About this file
This document contains questions and answers related to a solicitation for detention facilities and transportation services in Texas. The solicitation seeks three contractor-owned, contractor-operated detention facilities within the Houston and San Antonio areas of responsibility that are turnkey ready at contract start and able to house, medically treat, transport, and meet daily needs for ICE detainees. Questions addressed staffing plan vacancy deductions, identification credential requirements, personnel qualification standards, wage determinations, and transportation CLIN definitions. Responses revised the performance work statement sections, wage determination, and defined transportation CLIN units of measure.

Attachment 15 70CDCR20R00000001
ICE Solicitation 70CDCR20R00000001
RFP Questions Template
Date:
February 3, 2020
Requirement:
C, Phase II Questions
1.
Solicitation Section/Subsection Number:
Section C.IV.B, Facility Staffing Plan, Floor Plan and Key Personnel (page 27) and Attachments 4 and 4A QASP
Question: In Amendment 3, Section C.IV.B was revised to remove the instructions for computing vacancy deductions ("based on daily salary and benefits") and to refer instead to the Performance Requirement Summary (PRS). The instructions in the PRS broadly "permit the Contract Officer to withhold or deduct up to 10% of a monthly invoice until the Contract Officer determines there is full compliance."
The PRS does not prescribe a formula by which the Contracting Officer will determine the deduction. Assuming that the Government's goal is to base the deduction on the amount the Government is charged for the vacant position, will the Government agree that vacancy deductions assessed under the PRS will be based on salary and benefits of any position that remained vacant for more than 60 days if staffing levels fall below 85%?
ICE Response
If staffing levels fall below the acceptable level, deductions will be calculated in accordance with the PRS. The PRS states violations of the SOW (contract) will permit the Contracting Officer to withhold or deduct up to 10% of a monthly invoice until the Contracting Officer determines there is full compliance with the standard or section.
2.
Section C.IV.B, Facility Staffing Plan, Floor Plan and Key Personnel (page 27) and Attachments 4 and 4A QASP
Question: In Amendment 3, Section C.IV.B the Government revised the third paragraph by adding a new first sentence. Will the Government please consider revising this sentence as follows to reconcile it to the second sentence?
"In addition to assessing deductions as defined in the Performance Requirement Summary, ICE may shall also consider costs associated with overtime used to cover vacant positions. No deduction shall apply during any period the Contractor documents that a vacant position was covered through the use of overtime, contract staff or otherwise."
Please see revised PWS.
3.
Section C.IV.O.2.b, Uniform Requirements/Identification Credentials (page 37)
Question: Because hair color is subject to change, will the Government please consider removing hair color from the list of personal descriptors that must be included on identification credentials?
4.
Solicitation Section/Subsection Number: Section I.1, Minimum Personnel Qualification Standards (Page 34)
Question: Section I outlines the Minimum Personnel Qualification Standards for employees working on this contract, to include the additional requirement that "All employees shall be a minimum of 21 years of age."
Will the Government please consider modifying this requirement to state, "All employees shall be a minimum of 18 years of age" to be consistent with the hiring requirements of nearby government and contracted facilities for the purposes of staff recruitment?
5.
Solicitation Section/Subsection Number: Section J, Attachment 1, WD 2015- 5233-Rev-13
Question: The Wage Determination included in the RFP is not the most recent revision. Please confirm which version is to be utilized upon contract award.
ICE Response
Please see updated Wage Determination for Requirement B (WD 2015-5215 Rev. 14) and Requirement C (WD 2015-5233 Rev. 14).
Solicitation Section/Subsection Number:
Section B (pages 4-9) and Attachment 13 Cost and Pricing Summary
Question: CLINXXX3 lists DH as the unit of measure and Amendment 2 further clarified the items to be included in this CLIN's pricing; however, DH was not defined. Please define DH as a unit of measure with respect to the transportation CLIN.
The Unit of Measure, DH, is defined as “Miles”.
