About this file

This document is an amendment to a solicitation for the George Washington Memorial Parkway Mount Vernon Trail Reconstruction project (Solicitation #693C73-24-R-000018) issued by the Federal Highway Administration, Eastern Federal Lands Highway Division.

The key details are:

  • The purpose of the amendment is to provide responses to questions and clarifications submitted by potential offerors, and to extend the Statement of Qualifications (SOQ) due date to July 24, 2024 at 2:00 pm EST.
  • The questions addressed include the licensing requirements for key personnel such as the Designer of Record, Bridge Engineer, Traffic Control Manager, and Landscape Architect. The government response is that the required licenses must be obtained prior to contract award, and if the proposed staff does not currently have the required licenses, the offeror should indicate that the licenses will be obtained prior to award and describe the steps being taken.
  • The amendment also clarifies that the Independent Quality Program Manager must be employed by a firm that is independent of the design firm and prime contractor.
  • The government will provide independent assurance for the owner's design, while the contractor is responsible for ensuring design and construction compliance with the contract.

Amendment No. 0001 Project VA NP GWMP MVT(4)

George Washington Memorial Parkway Mount Vernon Trail Reconstruction Solicitation: 693C73-24-R-000018

The purpose of this Amendment is to:

1) Provide a summary of responses to questions/clarifications asked by potential Offerors.

2) Extend the Statement of Qualification (SOQ) due date to July 24, 2024, at 2:00 p.m. EST.

Questions / Clarifications

The following questions and issues were submitted to EFLHD at eflhd.contracts@dot.gov.

The Government response or clarification is provided. Due to the repetitive nature of several questions and issues, the wording of the questions may have been revised and some questions have not been included. The Government’s direct response to the sender may also have been updated below for better clarity.

1. Designer of Record (DOR) – can the RFQ be amended so that the DOR is a Professional Engineer in another state and has the ability to be licensed as a Professional Engineer in the Commonwealth of Virginia and the District of Columbia?

Response: The required licenses listed in the Request for Qualifications must be obtained before contract award. If the proposed staff currently does not have the required licenses, please indicate in the proposal that license will be obtained prior to award and describe the steps that are being taken to obtain the required licenses.

2. Bridge Engineer - can the RFQ be amended so that the Bridge Engineer is a Professional Engineer in another state and has the ability to be licensed as a Professional Engineer in the Commonwealth of Virginia and the District of Columbia?

Response: The required licenses listed in the Request for Qualifications must be obtained before contract award. If the proposed staff currently does not have the required licenses, please indicate in the proposal that license will be obtained prior to award and describe the steps that are being taken to obtain the required licenses.

3. Traffic Control Manager - can the RFQ be amended so that the Traffic Control Manager has received Advance Traffic Control training (20 hour course work) and is a Professional Engineer in another state has the ability to be licensed as a Professional Engineer in the Commonwealth of Virginia and the District of Columbia rather than be a Professional Traffic Operations Engineer?

Response: The required licenses listed in the Request for Qualifications must be obtained before contract award. If the proposed staff currently does not have the required licenses, please indicate in the proposal that license will be obtained prior to award and describe the steps that are being taken to obtain the required licenses.

4. Landscape Architect - can the RFQ be amended so that the Landscape Architect is a

Professional Landscape Architect in another state and has the ability to be licensed as a Professional Landscape Architect in the Commonwealth of Virginia and the District of Columbia?

Response: The required licenses listed in the Request for Qualifications must be obtained before contract award. If the proposed staff currently does not have the required licenses, please indicate in the proposal that license will be obtained prior

5. Given that the Base Contract work is in Virginia and only Option 1 is located in the District of Columbia, is it acceptable to have key personnel obtain their DC PE prior to the DB contract award? All key personnel have the required VA PE licenses, and have applied for reciprocity to obtain the DC PE, however the current processing time for DC Department of Licensing and Consumer Protection (DLCP) issuing approvals of licenses is estimated to be in excess of 6 months.

Response: The required licenses listed in the Request for Qualifications must be obtained before contract award. If the proposed staff currently does not have the required licenses, please indicate in the proposal that license will be obtained prior

6. Please clarify if the Independent Quality Program Manager (QPM) role can be from one of the firms providing services on the project team, as long as it is not in a design function. For example, can a firm have an employee serve as the QPM, while another, separate employee provides Utility Coordination or Construction QC Services? There could be fire walls put into place to be sure the QPM stays independent.

Response: No. The QPM shall be employed by an independent firm independent of the design firm and prime contractor companies.

7. Will the Geotechnical Engineer and the Surveyor who participated in the preparation of the PRELIMINARY DESIGN PLANS be allowed to be part of the DESIGN-BUILD Team?

Response: Yes. If the Offeror believes there is an issue, the Offeror can submit per FAR 9.5 a Conflict of Interest Resolution Document with the Proposal.

8. Is there the possibility that the roles related to Key Personnel: Quality Program Manager would be absorbed into that of Construction Quality Control Manager, or that the requirement for a Quality Program Manager would be removed altogether?

Response: No.

9. Provide clarification on who will be providing the Independent Quality Assurance for design. The Draft RFP states the following:

a. 153.02 - The Government will perform owner’s Independent Assurance of the Contractor’s design.

Response: The Government will represent the owner and provide independent assurance for the owner. The Contractor is responsible for ensuring that the design and construction of the project are in conformance with the contract and design documents.

b. 153.03 - Perform design QA functions by an independent firm that has no other involvement in the design or construction of this project.

Response: It is the responsibility of the Contractor to provide an independent firm independent of the design firm and prime contractor companies to perform design quality assurance functions.
