SLS Eisenhower Lock Concrete Diffusers Questions and Answers

6923G521R0002A00005

1. Is there a requirement for errors and omissions/Professional liability for the designer?

Response: The Contractor shall be responsible for the professional quality and technical accuracy of the services furnished by the Contractor under this contract. The Contractor shall, without additional compensation, correct or revise any errors or deficiencies in the required services. The Contractor shall be liable to the Government in accordance with applicable law for all damages to the Government caused by the Contractor’s negligent performance of any of the services performed under this contract. This includes liability for professional services and any errors or omissions related to the completion of such services.

2. In past contracts with the lock there have been significant liquidated damages specified as part of the contract. Can you provide details on what the liquidated damages will be if the seaway is not opened by the specified date?

Response: It is critical that the Contractor conform to the schedules for completion of each season’s activities as outlined in the RFP. If the work is not completed and the lock turned over to the SLSDC in accordance with the schedule, the opening of the international St. Lawrence Seaway would be delayed which is not acceptable.

For this reason, the SLSDC will assess disincentives according to the following:

a) If the Contractor does not complete all work and has not removed all equipment and materials from the lock and placed it in locations away from the lock wall as designated by the COR by 11:59 PM on March 8, 2021 (March 7, 2022), as determined by the COR, the Contractor shall be assessed a disincentive in the amount of $25,000.00 for the first day he/she is late, an additional $50,000.00 for each day he/she is late through March 15, 2021 (March 14, 2022) and $100,000.00 per day thereafter. The dates in parentheses apply to the second season of the two-season schedule if awarded.

b) The total disincentives assessed for non-conformance with the schedule will not exceed $1,000,000.

3. There are multiple hatches alongside the work areas that we clearly understand need to be protected. Can you identify which hatches can be covered for the duration of the work and which hatches we need to maintain access to during our work?

Response: The SLSDC does not plan to access any of the hatches or covers on the lower lock walls adjacent to the diffuser area hatches and covers after the lock is initially dewatered. SLSDC personnel may need to occasionally access the emergency generator on the north side. SLSDC personnel will also need to access the dewatering pit on the north side via the structure over the dewatering pit’s entrance. The SLSDC does run an air line out of the dewatering pit which exits the shelter structure and runs along the ground towards the north slot for the downstream stoplogs to feed bubblers on the bottom stoplog. The Contractor shall not damage or obstruct this air line.
