About this file
This is a municipal ordinance document from the City of Lancaster, Pennsylvania, establishing comprehensive regulations for streets and sidewalks under Chapter 262 of the City Code, adopted in April 2017. The ordinance governs the design, construction, maintenance, and repair of all public streets, sidewalks, curbs, and related infrastructure within Lancaster's city limits. Key provisions address permits required for curb and sidewalk construction, street excavations, snow emergency management, sidewalk obstructions, and streetscape district standards. Property owners are responsible for constructing, maintaining, and repairing sidewalks, curbs, driveways, and planting strips adjacent to their properties and are liable for damages resulting from defective conditions. The City's Department of Public Works and Bureau of Engineering administer the permitting process, which includes applications, fees established by City Council resolution, surety bonds, and insurance certificates. Street opening permits require compliance with the Pennsylvania One Call System for underground utility protection and stormwater best management practices, with exemptions for certain municipal purposes and emergency situations. The ordinance establishes the Streetscape District, which includes downtown areas and specified street corridors, requiring adherence to the City of Lancaster Streetscape Design Guidelines for construction and maintenance of streetscape components.
The ordinance imposes permit fees, inspection fees, and degradation fees to be paid prior to permit issuance, with amounts specified in the Department of Public Works Right-of-Way Fee Schedule approved by City Council resolution. Property owners performing work on their own property are exempt from posting surety bonds, while contractors must furnish properly executed corporate surety bonds from reputable surety companies licensed in Pennsylvania. Violations of the ordinance are subject to civil penalties ranging from $500 to $1,000 per violation, with each day of violation constituting a separate offense, plus recovery of the City's reasonable attorney's fees and court costs. The ordinance incorporates by reference multiple technical standards including the Construction Specifications and Guidelines Manual and Streetscape Design Guidelines, which can be amended by the Director of Public Works with thirty days' notice to property owners. Specific provisions address emergency repairs to sidewalks, with the City authorized to perform repairs at the property owner's expense if the owner fails to comply within forty-eight hours of notification. Appeals of permit denials or violations must be filed within ten business days to the Department of Public Works Director, with further appeal rights to the Court of Common Pleas of Lancaster County. The ordinance also establishes requirements for temporary sidewalk closures, restoration guaranties of twenty-four months following street opening work, and mill and overlay requirements when more than 25 percent of a street surface has been excavated.
