Questions Answers
1 On sheet A2 of the plans that shows the FDR Typical Section, note 7 states “Spread pulverized material and pave across the available width on all curves. Add aggregate base if necessary”. My question/concern regarding this note is twofold. First, who determines if additional aggregate base is necessary? Second, how is the contractor supposed to figure these possible additional costs of additional aggregate base?
The contractor is required to provide aggregate base to meet the lines and grades shown in the plans.
Within the FDR section there are some segments in which the existing pavement width is slightly narrower (12 inches or less) than the proposed width.
2 I realize that the granular base material gets primed before the winter of 2021/2022, but undoubtedly there will be soft/unstable areas that show up in the spring of 2022. Is the contractor responsible for these soft/unstable areas?
Yes, the contractor is responsible for a subgrade that meets the specifications prior to paving.
3 Is there a maximum % amount that the Mobilization bid item amount can be compared to the overall total bid amount which in this case is $16.6M?
There is no maximum % amount for the Mobilization bid item. However, all bids are reviewed for unbalanced pricing and a bid may be rejected if it poses an unacceptable risk to the Government. See
FAR 15.404-1(g). The payment structure contained in Section 151 Mobilization should be considered before a determination of the mobilization amount is made.
4 At the pre-bid meeting last week stated that in order for the earthwork quantities to balance so that the contractor does not have to go far to either obtain dirt or waste dirt he will be able to go outside the ROW. Is this correct?
If so, will there be issues associated with whether or not this material will meet specification?
What about an archeological study in these possible borrow and waste areas
Will it be up to the contractor to deal with the landowner?
Per Section 111 of the Special Contract
Requirements, the contractor can utilize on-site borrow or waste sites that are within the contract limits of construction, but outside the limits of the proposed 4R work, to optimize earthwork mass haul.
Per the Geotechnical/Pavements report, the materials underlying the route are generally suitable for embankment construction.
The contractor is responsible for securing necessary permissions and environmental clearances on any borrow or waste areas outside the construction limits of the project.
5 Station 674+55.00 – 66.70’ LT Install 18” x 78.00’ CMP Culvert, 16 gage with 2 safety ends w/o bars
Is missing off of table?
This item is missing off the table and would increase the quantities for 18” culvert, ITEM NO. 60201-0600
78 LNFT and ITEM NO. 60210-0600 Safety Ends end sections, 2 EACH. This will be included in a future amendment.
6 Station 238+63.00 shows on plans 2 -30 degree bends, table say 20 degree bends.
Also couldn’t find a detail or spec on how you want the RCP – CMP transition adaptor
The Pipe Section, sheet 159, is correct showing 20 degree bends.
Pipe culvert plots are required by the specifications before ordering materials and bend angles or culvert lengths may be adjusted based on field conditions.
There are commercially available transitions between
RCP to CMP adaptor fittings.
7 I have a question on the pavement sections in this document. The first pavement section references TX140. See table
The second pavement section references TX7. See table.
These tables are not applicable to the structural section in the plans and specs and are superseded by the Technical Memorandum, Addendum to BIA
Geotechnical Report, dated August 14, 2020. The pavement section is based on the structural section in the typical sections, plans and specs. Sheet A5 of the plans details the locations where stabilization geogrid is specified.

8 According the station #’s in the plans for the FDR section (0+00 – 381+92.5) this equals 7.23 miles. However, on the bid form (sheet A-9) the quantity shown in the
FDR section is only 6.00 miles. Is this correct?
Amendment A001 replaced page A-9 which corrected the FDR section length.
9 What happens to the existing asphalt pavement and base course material beneath the pavement for sections 3R and 4R? Is this material reclaimed/processed-in-place? If so, is the intention for this material to be re-used as granular base material beneath the new asphalt pavement?
The existing asphalt pavement and base course material would be considered unclassified excavation. This material may be reclaimed/processed-in-place and reused as granular base material if it meets the specifications for aggregate base.
10 Why are the notes for section 3R (plan sheet A3) different than the notes for section 4R
(plan sheet A4?
The notes describe the different type of work based on the typical section. In the 4R areas in larger cuts or fills it may not be practical to pulverize the existing road.
The “Typical Section – 3R WITH UNDERCUT” represents a typical section that requires template control staking. The proposed centerline and road profile grade will be based off the existing road profile.
The “Typical Section - 4R per BIA PLANS” is controlled by a designed alignment and profile. The proposed design for this section is shown in the cross sections and will vary from the existing road profile.
11 Regarding traffic control, can BIA RT 10 be closed to through traffic? If so, is there a maximum distance that the road that can be closed?
Per Section 156 of the Special Contract
Requirements, the road will be closed to public traffic during construction; however, access must be provided to residences and businesses along the route, the majority of which are located on the easternmost 2 miles of the project.

12 Are there TERO/TECRO fees associated with this project?
The contractor is not responsible for the TERO fees associated with this project.
13 Note 4 on sheet A3 for the Typical Section 3R states that “Dimensions shown are approximate and may be varied by the CO”. Does this mean that the CO can change the width of the 3R section?
The majority of the route will fall within dimensions shown in the typical section; however, there may be a pullout, curve widening, or other special locations that differ from the typical section.
14 Note 6 on sheet A3 for the Typical Section 3R states that “Pulverize the existing paved width to a depth of 8” or as directed by the CO”. Does this mean that the CO can direct the contractor to pulverize to a depth greater than 8”?
The intent is to pulverize to a depth of 8 inches on the
3R typical section. There may be localized conditions along the route that require the depth of pulverization to be adjusted slightly for areas which have been patched previously or if the existing pavement and base is less than 8 inches in depth and clays are present. The pavement borings completed along the route do not indicate deviations to this depth will be necessary, but areas could still be encountered during construction.
15 Also regarding Note 6 on sheet A3, is this note requiring that the contractor must pulverize the existing paved surface? What is the contractor required to do with the existing paved surface and granular base that is in sections 3R and/or 4R?
Refer to the response to question 9.
16 For the FDR section (stations 0+00 to 381+92.5), why are there earthwork/embankment quantities shown on the P & P sheets? I thought that for the FDR sections the existing asphalt pavement and granular base is pulverized to a depth of 8”, this material is equalized and laid back down, and then a new 4” asphalt mat is installed. I didn’t think that there was any earthwork needed for the FDR Typical Section.
The Plan and Profile sheets included in the plans represent a 4R full reconstruction design along the entire length of the project. However, these earthwork quantities have been eliminated and reduced in the quantity tables for the FDR and 3R sections, respectively. For the FDR sections from station 0+00 to 381+92.5 it is estimated earthwork will not be required because the work is proposed as pulverize the existing pavement and pave matching the proposed typical section width of 24-ft which is based on the existing pavement width.
17 In the Special Contract Revisions on page E-61 in the Payment 401.19 section, it states that an asphalt concrete pavement contract price of $90/ton needs to be used when determining the payment price for asphalt material and binder according to Subsections
106.05 and Table 401-7. What is the purpose of this requirement? This seems like the contractor is being required to bid this work at a certain unit price, regardless of what the contractor arrives at for costs, etc
Because of the lump sum nature of the bid schedule, the contractor is not required to provide a unit price for asphalt based on tons. The $90/ton will be only be used to calculate pay factors associated with binder incentives.
18 Regarding the QCM requirements, what is considered equal to a NICET Level III certification? Would a Construction Management or Civil Engineering degree suffice?
Yes, a Civil Engineering or Construction
Management degree is acceptable with some demonstrated experience on highway construction projects.
19 For the Typical Section – 3R with Undercut on sheet A3, what is the purpose of Notes 6 and 7? Based on answer #9, it’s my understanding that the existing asphalt pavement and granular base material is considered unclassified excavation, and therefore the contractor does not need to pulverize and re-use.
The Contractor is not required to pulverize and reuse the material. If the contractor chooses to pulverize and reuse the material, the estimated depth is 8-inchs.
Note 7 is more applicable to a FDR section. Since there is undercut in this section the material will need to be picked up or moved to allow for the undercut if it is going to be reused.
20 Since the existing asphalt pavement and granular base material in section 3R is considered unclassified excavation, can you tell me how many yards of unclassified excavation the FHWA has estimated this total to be?
The estimated quantity for unclassified excavation for the example lengths is based on excavating the volume above the proposed undercut, which includes the 26 ft top width and 2-5 ft wedges at a depth of
13” for the proposed length. This is the bank cubic yard volume shown in the roadway prism column in the grading summary for the 3R-with undercut station ranges.
The estimated quantity of asphalt pavement and granular base material in the 3R section can be calculated from the Geotech report borings based on the existing pavement structural section.
The quantity of asphalt pavement and granular base that compose the total of the unclassified excavation will depend on the length of 3R the contractor proposes to construct. This quantity can be estimated by calculating the width of existing asphalt x length x estimated depth of existing asphalt and base.
We have estimated a pulverize depth of 8-inches if this material is reused as aggregate base and meets the specifications for aggregate base.
21 I realize the maximum number of miles that 4R can be bid at is 6.31 miles. Is there a minimum distance or length required for the 4R unit price bid?
No

22 Will the Owner be responsible for all costs associated with relocating any utilities that need to be relocated?
Yes. The owner is responsible for costs associated with utility relocations. The intent is to have the utilities relocated before construction begins.
23 I am a little confused with your answers related to the existing asphalt pavement and base course material in sections 3R and 4R being considered unclassified excavation and can be reused as granular base material if it meets the specifications for aggregate base. If we assume that this reclaimed material won’t meet the specifications for base course and subsequently can’t be used as part of the required 10” of Aggregate Base, what is supposed to be done with this reclaimed material? Does it become part of the
Roadway Excavation quantity? What if the contractor does not elect to pulverize the existing asphalt pavement and granular base material in sections 3R and 4R and instead?
If the material is not reclaimed it will be treated as unclassified excavation and can be used as embankment, backfill or disposed of according to the requirements for embankment construction and environmental requirements for the type of material.
For the 3R and 4R sections the quantity is included in the Roadway Excavation quantity under Roadway
Prism (BCY). If the quantity is pulverized and resused as base this would lower the 20401-0000
Roadway Excavation, the Total Excavation available for Fills (BCY) and the Waste quantities by the volume that is pulverized and removed.
If the pulverized material meets the specifications and is used for base material it would also reduce the quantity of imported material required for 30203-
2000 Roadway Aggregate, Method 2 on the surfacing summary.
24 I don’t see where granular material is required on any of the approaches, driveways to homes and intersecting roads. Is this correct?
The typical road entrance section is shown on Sheet 6 of 343 in the plans. Granular material is required matching the adjacent pavement section. A quantity of Item 30203-2000 Roadway Aggregate Method 2 for “Accesses and Irregularities” is shown on the surfacing summary tables on sheets B7, B26, and
B45.
25 How long does the Tribe get to make payments to the contractor once the pay requests are finalized by the FHWA and contractor?
FHWA is handling contract administration, including payments on this project. Progress payments will be made 14 days after a proper payment request is received, as required by FAR clause 52.232-27, Prompt Payment for Construction Contracts.
26 Who submits the pay requests to the Tribe?
The contract will be between the FHWA and the prime contractor. The prime contractor will submit pay requests to the FHWA for processing and payment.

27 If for example we figured 1.5 miles for the 4R section instead of 1.95 miles, does the concrete sidewalk still have to be installed for the 0.45 miles?
No, but the contractor would be responsible to develop and provide a plan and the work to tie into the existing facilities like the lighting, sidewalks fences, road profile transition, drainage and ditch grading and other features.
28 If the contractor elects to build 3R from Station 397+98 to 628+00, will the berms be eliminated at Stations 539+22 and 562+88 as this will not be a full grading section? If they are required to be built, where will the dirt come from?
The berms would be eliminated at stations 539+22 and 562+88.
Contractor is responsible for borrow sources.
29 Is there a breakdown of the Structure Excavation item showing quantities and locations? Sheet 8 Plan Notes has a breakdown of the estimated
Culvert Structure excavation. This is based on the 4R
Full Design Profile and 4R grading.
30 Regarding my question from earlier this morning about whether or not roadway aggregate is required on the approaches, driveways, and intersecting roads, I have attached plan sheet 8 of the project plans that answers this. However, as you can see, these plan notes reference bid items 301.003 and 402.225, which are not applicable to these project bidding documents. Likewise, what are the quantities that the FHWA has estimated for the Roadway Aggregate and Asphalt Concrete Pavement that will be needed at all of the approaches, driveways, and intersecting roads.
Estimated quantities for Approaches, driveways and intersecting roads “Accesses and Irregularities” is shown on the surfacing summary tables on sheets B7, B26, and B45.
A breakdown of individual locations will not be furnished.
31 I want to make sure the that Full Depth Reclamation (FDR) that is being required for this project is the FDR that is applicable to Section 304 in the FP-14 spec book. There are several types of FDR that deal with adding cement, oil, etc., and I want to be sure that these type of FDR requirements are not applicable for this job.
Construct the Full Depth Reclamation, Method 2 according to Section 304 of the FP-14.
32 In the Summary of Quantities – Example 628A table, the estimated quantity for 42”
RCP is only 130 LF; however this quantity in Example 397A is 936 LF and this quantity in Example 540A is 900 LF. Is the quantity shown in Example 628A incorrect?
The quantity shown in the Example 628A is not correct. The correct quantity is 900 LF. See Sheet
B47 for individual pipe locations.
33 On plan sheet 158 of 248 lighting starts at station 641 and goes to station 657 on sheet
159 with no pathway shown. There is a detail on plan sheet 73 for an 8’ pathway. Will there be new pathway added to this area? I can’t find an shown on the plan sheets.
See P&P Sheet 142 and 143 of 343 (209 and 210 of
248 in the pdf) shows a new concrete sidewalk.
