About this file

This document is a State of Illinois Provisions section outlining contractual requirements for the Agency for Community Transit, Inc.'s Background Screening Services solicitation (No. 25-2-16200), issued on September 3, 2025, with funding assistance from the Illinois Department of Transportation (IDOT). The section establishes the regulatory framework and compliance standards that the selected contractor must adhere to throughout the contract term. While the document does not specify response dates, site visits, bidder conferences, award dates, or contract renewal options, it establishes that the contractor will provide comprehensive employment-screening and background-check services to support the Owner's Human Resources Department in maintaining workplace safety and security in accordance with the Owner's Background Check Policy and all applicable federal and state laws.

The provisions impose significant legal and operational obligations on the contractor, including strict prohibitions against financial interests held by local officials during their tenure or for one year thereafter. The contractor must indemnify and hold harmless the State of Illinois, IDOT, and their respective officials, employees, and agents from all claims, damages, losses, and related costs arising from the contractor's actions or inactions. The contractor must maintain full compliance with all applicable federal and state nondiscrimination laws, including the Illinois Human Rights Act, the Public Works Employment Discrimination Act, the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, the Americans with Disabilities Act of 1990, and the Age Discrimination Act. Additionally, the contractor must operate independently and not represent itself or its employees as agents or employees of IDOT or the State of Illinois, nor claim any associated employee benefits, worker's compensation, unemployment compensation, or retirement privileges.
