About this file

This is an attachment to a Request for Proposals (RFP) issued by the Salt Lake City School District (SLCSD) that establishes FERPA (Family Educational Rights and Privacy Act) standard terms and conditions for vendors providing classroom nursing services. The RFP seeks qualified vendors with licensed registered nurses (RNs) to deliver health care services to students with complex health care needs within SLCSD classrooms. The solicitation requires all proposals to be submitted through the Bonfire system, with vendors permitted to modify submissions at any time until the deadline. All questions regarding the solicitation must be submitted through the Bonfire system, and only official addenda issued by the SLCSD Purchasing Department constitute binding modifications to the procurement. Responses submitted through Bonfire remain secure and confidential until after the solicitation deadline.

The FERPA standard terms attachment establishes the privacy and data protection requirements vendors must comply with when handling student educational records and personally identifiable information. These terms govern how contractors access, use, and safeguard confidential student information in accordance with federal FERPA regulations. Vendors must acknowledge and agree to these terms as part of their proposal submission. The attachment serves as a binding agreement between SLCSD and any selected vendor(s) regarding the protection of student privacy throughout the contract term.

FERPA provides a contractor, consultant, volunteer, or other outside party may be treated as a school official if the contracting party is: (a) providing services or functions that the SLCSD would otherwise use employees, (b) under the direct control of SLCSD with respect to the use and maintenance of education records and personally identifiable information, (c) subject to the requirements of 34 C.F.R. 99.33(a), and (d) limiting access within the Vendor’s organization to those who have a legitimate educational interest. 34 C.F.R 99.31(a)(1)(i)(B).
