About this file

This is a Payment Bond Form template issued by the Board of Public Education for the City of Savannah and the County of Chatham (SCCPSS) for the Data Cabling for Hubert Middle School project. The payment bond is required for any bidder whose proposal exceeds $100,000 and who is selected as the successful contractor. The bond must be executed as a condition precedent to contract execution and must equal the total contract amount as approved by the School District. If the contract amount is subsequently increased by mutual agreement, the School District may require the contractor to increase the bond amount accordingly. The bond must be furnished on standard insurance industry forms substantially similar to the sample template provided and must be underwritten by a surety authorized to conduct business in Georgia under a current certificate of authority from the Georgia Commissioner of Insurance or listed on the United States Department of Treasury's approved bond sureties list. The District reserves discretion to assess the sufficiency of both the bond form and surety.

The payment bond protects claimants—defined as subcontractors and persons supplying labor, materials, machinery, or equipment—who have not been paid in full within ninety days of completing work or delivering materials. Claimants may sue on the bond for unpaid amounts, provided they have given written notice to the contractor within ninety days of final work performance or material delivery and, if a Notice of Commencement was filed, have submitted a written Notice to Contractor within thirty days of filing or first delivery, whichever is later. Actions on the bond must be brought within one year from the date of the Final Certificate of the Design Professional. The surety waives notice of any contract changes, time extensions, alterations, or additions and agrees to increases in the penal amount of the bond. The bond must include the name and address of the authorized Georgia-licensed agent authorized to conduct business concerning the bond.
