About this file

This is a Liquidated Damages Form from the Town of Palm Beach, Florida, establishing financial penalties for contractor non-performance on construction projects. The form acknowledges that timely completion is essential and that computing actual damages from delays is difficult and uncertain. The Town and contractor mutually agree that the contractor and contractor's surety shall be liable for liquidated damages in amounts per an attached schedule based on the Florida Department of Transportation guidelines (paragraph 8-10). These damages accrue for each calendar day after the scheduled completion date, including any time extensions granted through approved written change orders, and continue to accumulate until the work is actually completed. In cases where the contractor is terminated for default prior to completion, liquidated damages continue to accrue and are charged against the contractor through final project completion.

The form requires the contractor's authorized representative to sign and confirm the company's understanding of and compliance with the liquidated damages terms. The specific daily damage amounts are referenced in an attached schedule based on FDOT standards, though the actual dollar figures are not detailed in this document. This liquidated damages clause applies to the Bee Hives installation and maintenance contract at the Town's Par 3 Golf Course, which is a five-year agreement with honey harvesting and packaging requirements, and ensures the Town has financial recourse for any scheduling delays or contractor defaults during performance.
