, with final acceptance times specified in each task order. The initial contract term can be renewed up to two additional terms, with a total contract duration not exceeding five years from the initial effective date. Liquidated damages are set at $650 per day for delays beyond the specified completion time.
The contract includes provisions for pricing adjustments through authorized change orders, with the specific contract price to be filled in at contract execution. The agreement includes several notable requirements, such as mandatory compliance with Texas state laws regarding boycotts (of Israel, energy companies, and firearm industries), immigration verification, and small business utilization. The contract has specific financial thresholds ($100,000 or more) that trigger certain compliance requirements, and includes protections for the city regarding fund appropriation, with the ability to terminate the contract if insufficient funds are available. The contract also contains comprehensive indemnification clauses and specifies Tarrant County, Texas, as the venue for any legal disputes.
