About this file

This document is an Amendment (No. 0001) for a Mid-Atlantic Region Construction Multiple Award Task Order Contract (MATOC) issued by the Federal Highway Administration's Eastern Federal Lands Highway Division. The solicitation (693C73-25-R-000073) is for a seed project located in the Chesapeake and Ohio Canal National Historical Park in Montgomery and Washington Counties, Maryland, with an estimated project cost between $2-3 million. The amendment provides clarifications and responses to potential offerors' questions, including confirmation that projects between $50,000 and $3 million are preferred, but larger projects will be acceptable if they meet specified criteria.

Key modifications include a correction to the business size determination (clarifying that businesses with average annual gross receipts above $45 million over 5 years are considered large businesses) and confirmation of various submission requirements. The seed project involves rehabilitation of McCoys Ferry, Four Locks, and Carderock tunnels, including concrete removal, riprap, structural concrete repairs, joint work, drainage improvements, and roadway excavation. The proposal due date remains Friday, August 29, 2025, at 2:00 p.m. EDT, with offerors able to submit questions to eflhd.contracts@dot.gov, though questions submitted within 7 days of the proposal due date may not receive timely responses.

Questions/Clarifications

Offerors can send written questions or inquiries for clarification to: eflhd.contracts@dot.gov.

Questions can be submitted at any time, but questions submitted within 7 days of the proposal due date may not be answered in time for the offeror to properly incorporate the responses into their offer.

The following questions were asked via email. The Government response or clarification is provided below. Due to the repetitive nature of several questions and issues, the wording of the questions may have been revised, and some questions may not be included. The Government’s direct response to the sender may also have been updated below for better clarity.

1. Where is the location of the seed project?

Response: The seed project is for the Chesapeake and Ohio Canal National Historical Park and located in Montgomery and Washington Counties, Maryland. The project is to rehabilitate the McCoys Ferry, Four Locks, and Carderock tunnels. The work includes concrete removal, riprap, structural concrete, structural concrete injection and crack repairs, cleaning and resealing joints, expansion joints, drainage weep holes, stone masonry repairs, culvert installation, roadway and ditch excavation, asphalt concrete pavement, and other miscellaneous work. The cost of the seed project is expected to fall within the price range of $2,000,000 to $3,000,000.

2. Please confirm the range for projects submitted in technical proposal is $50,000 to $3,000,000.

Response: This price range is indicative of the size and scope of anticipated task orders to be awarded via subsequent IDIQ contracts in the future. Projects higher than $3M would be acceptable as long as each project is similar in scope and reflect as many of the 12 elements provided in Section M of the solicitation as possible.

3. Would projects that are higher than $3M be acceptable? Or would they be rated less favorably?

Response: Yes, projects higher than $3M would be acceptable as long as each project is similar in scope and reflect as many of the 12 elements provided in Section M of the solicitation as possible.

4. Is a bid bond required for seed project? It states bonding letter is required, but no mention of bid bond. However, there is a provided bid bond form for seed project. If it is required, do we submit this in technical proposal or price?

Response: Yes, a bid bond is required for the seed project. The bid bond should be included as a part of your price proposal.

mailto:eflhd.contracts@dot.gov

5. Is it acceptable to submit previously completed PPQs if CPARS does not exist for projects in past performance?

Response: Yes, as long as they meet the requirements as stated in Section M of the solicitation.

6. Would a “title page” what includes the presidents signature be enough to satisfy the required “authority to sign” as past of the technical proposal?

Response: No. Offerors are to submit complete and signed Authority to Sign forms as provided in the solicitation.

7. Is there a deadline to submit questions?

Response: Questions can be submitted at any time, but questions submitted within 7 days of the proposal due date may not be answered in time for the offeror to properly incorporate the responses into their proposal.

8. Page K-1 states, “If your average annual gross receipts for the past 3 years are above $45 million you are a large business for this solicitation.” However, it is our understanding that the SBA guidance for graduating is based off of our 5-year annual average revenue. Can you please confirm that the above statement should say 5 years?

Response: Correct, the statement in the box in Section K.2 on page K-1 of the solicitation should state “If your average annual gross receipts for the past 5 years are above $45 million, then you are a large business for this solicitation.” Please see revised Page K-1 in Amendment No. 0001.

9. Is it acceptable to include the bid guarantee for the seed project in the Price Proposal?

Response: Yes, please include the bid guarantee for the seed project in the price proposal.

10. RFP Factor 1 criteria includes "roadway reconstruction of 1-mile or more corridor" but does not state new road construction. Will new road construction also be considered relevant under Factor 1 Prime Contractor Recent and Relevant Experience?

Response: Yes, new road construction will also be considered relevant under Factor 1.

11. In accordance with FAR 215.305 Proposal Evaluation (Jan 2025), the agency shall consider relevant past performance of affiliates of the Offeror. For two companies that are wholly-owned subsidiaries controlled by the same parent company, will past performance of one subsidiary (not the Offeror) be deemed relevant for the Offeror's use for this solicitation?

Response: The Department of Defense’s Defense Federal Acquisition Regulation Supplement (DFARS 215.305) does not apply to civilian federal agencies. Therefore, the one subsidiary's (not the Offeror) past performance will not be deemed relevant for the Offeror's use for this solicitation.
