JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(BRAND NAME DETERMINATION)

PCN 99709 - REPLACE 4100 LEGACY FIRE PANEL, Facility M7-0360 (SSPF) and PCN 99710 - Remove Old Pyrotronics Panels, Facility M7-0360 (SSPF) for NASA, at John F. Kennedy Space Center

ESTIMATED VALUE OF SIMPLEX-GRINNELL INSTALLATION SERVICES FOR

PCN 99710: $110,000

1.) Based on the justification provided herein, we recommend that an acquisition be made by other than full and open competition for the contract actions described below.

2.) This contract action is for the acquisition of fire monitoring equipment as well as installation/programming/testing services by Simplex-Grinnell at Facility M7- 0360 (SSPF) for NASA, at John F. Kennedy Space Center. This contract action includes both PCN 99709 and PCN 99710 with proprietary equipment/services as follows:

SIMPLEX 4100 ES (1) plus Software, Peripherals, Installation and Testing Services (PCN99709).

SIMPLEX Detectors/Software Installation/Revision and Testing Services

(PCN99710).

The total value of these single manufacturer items is approximately $332,000.

3.) Contracting without full and open competition is permitted pursuant to 10 U.S.C.

2304 (c) (1) because the equipment required by KSC is available from only one responsible manufacturer and no other manufacturer’s equipment will fully satisfy KSC’s requirements. Simplex-Grinnell is the original equipment manufacturer of KSC’s existing networked FACPs. Due to Simplex-Grinnell proprietary communication protocols, they are the only contractor capable of modifying and reprogramming their proprietary software and hardware.

4.) There is a reasonable basis to conclude that only the proprietary equipment available from Simplex-Grinnell can satisfy KSC’s requirements. This single manufacturer requirement is based on software/hardware compatibility issues, communications protocols, and on the training investment previously made by the Government on Simplex-Grinnell equipment.

a. The scope of work under PCN 99709 includes replacement of one (1) each existing Simplex-Grinnell fire alarm control panel (FACP) in existing cabinet as well as replacement of peripherals/detectors/equipment in four

(4) each adjacent existing cabinets at M7-0360 (Space Station Processing Facility – SSPF). This effort also includes all associated software, programming, and functional testing. All software modifications will ensure satisfactory operation of all fire alarm panels connected on a proprietary Simplex network. This effort requires installing, modifying, re-programming, and testing of both new and existing Simplex-Grinnell fire alarm control panels/equipment at this facility.

b. The work scope under PCN 99710 includes installation of new Simplex detectors as well as updating of fire alarm control software, programming, and functional testing of all required circuits at M7-0360 (Space Station Processing Facility – SSPF). All software modifications will ensure satisfactory operation of all fire alarm panels connected on a proprietary Simplex network. This effort requires installing, modifying, re-programming, and testing of both new and existing Simplex-Grinnell fire alarm control panels/equipment at this facility.

c. NASA KSC has existing FACPs that use Simplex-Grinnell developed software and are interconnected on networks using Simplex-Grinnell proprietary communication protocols. Simplex-Grinnell’s hardware and associated software are proprietary products designed to provide communications for fire alarm signal reporting purposes. The Government has neither the rights nor the data necessary to allow any other vendor to modify Simplex-Grinnell software and hardware associated with Simplex-Grinnell networks or FACPs. Simplex-Grinnell develops and distributes software associated with Simplex Fire Alarm Systems and is the only contractor capable of modifying their proprietary software and hardware.

d. The use of other manufacturer’s products will drive KSC to develop, at substantial cost to the Government, a new infrastructure around that manufacturer’s product line, creating undesirable delays in fulfilling the agency’s requirements. The work under these projects requires significant installation and/or major modifications of Simplex-Grinnell fire alarm control equipment and software.

e. Previous contract NNK10CA67C installed a new Central Radio

Monitoring System (CRMS) that established a new NASA KSC Center Wide Fire Monitoring System (CFMS). The Government has a significant investment in CFMS using Simplex-Grinnell equipment. Use of equipment not compatible with the existing infrastructure would result in significant additional costs to the Government to design, implement, and test a new and redundant fire monitoring system.

5.) Efforts are being made to ensure that qualified offerors are solicited from as many potential sources as possible. NAICS Code 238210, Electrical Contractors and Other Wiring Installation Contractors, is applicable to this acquisition. Accordingly, the acquisition of PCN 99709 - REPLACE 4100 LEGACY FIRE PANEL, Facility M7-0360 (SSPF) and PCN 99710 - Remove Old Pyrotronics Panels, Facility M7-0360 (SSPF) will be competed via Solicitation 80KSC018Q0028 - Electrical Construction Master Blanket Purchase Agreement. The project Statement Of work (SOW) contained in the appendix of this solicitation fully details the specific requirements of each effort. Additionally, the government will provide applicable contact information for Simplex-Grinnell (during solicitation process) to all Electrical Construction Master Blanket Purchase Agreement contractors.

6.) The competitive nature of the Electrical Construction Master Blanket Purchase

Agreement procurement will entice bidding prime contractors to provide the most advantageous overall pricing for these efforts.

Pursuant to FAR 6.303-2(b), we hereby certify that the supporting data furnished in support of contracting by other than full and open competition, under 10 U.S.C. 2304(c) (1), with Simplex-Grinnell is complete and accurate to the best of our knowledge and belief.
