4. Staging. Parking areas, fueling areas and spill containment, and stockpile of supplies or equipment.
5. Safety. The Contractor is completely responsible for safety on the project site from the notice to proceed to final acceptance.
The responsibility runs at all times, including outside working hours, and the site being closed to the public does not reduce it. The end of day condition of open excavations, running dewatering pumps and stockpiles is the Contractor’s.
6. The contract and the Engineer’s role. The notice to proceed will come from the Owner and Contracting Officer, State of Utah, and all contractual agreements must be met to their satisfaction.
The Engineer is not privy to the contract or to any agreement other than those that directly affect construction performance. The Engineer acts as an agent for the Owner and Contracting Officer and provides information related to construction performance, but has no authority to modify or change the terms of the agreement. All questions or actions regarding the contract must be addressed with the Contracting Officer in the manner the contract specifies.
The Engineer does not direct the Contractor’s means and methods. The Contractor selects its equipment and owns the result. The Contractor is the sole point of contact for its subcontractors and is responsible for them.
7. Contact information.
WWW.EQUINOXENGINEERING.US PAGE 2 OF 4
Owner. State of Utah. For bidding purposes all contact must be through the U3P portal. Refer to the U3P site for project specifics.
Engineer. W. Chris Christiansen, cchristiansen@equinoxengineering.us, 801.910.9480 (Mobile).

Neither the Engineer nor the WMA Manager can provide information outside the U3P portal. During construction the WMA Manager is contacted for an emergency, or when the Contracting Officer directs it.
8. Bidding schedule and bid submission. As per the schedule posted on the U3P site or as directed.
The question and answer period closes, and bids are due, on the dates and times specified on the U3P site. It is the bidder’s responsibility to read them there.
The bid form provided on U3P must be submitted electronically to the U3P bidding portal, as the project requirements direct, on or before the due date and time.
9. Time. Substantial completion October 26, 2026. Final completion October 30, 2026. Demobilization immediately following final completion.
The waterfowl hunt begins the first Saturday in October, October 03, 2026, and construction may be underway while the hunt is running.
Only the Contracting Officer or the Owner has authority to issue, change or modify the schedule. A change is requested in writing and approved in writing. Time is of the essence. The Engineer does not control the Contractor with respect to schedule, and performance with both manpower and equipment rests with the Contractor.
10. Notice to proceed. Issued by the State Contracting Officer once all necessary paperwork is complete to his or her satisfaction. The Engineer has no control over this item, and any question or concern is addressed to the Contracting Officer.
11. Insurance and bonds. Both are required by the bidding documents. The requirements below are the State of Utah’s mandatory minimums, they are posted on the U3P site, and the Engineer has no authority to change or waive them.
Insurance. Workers compensation at the statutory limits, commercial general liability at one million dollars per person per occurrence and three million dollars aggregate, and commercial automobile liability at one million dollars per occurrence combined single limit. A certificate of insurance showing current coverage must be on file with the State before the contract may commence.
Bonds. Attachment D. A bid bond for 5 percent of the total bid, on AIA Document A310 or an equivalent form, must accompany the bid in U3P. A bid submitted without it is declared non responsive. The awarded Contractor furnishes a performance bond and a payment bond, each 100 percent of the awarded amount, on AIA Document A312 or an equivalent form, within 14 calendar days of award, and no purchase order is issued until they are received. Each surety must be authorized to do business in Utah and listed on U.S. Department of the Treasury Circular 570.
12. Liquidated damages. If applicable, administered by the Contracting Officer. The Engineer has no control over this item. All requests for an extension of time must be made in writing.
13. Survey control. The extents of the project are shown on the plans. Vertical and horizontal control is provided on the plan set.
The Contractor may install temporary control points at any convenient location for ease of construction, but all elevations for the project are based on the control points shown on the plan set. The Contractor is responsible for preserving and replacing survey benchmarks, and for laying out any component that is not staked.
WWW.EQUINOXENGINEERING.US PAGE 3 OF 4
The flowline of the inlet pipe governs the vertical set of each water control structure. The top of structure elevation is a check value.
14. Owner furnished materials. Two items on the bid schedule are install only because Farmington Bay is providing the material.
WCS Alpha. A Type A 6084 structure, cast on site and stored on site. Where it sits now and where it is set are both shown at the site visit. The Contractor lifts, loads, moves, sets and installs it. Bid item 3 is install only.
60 inch HDPE pipe. Provided by Farmington Bay and delivered to the site, with couplers.
The Contractor offloads the pipe from the truck, moves it and installs it. Bid item 6 is install only.
Owner furnished materials are provided in the condition they are in. The Contractor is responsible for handling, moving and installing them without damage, and for replacing any material damaged while in its possession.
Everything else is purchased, provided and installed by the Contractor.
15. Water control structure Bravo. Supplied and installed by the Contractor, bid item 4. Specified to be provided by Chris Brown or approved equal, cbrown70brown@gmail.com, 801.791.1661.
16. Pipe and coupler compatibility. The 36 inch HDPE pipe is supplied by the Contractor, bid item 5, and it must match the corrugation profile of the pipe stub cast into WCS Bravo, not the nominal diameter alone.
Corrugation profiles vary by manufacturer and product line, and a coupler will not seal across two different profiles. The cast in stub cannot be changed, so the pipe is ordered to it.
Bell and spigot is preferred. Where a length is cut to fit and no bell remains, the clamshell coupler must come from the pipe manufacturer and must match the profile.
Mar‐Mac couplers are not approved.
17. Compaction. Material excavated to place the structures and the pipe is returned to the excavation and compacted in place to 90 percent of maximum density, standard Proctor, ASTM D698, per the general notes.
Compact around the haunches of the pipe. A plate compactor or a jumping jack is the expected equipment for this work.
18. Wet or saturated site conditions. This project is constructed in and close to water, and it is openly represented that the project is subject to water impacts.
Any portion of the site, up to and including all of it, may be wet or saturated and may require dewatering to allow for acceptable construction. The Contractor is responsible to provide any and all equipment necessary to complete the project on time and in accordance with the plans and the technical specifications.
Site conditions are represented as is and may change over time. Precipitation events and surface or subsurface flows associated with runoff or managed water may alter the amount of water on the site between the site showing and the start of construction. A change in site hydrology from those causes does not constitute a change in site conditions.
19. Utilities. There are no known public utilities on the project site that would impact construction activities. It is the Contractor’s responsibility to contact Blue Stakes of Utah at 800.662.4111, www.bluestakes.org, or another utility locating service as appropriate.
20. Operation of the wildlife management area. The project site is an active waterfowl management area and the hunt begins October 03, 2026.
Unauthorized individuals may find their way to the project site. The Owner, the Contracting Officer and the Engineer are not responsible for vandalism or damage to equipment at any time. WMA staff will
WWW.EQUINOXENGINEERING.US PAGE 4 OF 4
reasonably assist the Contractor in efforts to mitigate against damage or vandalism but cannot and will not be responsible for it. The Contractor is responsible for its equipment and materials at all times.
21. Wildlife protection. Do not disturb wildlife unnecessarily.
22. Cultural resources. None is expected or anticipated. If an artifact is discovered, work stops at the location of the find and the Engineer is notified the same day. Work continues elsewhere on the site.
23. Specific work related items.
a. Mobilization. Lump sum. The Contractor mobilizes and demobilizes all equipment, materials and personnel needed to complete the work on schedule.
b. Site preparation. Lump sum. Excavation of the existing levee to place the structures and the pipe, dewatering as needed, replacement and compaction of the excavated material, and return of the site to more or less its original condition. All temporary modifications are removed.
c. WCS Alpha. Install only. One each.
d. WCS Bravo. Supply and install. One each.
e. 36 inch diameter HDPE pipe. Supply and install. 40 linear feet.
f. 60 inch diameter HDPE pipe. Install only. 50 linear feet.
Select fill and filter fabric at the water control structures are incidental to the installation of the structures and are not paid separately.
All materials other than those provided by Farmington Bay are purchased, provided and installed by the Contractor.
24. Measurement and payment. The bid is submitted on the unit price schedule, Attachment C.
Estimated quantities are provided as a courtesy to assist with bid preparation. They are deemed to be accurate but are not guaranteed, and the Contractor is responsible to verify them and adjust its bid as it deems appropriate. Single unit bid prices are requested so the Owner may adjust quantities after the bid, at the Owner’s sole discretion, as the needs of the project require.
Payment is made at plan quantities and plan dimensions.
