About this file
Summary
This is a Certification of Noninvolvement in Prohibited Activities in Russia or Belarus form required by New Jersey State law (N.J.S.A. 52:32-60.1, et seq., L. 2022, c. 3) for vendors seeking to enter into or renew contracts with state agencies. The form applies to the County of Bergen's Commercial Grounds Equipment Cooperative Purchasing contract, a twenty-four-month procurement commencing May 7, 2026 through May 6, 2028 with multiple catalog vendors for the provision of commercial grounds maintenance equipment and accessories, including gas, electric, and battery-powered lawn, turf, agriculture, compact construction, and outdoor power equipment for the Department of Parks and Recreation and registered New Jersey Cooperative Purchasing Alliance members.
All prospective vendors must certify their status relative to the Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons list concerning activity related to Russia and Belarus. Vendors must select one of three certification options: confirming non-identification on the OFAC list for Russia/Belarus-related activity; declaring inability to certify non-identification due to listing; or providing detailed explanation if listed but engaged in activity consistent with federal law, regulation, license, or exemption. The definition of "Vendor" encompasses natural persons, corporations, partnerships, and other governmental and nongovernmental entities, including parent companies, subsidiaries, and entities under common ownership or control. Failure to provide truthful certification may result in sanctions, default declaration, debarment, suspension, or recovery of damages by the New Jersey Department of the Treasury.
