About this file

This is a Liquidated Damages Form from the Town of Palm Beach, Florida, establishing financial penalties for contract non-performance on the Bee Hives—Town Wide project. The form outlines that the contractor and surety are liable for liquidated damages based on the Florida Department of Transportation schedule (paragraph 8-10) for each calendar day the work remains incomplete after the scheduled completion date, including any approved time extensions documented in written Change Orders. If the contractor is terminated for default before completion, liquidated damages continue to accrue and be charged against the contractor until the work is finished. The form requires the contractor's authorized representative to acknowledge understanding and agreement to comply with these liquidated damages terms by providing company name, individual name, date, and authorized signature.

The liquidated damages provision reflects the Town's recognition that computing actual damages from delayed completion is difficult and uncertain; therefore, the parties agree in advance to the predetermined penalty schedule rather than pursuing claims for actual damages. This mechanism protects the Town's interests by ensuring financial accountability for schedule delays while providing the contractor with a known, capped liability exposure. The contractor must sign and return the completed form as part of the bidding and contract execution process for the five-year beehive installation and honey harvest project at the Par 3 Golf Course.
