About this file

This is a clarification questions document containing 247 questions and answers related to two solicitations (70LCHS25RPFB00001 and 70LCHS25RPFB00002) for Student Support Services and Facilities Operations Maintenance Services at the Federal Law Enforcement Training Center (FLETC) in Charleston, SC.

The Q&A addresses key aspects of both requirements including: key personnel positions and qualifications, past performance submission requirements, oral presentation guidelines, pricing structure, wage determinations, equipment responsibilities, maintenance schedules, and service level specifications. Notable clarifications include: two separate proposals are required for bidding on both requirements, resumes are required for key personnel with 7-page limits, oral presentations are limited to 8 team members with 5 from the prime contractor, and the shared liability threshold is $1,500. The document also clarifies that the requirements are set aside for 8(a) firms, with Phase 1 submissions due by 12:00 PM ET on March 6, 2025. Multiple technical clarifications are provided regarding facilities maintenance, grounds keeping, transportation services, and food service operations.

Federal Law Enforcement Training Centers Charleston SC 70LCHS25RPFB00001/70LCHS25RPFB00002 Clarification Questions

N o.

Document Location Page Question Government Response

1 Section L L.9 Proposal Submissio n Instruction s

L-5 Can the government please confirm that it "intends to make one award without discussion with Offerors" for each of the contracts?

Section L-9 & M-1:

Notice to Offerors:

The Government intends to award (2) Single Award, (IDIQ) contracts to include Firm-Fixed Price (FFP) and Other than Firm Fixed Price (OTFFP) CLINS resulting from this solicitation. The Government reserves the right to discuss submissions and/or ask clarification questions to contractors submitting a proposal if deemed in the Government’s best interest.

2 Section L L.15 Phase II - Factor 3:

Capability of Proposed Key Personnel

L-10 Section M related to key personnel resumes, which currently states:

"At least two (2) resumes of each category shall be current personnel of the Prime Offeror."

We respectfully request

This verbiage has been revised clarification on whether the government would consider revising this requirement to allow the inclusion of resumes from personnel of the entire Offeror team, including teaming partners and subcontractors.

Expanding this requirement to encompass the full Offeror team would allow us to leverage a broader pool of highly qualified and experienced personnel who are collectively positioned to meet and exceed the government’s requirements.

3 Section L L.15 Phase II - Factor 3:

Capability of Proposed Key Personnel

L-11 Can the government please clarify the key personnel for each contract?

Please see revised Section L.15:

"The Offeror shall submit resumes that describe the specific, relevant experience and availability of key personnel in providing services described in section C.6 of each

PWS".

4 Section L L.15 L-11 Can the government please clarify if the same resumes can be used for key personnel

The Government will not accept the same resume(s) for key personnel positions to overlap with each contract positions that overlap with each contract?

5 Section M M.2 Basis of Award

M-1 After reviewing Section M, we understand that this acquisition will be conducted using a Best Value tradeoff methodology, with both price and non-price factors considered. We would like to request clarification on the following:

1. Relative Importance of Non-Price Factors: Could the government confirm the relative importance or weight assigned to Factors 1 through 4 (Demonstrated Prior Experience, Oral Presentation, Capability of Proposed Key Personnel, and Past Performance)?

Are these factors considered equal in importance, or is one given more emphasis?

2. Non-Price vs.

Price Factors:

Please see revised Section M.2. For this solicitation, the evaluation factors are:

All "Non-Price/Cost" factors when combined, are significantly more important than Cost/Price. Factors 1, 2, 3 and 4 are of equal importance.

While we understand that price will be evaluated for reasonableness and completeness, could you clarify how price is weighted relative to non-price factors? For example, does the government prioritize technical excellence over cost, or is there a specific balance intended?

3. Oral Presentations:

For the oral presentation (Factor 2), could the government provide additional insight into its weight compared to the other non-price factors?

6 Section M Factor 4:

Past Performan ce

M-2 Can the government please confirm that Offers are to provide up to four (4) projects and two (2) additional projects per each teaming partner?

Section M-2 Factor 4:

Past Perfomance has been revised. "Offerors are to provide up to four

(4) projects and two (2) additional projects per each teaming partner".

7 Section C (Student Support)

68 Student Support Services Section C is missing content after C.5.E. Can the government

This has been corrected and uploaded to

SAM.GOV

provide scope for C.5.F, C.5.G, C.6 and C7?

8 Section L L.17 Factor 5:

Price Proposal Instruction s

L-12 The government states "While certified cost and pricing data is not required, other than certified cost and pricing data is required". Can the government please clarify this statement?

As this is a competitive requirement, normally DOTCCPD is not required. In unusal circumstances, DOTCCPD may be required. See revised section L.17 Factor 5:

Price instructions.

"While certified cost and pricing data is not required, other than certified cost and pricing data may be required".

9 Section M Can the government please confirm that Offers can have 5 people attend the site visit and not a "Maximum of 1 individual per company"?

The government confirms that Offerors can have 5 people attend the site visit/pre-proposal conference.

Please be advised that we request that each attendee dress comfortably for the site visit as the campus will be viewed by foot.

Section L L.14 Oral Presentati on

L-8 Upon reviewing the requirements for oral presentations, we noticed that the government allows up to five

(5) individuals to participate for 180 minutes when bidding on one task and for 240 minutes when bidding on both tasks.

We respectfully request that the government

The contractor is authorized to have up to 8 individuals present for the oral presentation.

Please see revised Section L.14 Oral Presentation: "The Offeror’s presentation team is limited to eight

(8) employees of the team. At least five (5) of the eight (8) team members must be from the Prime Contractor".

consider allowing more individuals to participate in the oral presentations for offerors bidding on both tasks.

Given the complexity and scope of preparing for both tasks, increasing the number of participants would allow us to present a more comprehensive and detailed demonstration of our approach.

This adjustment would enable subject matter experts and key personnel to address task-specific aspects directly, thereby providing the government with greater assurance of our ability to meet or exceed the requirements.

Would the government consider revising the participant limit for offerors bidding on both tasks to 7-8 individuals? We believe this adjustment would better align the oral presentation process with the scope and objectives of the solicitation.

Section L L.6 Pre- Proposal Conferenc e

L-3 We would like to request additional clarification on the structure of the site visit, particularly given that the solicitation encompasses two distinct tasks and not all attendees may be bidding on both.

Does the government plan to divide the site visit into groups or hold separate sessions to address the unique aspects of the two tasks?

If the government does not plan to break out by task, will there be separate discussions or presentations for

The government plans to conduct separate site visits for each requirement. The official dates for those visits will be listed on the Finalized RFP.

each task during the site visit?

Would the government consider extending the site visit to multiple days or offering an additional session to provide more tailored information for each task?

We are seeking these details to ensure our team can maximize the value of the site visit and adequately prepare for the discussions specific to the tasks we plan to bid on.

Section C (Student Support)

Intro and General Requirem ents

C-

Under Firing Range Pick-up, it is noted that the Student Support Services Contractor is to “clean weapons cleaning room, making sure surface areas are free of grease, oil, solvents, trash, and other foreign materials.

Refill lead soap dispensers when empty”. Judging by Attachment C-8, Part 2, this appears to be a requirement for

Rangemasters are required to clean up after each class departs so it is ready for the next class; this is not for the janitorial staff to accomplish. The janitorial staff normally only cleans common use areas such as public restrooms, lobby areas and staff office areas at the indoor range.

the Facilities Operations Maintenance Contractor instead. Can the Government clarify the janitorial/custodi al requirements for each contract as there are additional overlap throughout?

Section C (Student Support)

Intro and General Requirem ents

C- 44-

Are the items listed under Firearms Equipment and Supplies (as well as targets, drums, and batteries) all Government furnished? If not, which ones are to be provided by the Contractor?

All range materials are supplied by the government

Section G.13 & Section L L-12 Sect. G.13 and Sect. L, page L-

12. These sections note Rev. 27 of two different Wage Determinations whereas the Attachment H-2 is for 2015-4427, Rev. 29. Please clarify the applicable Wage Determination.

See revised Section G.13 and L.17 to reflect the correct Wage Determination to be 2015-4427, Revision 29

Section L Key Personnel L-15

L-10 This section notes that “at least two (2) resumes of each category shall be current personnel of the

This verbiage has been revised

Prime Offeror”.

This provides an unfair advantage to the incumbent contractor and subjects the Government to a possible protest.

Given that it is well understood that any new contractor will likely hire incumbent staff to satisfy first right of refusal requirements, please consider eliminating this requirement.

Section L & Section M Key Personnel L-15

L-11 & M-

These sections call for resumes for Dorm Manager, Dining Hall Manager, and Chef. These positions do not seem relevant to the Facilities Operations Maintenance Solicitation

70LCHS25RPFB0

0002, and these sections should be clarified as such.

Please see revised Section L.15:

"The Offeror shall submit resumes that describe the specific, relevant experience and availability of key personnel in providing services described in section C.6 of each

PWS".

Section L & Section M L-11 & M-

This section calls for a page limit of five (5) pages whereas Sect. M, page M-3 calls for a six (6) page limit. Please clarify.

Each section has been revised to increase the page limit to 7 pages

Section L L-12 This page notes that questions are due on Feb.

03 and yet the site visit is not until Feb. 06.

This is highly unusual to expect contractors to have all questions in hand prior to a site visit and an unfair advantage to the incumbent.

Please consider revising the due date for questions until at least several days after the 6th.

Tentative Dates have been updated on Draft Announcement

Section M M-4 This section notes that “if the offeror proposed teaming partner(s) or subcontractor(s) in response to this RFP, the offeror shall provide two (2) additional past performance questionnaires for each teaming partner(s) and/or subcontractor(s) for contracts entered into by the federal government, agencies of state and local governments, and/or

Each section has been revised to increase the page limit to 7 pages commercial customers”.

With these additional past performance requirements, please consider adding an additional two (2) pages to the document length for each subcontractor.

Otherwise, there will not be enough room to adequately describe subcontractor past performance.

Section M M-4 This section notes that “if the offeror proposed teaming partner(s) or subcontractor(s) in response to this RFP, the offeror shall provide two (2) additional past performance questionnaires for each teaming partner(s) and/or subcontractor(s) for contracts entered into by the federal government, agencies of state and local governments, and/or commercial customers”.

Please change

Section M-4 has been revised to reflect the change to "references" the word “questionnaires” to “references”.

Attachments C-2 & C-4 What is the difference between these two attachments?

They both seem to cover hours of operation.

Attachment C-2 is a sample of the FLETC Class Schedules.

Attachment C-4 is a sample of the FLETC Facility Building Hours of Operation.

Attachment C-6 Government Equipment List.

What is the difference between the three provided sheets within the spreadsheet

That is correct.

Attachments C-8 Schedules of Service, Parts 1 & 2

The heading on these documents is

70LCHS25RPFB0

0002. Please confirm these schedules are exclusively for this Solicitation only

That is correct.

Attachments C-8 Schedules of Service, Parts 1 & 2

Under Special Requirements under several of the locations, it is mentioned that “additional dormitory service requirements are described in Section C- 5.B.5.b”. This is not the case.

Where are the dormitory service requirements addressed?

This reference has been corrected; attachment C-35 has the schedule of services listed for the dormitories under the student services contract. The dormitory staff is responsible for their own janitorial/housekeeping service

Attachment C-9 Contractor Furnished Materials and Supplies

The heading on this document is

70LCHS25RPFB0

0002. Please confirm these materials and supplies are needed exclusively for this Solicitation only.

That is correct

Facilities Management C.5.A.3

The listed Contractor Furnished Materials and Supplies overlaps.

The following items are listed under Attachment C-7 and Attachment C-9.

Paper Towels, Liquid Hand Soap for Dispensers, Hand Sanitizer Dispenser, Hand Sanitizer, Toilet Paper, Walk-off Mats, Disposable Cups for Water Coolers, Toilet

These are two separate requirements and shall be bid as such. Each section will need each item(s).

Paper Holders, Toilet Seat Covers, Soap Trays, Soap Dispensers, Soap Dispenser Refill Bags, 2XL Hand Sanitizer Touch Free Dispenser, 2XL-27, Hand Sanitizer Refill Bags, Towel Bars, Shower Curtains, Shower Curtain Rods, Medicine Cabinets, Mirrors, Smoke Detectors, Door Stops, Tri- Flow Teflon Lubricant, Gym Wipes.

The overlap in materials creates confusion in the division of responsibility between the Student Support Services and Facility Operations Maintenance.

For example, what contractor would be responsible for replacing Walk-off Mats or refilling disposable cups for water coolers.

Can the USG please provide clarification as to which materials and supplies are required for Student Services and which are required for Facility Operations Maintenance.

All Offerors should be required to

Dates will be posted with finalized RFP and as part of advisory down select notifications submit oral presentations slide on the same date and time so as to not give an Offeror additional time over another to complete oral presentation decks.

Additionally, if one competitor is required to do oral presentations on the 17th and another on the 24th, it allows an Offeror to have an unfair advantage over another by allowing them additional time to prepare.

1. Recommend the USG require Offerors to submit oral presentations on the same due date and 2. Hold oral presentations within a smaller window of time, preferably within 48 hours of each other.

Student Services Section C, C.4(a)1

personnel designated by the Contracting Officer to discuss problem areas."

Does the student services solicitation require a Key Alternate Project Manager? This position is not listed in Section C.6 Contractor Key and Essential Personnel Requirements.

If yes, can the USG please update Section C.6 to include the requirements for the student services Alternate Project Manager.

Section L Past Performan ce

We encourage the government to include in the solicitation for the

FLETC III

procurement language clarifying that the government will consider past performance of an offeror’s parent and sister companies, often referred to as affiliate past performance

(“APP”).

As a buyer of good and services, the government benefits from making clear that an offeror’s past performance citations may include the past performance of affiliates.

Crediting APP increases competition and makes available to the Government the broadest range of capabilities from an offeror’s enterprise. The procurement rules specifically endorse the Government crediting an offeror with APP where the offeror’s proposal demonstrates

See revised Section L that the resources of the affiliated company (e.g., workforce, management, facilities, or other resources) will be meaningfully contributed to contract performance.

See, e.g., GM– Bulltrack, B- 414591.6, B-

414591.7 (Comp.

Gen. Oct. 30, 2018). As GAO held in the Bulltrack case:

However, an agency properly may consider the experience or past performance of an offeror’s affiliated companies where the firm’s proposal demonstrates that the resources of the affiliated company will affect the performance of the offeror…. The relevant consideration is whether the resources of an affiliated company - its workforce, management, facilities or other resources - will be provided or relied upon for contract performance, such that the parent or affiliate will have meaningful involvement in contract performance.

Indeed, a GAO decision found the Army Corps of Engineers unduly limited competition by issuing a solicitation that prohibited consideration of APP. In Iyabak Construction, LLC, B- 409196, 2014

CPD ¶ 62, 2014

WL 523829

(Comp. Gen. Feb.

6, 2014), GAO

held:

…the Corps’ explanation for the RFP’s experience and past performance restriction is that the agency encountered problems in the past when it considered the experience and past performance of affiliates. As recounted by the contracting officer, these problems concerned the acceptance by the agency of “general statements about availability of affiliate resources,” where the offerors “did not demonstrate any meaningful involvement by the affiliate or include any commitment that the affiliate would perform any part of the contract.”

This explanation, however, does not address the protester’s position that it is unreasonable for the agency to refuse to consider the experience and past performance of affiliates where there are firm commitments for affiliates to participate meaningfully in contract performance.

Id. (citations omitted;

emphasis added).

The following is language from a government solicitation (“Model Language”) specifically addressing APP:

If applicable, Offerors may provide the experience or past performance of a parent or affiliated or predecessor company to an Offeror (including Joint Venture prime partner companies and/or a parent or affiliated company that is being otherwise proposed as a subcontractor on this effort) where the firm’s proposal demonstrates that the resources of the parent or affiliate or predecessor will affect the performance of the Offeror. The Offeror shall demonstrate that the resources of the parent or affiliate or predecessor company (its workforce, management, facilities or other resources) shall be provided or relied upon for contract performance such that the parent or affiliate or predecessor will have meaningful involvement in performance.

Accordingly, we respectfully request that the government include language like the Model Language in the

FLETC III

solicitation.
