2. Offerors must include prices for all the Basic Requirement Items and Optional Requirement to be considered responsive.
3. The Corporation intends to award the Basic Requirement by November 20, 2020; award of the Optional Requirement is dependent upon the availability of funds.

DESCRIPTION/SPECS. /WORK STATEMENT
SPECIAL PROVISIONS
C.1. DESCRIPTION OF THE WORK.
This is a two-phase design-build construction procurement. In Phase One, interested offerors were required to submit proposals, demonstrating their capability to successfully execute the design-build construction contract resulting from this solicitation. The Saint Lawrence Seaway Development Corporation (SLSDC) evaluated the Phase One submittals in accordance with the criteria described in the solicitation and has determined the most highly qualified offerors – no more than five – to compete for the design-build contract in Phase Two. Offerors qualifying for Phase Two shall submit technical and cost proposals in accordance with the criteria described herein.
Scope of Work Overview
This scope of work shall provide all design and construction services required to complete the replacement of diffuser structures (diffusers) at Eisenhower Lock located in Massena, New York. The SLSDC intends to replace up to six (6) concrete diffusers (water manifolds) below the downstream sill at Eisenhower Lock over two winter seasons.
Generally, the Contractor’s responsibilities shall include, but will not be limited to, the following:
a. Design the replacement diffuser lateral. The design objectives are to have a new diffuser that is structurally and hydraulically equivalent to the existing with comparable durability. A service life of at least 50 years is required. Reinforced concrete is anticipated but the SLSDC will entertain the use of alternate materials. If the geometry of the new diffusers and/or a material other than reinforced concrete are proposed, the design must include sufficient technical specifications and modeling data for the SLSDC to verify the structural and hydraulic performance and the durability of the new diffuser lateral. Reinforced concrete designs shall include reinforcing steel and all concrete properties.
b. Prepare a work plan by which the new diffusers will be constructed, positioned and anchored. This will include concrete curing, and other temperature control as may be required.
c. Prepare a work plan and methodology to access, demolish and remove the existing diffusers.
d. Prepare work plans to include personnel, site layout, weather protection, mobilization and demobilization.
e. Design of any temporary structures that will be supporting personnel, equipment, material and/or other live or construction loads.
f. Prepare a comprehensive project quality control plan by which the contractor will define and follow standards of quality for the constructed project
g. All engineering designs, specifications and as-built documentation must be sealed by a New York
State Licensed Engineer and contain all computations. The engineering designs may be performed by in-house personnel, or on a joint venture or subcontracted basis.
h. Perform the actual work, including mobilization, setup, existing diffuser removal, new diffuser construction/installation, site breakdown, and demobilization.
The diffusers are normally submerged in about 35 feet of water. Demolition and construction work can only be done when the lock is out of service and dewatered during the annual winter navigation shutdown period (season) from approximately January 11th through March 15th. Access to the work areas is restricted in that the diffusers are about
40 feet below the adjacent lock wall surfaces. This will require temporary special access means such as construction stairways, elevators, etc. for personnel access, and crane service will be required to insert and remove materials and equipment. The SLSDC cannot fully dewater the diffuser work area. Additionally, water will infiltrate into the dewatered areas. Water levels will fluctuate to as much as approximately 2-feet in the work area. Therefore, the
Contractor must provide means to manage water in the work area as needed.
Overall Project Schedule
The overall project schedule is as follows

C.2. CONTRACT DRAWING AND SPECIFICATIONS.
These special provisions provide a basic description of the various tasks comprising the project and together with the technical specifications, contract drawings, reference drawings, approved submittals and referenced publications, codes and standards form the contract requirements for the project. The specifications and drawings are being furnished to the Contractor per Part III, Section J, List of Attachments, in a pdf attachment. Hard copies can be furnished upon request at the cost of reproduction and are available from the Office of Engineering and Maintenance, Saint Lawrence Seaway Development Corporation, 180 Andrews Street, Massena, New York 13662-0520.
C.3. WORK SITE REQUIREMENTS.
a. General. The Contractor acknowledges that he/she has satisfied himself/herself as to the nature and location of the work, the general and local conditions, including but not restricted to those bearing upon transportation, disposal, handling, and storage of materials, availability of labor, water, electric power, roads, uncertainties of weather or similar physical conditions at the site, the conformation and conditions of the ground and structures, and the character of equipment and facilities needed preliminary to and during prosecution of the work. The Contractor further acknowledges that he/she has satisfied himself/herself as to the character, quality and quantity of surface and subsurface materials or interference from existing structures or related facilities to be encountered insofar as this information is reasonably ascertainable from an inspection of the site as well as from information presented by the contract and reference drawings and these specifications. If the Contractor fails to properly acquaint himself/herself with the available information and existing work site conditions, he/she will not be relieved from responsibility for properly estimating the cost of successfully performing the work. The Contractor shall be responsible for performing all work in strict accordance with applicable SLSDC and Occupational Safety and Health
Administration (OSHA) safety and health requirements. The Contractor shall also comply with SLSDC lock-out/tag out requirements and furnish his/her own locks for this purpose.
b. Utilities.
1. Air. The Contractor shall be responsible for providing and maintaining all compressed air required for the performance of the work. The Contractor's portable air compressor(s) shall be located on the lock wall in areas to be approved by the Contracting Officer's Technical Representative (COR).
2. Electricity. The SLSDC will provide the Contractor with two (2) load centers which will be located on top of the lock wall or other locations agreed upon by the Contractor and COR. Each load center will provide the
Contractor with a total electrical capacity of 60 amps of three-phase 208/120 volt power. The load centers each have six (6) 120V single phase twist-lock receptacles, 20 amp each, two (2) standard 120V single phase receptacles, 20 amp each, two (2) 208V three-phase twist-lock, 30 amps combined, and one 208V single phase twist-lock at 20 amps. All conductors, lights and outlets from there shall be provided by the Contractor.
The Contractor shall provide any additional power required at his/her own expense. Temporary wiring, extension cords and GFCI protection devices shall be properly sized and conform to applicable provisions of OSHA and the
National Electrical Code.
3. Heating. The Contractor shall be responsible for heating the work area as required. Methods used for heating shall not create a hazardous atmosphere for workers and shall not create excessive accumulations of carbon dioxide or other fumes or gases that interfere with any applicable concrete curing.
4. Lighting. The Contractor shall be responsible for lighting the work area as required.
5. Water. Any water required shall be provided by the Contractor at his/her own expense.
c. Sanitation. The Contractor shall provide chemical toilets within his/her work area which shall comply fully with the New York State Department of Health Standards. The capacity of the toilets shall be sufficient to provide for the needs of the Contractor’s people and all waste material from the toilets shall be disposed of away from the site.
The Contractor shall be responsible for keeping his/her work areas clean of refuse of any kind and shall dispose of all refuse off the site.
d. Parking Areas. The Contractor and his/her work crews shall park their vehicles in areas designated by the
Contracting Officer's Representative (COR). Vehicles required for transporting equipment and materials to and/or from the work site shall not be parked at the work site for long periods of time without prior approval of the COR.
e. Work Areas. The work site required by this contract will be on both sides of Eisenhower Lock downstream of the lower miter gate. The Contractor shall submit a work site layout plan to be approved by the
COR.
f. Restricted Areas. The Contractor will be required to confine his/her operations to the work area, as designated in the previous subparagraph. The access roads, parking areas and SLSDC buildings shall be kept free of the Contractor’s personnel, materials and equipment. When necessary for the Contractor’s personnel, materials, or equipment to occupy these restricted areas, the Contractor shall notify the COR to coordinate this with SLSDC operations. The Contractor’s personnel must not drive vehicles or equipment over any recess covers or gratings located on the lock walls, nor set up cranes on any recess covers or gratings because they are not designed for these loads. The locations of the recess covers and gratings are indicated on the contract reference drawings however, the Contractor is responsible for verifying the recess cover and grating locations in the field prior to submitting the work site layout plan for approval and commencing work.
g. Existing Conditions and/or Existing Features. The Contractor will be able to start mobilizing materials and equipment to the site to locations as approved by the COR after receiving the Notice to Proceed however, he/she will not be able to place anything adjacent to the lock walls until the lock has been covered or has been given permission by the SLSDC. The locks will not be covered, thus the Contractor must provide any heating and weather protection that is necessary for his/her work in addition to any snow and ice removal within the work areas required to perform the work.
i. Snow and Ice Removal. Snowplowing and sanding will be provided by the SLSDC for roadway access to the work site and in the parking area however, it must be expected that at times of sudden, unpredictable and/or heavy snowstorms, the snow removal may be delayed. Any additional snow or ice removal or sanding as deemed necessary by the Contractor to maintain his/her work areas and schedule shall be by and at the expense of the Contractor.
j. Inspection. The Contractor's work will be inspected by the COR and the Contracting Officer. The COR has the authority to reject work not conforming to the contract documents however, the Contracting Officer will have the ultimate authority for project acceptance. It is the Contractor's responsibility to ensure that all work conforms to the approved design and contract documents. The Contractor will also be responsible for providing access to all work for the COR, or their designee as required for inspection of the work.
k. Protection of SLSDC Facilities: Various structures, utilities and equipment housed in the cable gallery and elsewhere are critical to lock operations and care shall be taken to prevent damage to these during demolition and new construction. The Contractor shall be responsible for the cost of repair for any damage he/she causes to all existing structures, utilities, equipment etc. and additional costs associated with required assistance from the SLSDC’s personnel, materials or equipment. During the navigation season, a disincentive in the amount of $500.00 USD per hour will be assessed for any documented shipping delay resulting from damages attributed to the Contractor.
C.4. LAYOUT OF WORK.
The Contractor shall furnish, at his/her own expense, all stakes, templates, platforms, equipment, or other guides as may be required in laying out any part of the work. The Contractor shall be held responsible for the execution of the work to such lines and grades as shown on the contract drawings or may be established or indicated by the COR. It shall be the responsibility of the Contractor to maintain and preserve any controls established by the COR until authorized to remove them. All elevations on the contract and reference drawings are based on the 1935 United States
Lake Survey (USLS) Datum unless another datum is noted on the individual drawing.
C.5. SLSDC AND CONTRACTOR-FURNISHED MATERIALS.
a. SLSDC Furnished Materials. None.
b. Contractor-Furnished Materials. The Contractor shall furnish all materials for the satisfactory completion of this contract. All materials shall be of the type and quality described in the Technical Provisions and contract documents.
❖ Underwriters Laboratories, Inc. (UL™) Standards.
Where items/materials to be supplied are available with UL™ standard of approval, they shall be provided including
Health and Sustainability standards as created through UL™ Environment and the GREENGUARD Environmental
Institute (GEI). Where determined that the UL™ standard is in conflict with Paragraph a. below, Paragraph a. shall take precedence over meeting the UL™ standard.
❖ Compliance with Executive Orders.
Pursuant to Executive Order 13693, “Planning for Federal Sustainability in the Next Decade”, the Contractor shall exert its best efforts to provide its services in a manner that will promote the natural environment and protect the health and wellbeing of Federal employees and contract service providers. To the extent that the construction services provided by the Contractor require provision of any of these types of products, the Contractor is expected to provide the green type of product unless that type of product is not available competitively within a reasonable time, at a reasonable price, is not life cycle cost efficient in the case of energy consuming products, or does not meet reasonable performance standards.
❖ Energy Independence and Security Act of 2007, Energy Policy Act of 2005, Executive Orders and
Federal Acquisition Regulation (FAR) Compliance.
The Contractor shall provide ENERGY STAR® qualified and FEMP designated products in performance of construction. When acquiring energy-using products, the contractor shall purchase ENERGY STAR® or other energy-efficient items listed on the Department of Energy’s Federal Energy Management Program (FEMP) Product
Energy Efficiency Recommendations product list. This applies to any power-consuming equipment to be installed or used in SLSDC facilities, whether title to the equipment will pass to the Government or be retained by the
Contractor.
❖ Use of Low Emitting Materials.
The Contractor shall include the use of low emitting materials for building modifications and construction, and maintenance and cleaning when applicable during Contract period. In particular, the following materials and products are to have low pollutant emissions: composite wood products, adhesives, sealants, interior paints and finishes, solvents, carpet systems, janitorial supplies, and furnishings.
❖ Use of Products That Have a Lesser or Reduced Effect on Human Health and the Environment.
The Contractor shall use products that have a lesser or reduced effect on human health and the environment over their lifecycle when compared with competing products or services that serve the same purpose. A number of standards and eco-labels are available in the marketplace to assist in making environmentally preferable decisions. For recommendations, consult the Federal Green Construction:
❖ Eliminate/Minimize the Use of Ozone Depleting Compounds.
The Contractor shall eliminate/minimize the use of ozone depleting compounds in the project where alternative environmentally preferable products are available, consistent with either the Montreal Protocol and Title VI of the
Clean Air Act Amendments of 1990, or equivalent overall air quality benefits that take into account lifecycle impacts.
C.6. PLANT.
The Contractor shall furnish all plant required for the performance of the contract. The plant shall be in satisfactory operating condition and capable of safely and efficiently performing the work. The plant shall be available for the
COR’s inspection at any time.
C.7. ENVIRONMENT PROTECTION.
a. General. For this specification, environment protection is defined as the retention of the environment in its natural state to the greatest possible extent during project construction and the enhancement of the natural appearance in its final condition. Environment protection requires consideration of air, water, and land and involves noise, solid waste management, hazardous waste management and management of radiant energy and radioactive materials, as well as other pollutants. In order to prevent and to provide for abatement and control of any environmental pollution arising from the construction activities in the performance of this contract, the Contractor and his/her subcontractors shall identify and comply with all Federal, State, and Local laws and regulations concerning environmental pollution control and abatement. Any non-compliance shall be immediately corrected and the Contracting Officer notified.
b. Notification. The Contracting Officer or her representative will notify the Contractor of any noncompliance detected by the SLSDC with the applicable Federal, State or Local laws or regulations. Such notice, when delivered to the Contractor or his/her authorized representative at the site of the work, shall be deemed sufficient for the purpose.
The Contractor shall, after receipt of such notice, immediately inform the COR of the proposed corrective action and take such action as may be approved. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop order shall be made the subject of a claim for extension of time or for excess costs or damages by the Contractor.
c. Protection of Land Resources. The land resources within the project boundaries and outside the limits of permanent work performed under this contract shall be preserved in their present condition or be restored to a condition after completion of construction that will appear to be natural and not detract from the appearance of the project. The Contractor shall confine his/her construction activities to areas defined by the plans and specifications.
d. Protection of Water Resources. The Contractor shall not pollute the River with fuels, oils, greases, bitumens, calcium chloride, acids, insecticides, herbicides, or other harmful materials. The Contractor shall identify and comply with all applicable Federal, State and Local laws and regulations concerning pollution of the St. Lawrence
River.
e. Protection of Air Resources. The Contractor shall identify and comply with all applicable Federal, State and Local laws and regulations concerning air quality and pollution.
C.8. DISPOSAL.
a. Spoil. Any waste material (except for concrete) shall be removed from the work site by the Contractor and disposed at his/her own expense in strict accordance with all applicable Federal, State and Local laws and regulations, the Contractor’s Solid and Hazardous Waste Management Plan and these provisions. The Contractor may spoil concrete pieces removed during the demolition, unused fresh concrete and concrete truck washout on SLSDC property on the north side of Eisenhower and Snell Locks in areas designated by the COR. Metals shall be disposed off-site by the Contractor.
b. Waste. The Contractor shall bear all costs and responsibilities associated with any waste generated including handling, testing/characterization, containerizing, labeling, transportation, recycling, treatment or disposal including obtaining, completing and monitoring each manifest.
c. Submittals. The Contractor shall submit the following within 30 calendar days of award:
a. Detailed design and specifications for materials and methods for new diffuser construction. Sufficient detail shall be provided to give a complete understanding of the proper construction materials and methods and how they will meet the design objectives. These specifications shall include sufficient quality control tests and inspections to assure conformance with the design objectives. Provide certification by a New York State registered professional engineer.
b. Shop and field drawings for the fabrication and installation of the new diffusers, to include reinforcing bar drawings as appropriate. Provide certification by a New York State registered professional engineer.
c. Demolition work plan showing methods, equipment and sequences for all demolition and removal of concrete.
d. Project quality control (QC) plan explaining all QC activities to be performed by the Contractor and any subcontractors. The QC plan shall show coordination of activities with work plan timelines.
e. Schedule of values for progress payment purposes. The schedule of values shall conform to the awarded basic and optional requirements listed in the Cost Proposal. Additional sub-line items may be included to provide additional detail as deemed necessary by the Contractor or requested by the
COR.
f. Project schedule showing dates and timelines for design, materials procurement, fabrication and performing the salient features of the work.
g. Project work plan explaining all project activities to be performed by the Contractor and any subcontractors. The work plan shall show each activity with timelines.
h. Project-specific health and safety plan outlining how the Contractor will maintain the health and safety of all personnel (Contractor, SLSDC and others) potentially sharing the work space.
i. Solid and Hazardous Waste Management Plan outlining how the contractor shall manage the collection, disposal and documentation of all non-hazardous and hazardous solid waste.
j. Designs and construction plans for any specially constructed work platforms and/or scaffolding, and anchoring systems for same. For commercially available scaffolding and work platform systems, provide documentation and certification that they meet the OSHA requirements. For custom-designed and built systems, provide certification by a New York State registered professional engineer.
k. Welding procedure specifications with procedure qualification records as applicable and welder performance qualification records.
l. Load test procedures for embedded anchors. The procedures shall include a schedule of test loads and methods for applying the test load.
m. Qualification and certification data for firms and personnel performing nondestructive examination and welding inspection.
For the purposes of this specification, “approval” of submittals means that the SLSDC or its designee has reviewed them for completeness and for general conformance to the design concepts. “Approval” of any submittal does not relieve the Contractor from responsibility for proper workmanship, material conformance, dimensional accuracy and design adequacy for those elements not detailed on the contract drawings. The Contractor retains sole responsibility for dimensional accuracy of new fabrications and installations.
d. Handling and Documentation. The Contractor shall not store hazardous waste at the work site in a manner as to create a regulated storage facility. All hazardous waste shall be managed in accordance with applicable Federal, State and local laws and regulations. All containers shall be properly located and labeled including contents and first date of accumulation. The Contractor’s Environmental Representative shall ensure that analysis certificates are obtained from an accredited laboratory, in the case where a characterization of the waste is required. The
Contractor’s Environmental Representative shall obtain a recycled, treatment or disposal certificate issued by the final destination facility for all wastes. The Contractor shall maintain documentation of all waste materials generated and removed from the work site in such a manner as to enable the SLSDC to trace the material from its point of origin to its final disposition and location.
e. Transportation. The Contractor shall utilize a properly licensed, permitted and insured transporter for transportation of hazardous waste or special waste generated during the work. The Contractor shall supply the COR with the intended transporter(s) names and license/permit scheduled by the Contractor to transport these materials.
This information shall be submitted to the COR prior to any shipments.
f. Recycling, Treatment and Disposal. The Contractor shall utilize waste recycling, treatment and/or disposal firms and facilities that possess the proper licenses, permits and insurance for recycling, treatment and/or disposal of the anticipated wastes generated by the work. The Contractor shall supply the COR with the names and license or permit numbers of the firm(s) as well as the designated facility information of the intended recipient of the wastes, including transfer facilities, up to and including final disposition. This information shall be submitted to the COR prior to any shipments.
C.9. DISPOSAL BY BURNING.
Burning will not be permitted.
C.10. USE OF EXPLOSIVES.
Blasting will not be permitted.
C.11. SAFETY.
The Contractor’s work shall comply with all applicable OSHA and SLSDC requirements. Prior to mobilizing on the project site, the Contractor shall submit a detailed and project specific health and safety plan for review by the SLSDC.
If the COR or designee determines that any of the Contractor’s work practices are not conforming to SLSDC and
OSHA health and safety regulations, they shall immediately notify the Contractor and record it in the daily log. If the deficiency is not corrected in a timely manner or presents an imminent danger, the COR or SLSDC safety representative will have the authority to stop the work, but in that case, they must notify the Contracting Officer and COR within one (1) hour of such occurrence. The Contractor shall verbally report any accidents or injuries immediately to the COR with a written report to the Contracting Officer with copies to the COR to follow within twenty-four (24) hours.
The Contractor must comply with requirements put forth by SLSDC that are result of, and intended to limit the spread of, the coronavirus disease known as COVID-19. The current requirements are attached.
C.12. WAGE RATES.
The requirements for the minimum wages to be paid to laborers and mechanics on this project, as most recently determined by the Secretary of Labor to be prevailing for the corresponding classes of laborers and mechanics employed on projects of a character similar to the contract work in the pertinent locality, are as set forth in the attached
Wage Determination. The complete determination is incorporated in the attachment regardless of whether the
Contractor will employ all of the classes of laborers and mechanics listed.
Any class of laborers and mechanics not listed in the Wage Determination which will be employed on this contract, shall be classified or reclassified to conform to Wage Determination by agreement between the Contractor and the class of labor concerned, and be subject to the prior approval of the Contracting Officer. In the event the interested parties cannot agree on the proper classification or reclassification of a particular class of laborers and mechanics to be used, the question, accompanied by the recommendation of the Contracting Officer, shall be referred to the Secretary of Labor for final
C.13. OTHER WORK.
Work by SLSDC personnel and other contractors may be in progress concurrently with the work under this contract.
Only the Contractor's authorized personnel, subcontractors and suppliers shall be allowed to enter the work area. The
Contractor shall fully cooperate with the SLSDC in all phases of the work and any disputes which may arise will immediately be brought to the attention of the Contracting Officer through the COR.
C.15. SITE VISITS.
The SLSDC will conduct a site visits of the proposed work areas at 10:00 AM on Wednesday, November 04, 2020.
It is recommended that those interested in submitting a proposal take advantage of this opportunity to inspect the work area and gain a better understanding of the physical configuration of the work areas. Arrangements must be made through the Office of Engineering and Maintenance at (315) 764-3240 or (315)-764-3253 to take part in a site visit. Some personal protective equipment may be required to be worn by visitors. Any expenses involved in a site visit shall be borne by the attendees.
C.16. SUBMITTALS.
The Contractor shall submit the following within 30 calendar days of award:

For the purposes of this specification, “approval” of submittals means that the SLSDC or its designee has reviewed them for completeness and for general conformance to the design concepts. “Approval” of any submittal does not relieve the Contractor from responsibility for proper workmanship, material conformance, dimensional accuracy and design adequacy for those elements not detailed on the contract drawings. The Contractor retains sole responsibility for dimensional accuracy of new fabrications and installations.
C.17. “OR EQUAL” ITEMS.
“Or equal” items referred to in this specification means that items having physical properties and performance characteristics equal to or exceeding those of the item specified will be accepted. The physical properties and performance characteristics included for each item are not intended to be a maximum or minimum, unless so specified.
Items having physical dimensions close to those specified will be accepted if those dimensions provide sufficient space to maintain the items after they are installed.
C.19. QUALITY CONTROL.
The Contractor has ultimate responsibility for the project quality control (QC), and shall submit a Quality Control Plan incorporating, as a minimum, all the following elements that are appropriate to the Contractor’s design materials and processes:
a. Perform field tests on each plant concrete delivery for slump, temperature, air content and water/cement ratio. All tests must be performed in accordance with the pertinent American
Society for Testing and Materials (ASTM) and/or American Concrete Institute (ACI) methods and criteria.
b. For cast-in-place concrete, make and test compressive strength test specimens as required to monitor strength gain for form removal and subsequent construction. A minimum of two specimens is required for each 50 cubic yards, or fraction thereof, for each cure increment (i.e.
two specimens each for 7-day, 14-day and 28-day compressive strength). All sampling and testing shall be performed in accordance with American Society for Testing and Materials
(ASTM) and/or American Concrete Institute (ACI) methods and criteria.
c. For precast concrete provide precast concrete plant quality control tests and reports equivalent to those described in “a” and b above for field-placed concrete.
d. Qualification of welding procedures and personnel.
e. Where applicable, structural steel shop and field inspection to include visual examination of all welds, and checks of proper workmanship and dimensional conformance.
f. Perform nondestructive testing (NDT) of all welding in any structural and plate steel that will be a part of the final structure. This also includes welding for temporary structures such as work platforms, lifting lugs, etc. NDT coverage shall be 100% of these welds, using the ultrasonic method for full penetration welds, magnetic particle for all fillet welds and liquid penetrant for all welds in stainless steel. All NDT must be performed in accordance with the pertinent provisions of the American Welding Society Structural Welding Code D1.1 for dynamically loaded structures.
g. Provide New York State licensed survey services to verify that new work is being installed to the proper lines and tolerances.
h. Perform load tests of anchors and dowels.
Only individuals qualified for NDT Level II or NDT III may perform NDT for this project. All personnel performing non-destructive inspection shall be certified under ASNT Recommended Practice SNT-TC-1A. Other qualifications or certifications may be accepted only at the COR's discretion. Provide reports of all QC tests, inspections and surveys to the COR.
C.23. ACCEPTANCE OF THE WORK.
After completion of all work contracted for, the COR or his designee will examine the work for final acceptance and approval by the Contracting Officer.

SECTION D
PACKAGING AND MARKING
D.1. PRESERVATION, PACKAGING, AND MARKING.
The Contractor may have supplies/materials shipped to the S LS D C Receiving Warehouse located at 251
Fregoe Road, Massena, NY 13662. Packaging must be labeled to include the Contractor’s name and contract number. The Contractor shall be responsible for any damaged or missing packages. Upon receipt, the Contractor shall examine all packages and make appropriate written exception for any goods not in apparent good order. The
Contractor is responsible for contacting the shipping company for any damages or losses. The SLSDC shall make every effort to contact the Contractor when packages arrive. The Contractor shall have large and/or heavy items (exceeding 80 lbs) delivered directly to the work site.
Warehouse hours are 7:00am to 3:00pm on weekdays (except Federal holidays).
The SLSDC reserves the right to refuse any packages that are damaged, improperly labeled, or appear suspicious.

The Contractor shall be required to (a) commence work under this contract within Ten (10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than March 08, 2021 for the first three (3) diffusers and by March 07, 2022 for the remaining three (3) diffusers. * The time stated for completion shall include final cleanup of the premises.
F.1. PERFORMANCE REQUIREMENTS.
It is critical that the Contractor conform to the schedules for completion of each season’s activities as outlined above because if the work is not completed and the lock turned over to the SLSDC in accordance with the schedule, the opening of the international St. Lawrence Seaway would be delayed which is not acceptable.
F.2. SCHEDULES FOR CONSTRUCTION CONTRACTS.
The Contractor shall prepare and submit to the Contracting Officer after award and prior to a preconstruction meeting, for approval, a copy of a practicable schedule showing the order in which the Contractor proposes to perform the work and the dates on which the Contractor contemplates starting and completing the salient features of the work (including acquiring materials, plant and equipment). The schedule shall be in the form of a progress chart of suitable scale to indicate appropriately the percentage of work scheduled for completion by any given date during the period. If the Contractor fails to submit a schedule as required, the Contracting Officer may withhold approval of progress payments until the Contractor submits the required schedule.
