61. Multiple other VISN’s including VISN 17 and VISN 1 have issued construction (NAICS 236220) MATOCs with project size ranges, allowing smaller companies and the more established SDVOSB firms to compete at a project size that works well for them. Is the Government able to increase the efficiency of this MATOC by subdividing the task orders into at least three project size categories/brackets? Our experience has shown that it is useful for the brackets to follow general size ranges used by the government. Examples include task orders under $2 million, task orders between $2 million and $10 million and task orders over $10 million.
No, the terms and conditions of this MATOC will not be revised at this time.
62. If two separate Joint Ventures apply for this MATOC and one of the partner firms is a minority owner in one joint venture and a majority owner in the other joint venture, would the VA review the proposals separately and award based on the merit of each entity?
Yes. Each proposal will be evaluated separately.
63. Will the contractor be considered delinquent and receive a lower CPARS rating (less than satisfactory) if the choose to not bid all of the task?
The government is awarding this MATOC with the expectation that the successful SDVOSB contractors will proactively pursue ALL construction project opportunities and provide competitive bids; however, bidding is not required for all projects.
64. The solicitation calls for a list of MATOC contracts and resultant Task Orders from the contractor. If the entity is a joint venture, will the experience of each member be considered or only the experience of the Joint Venture?
Both. The experience of the joint venture and the experience of all parties associated with the joint venture will be evaluated.
65. Will the government consider a project that is more than 50% complete by the contractor as Recent and Relevant for Factors 1 and 3?
No, the factors require completed projects.
66. Are the personnel resumes requested in the solicitation meant to be specific to the seed project task order or will these individuals be required to work on all task orders?
No, the resumes are not seed project specific. The intent of the resumes are to identify the construction capabilities of the provided personnel and how they will be best utilized to obtain successful MATOC Task Order completion. The personnel provided during the initial receipt of proposals for the seed project do not necessarily need to work on future task orders; they may be substituted with personnel that meet or exceed the capabilities with the approval of the CO.
67. The key staff personnel seem to be directed toward the seed project. Is there a preference by the VA to show leadership positions of the contractor in the organizational chart? If so, are there requirements for those positions?
The resumes are not specific to the seed project. If an offer feels additional leadership information will better compliment their proposal, they are encouraged to submit it accordingly.
68. Is the total value of the MATOC for the entire 5 years only $40 million for all contract awardees or is each contract awardee under the MATOC limited to $40 million total for the life of the contract?
Contract ceiling is $40M per contract. Individual task order ceilings are $16M.
69. Most solicitations exclude past performance documentation from page counts. Does the 30 page limit for factor 3 include Exhibit A, exhibit B, and other demonstrations of past performance such as a CPARS report.
Exhibit A will count towards the page limitations associated with Factor 3. It is required that the PPQs (Exhibit B) are directly submitted to the contracting officer by an end user or prior client. As such, no PPQs are to be submitted with an offerors proposal. As a result, PPQs will not be included into the page limitations. CPARS will count towards the page limitations associated with Factor 3.
70. Can the capacity of the MATOC increase in the future?
No, we don’t foresee circumstance that will require the capacity to increase.
71. Exhibit B requires that the contractor’s client send the completed document to the government directly and not include it in the proposal from the contractor. The proposal table shows that Exhibit B’s do have a place in the proposal. Should the contractor provide Exhibit B in the proposal and have the client send the completed Exhibit B to the government?
Although there is reference to Exhibit B to be submitted with Volume III, It is required that the PPQs (Exhibit B) are directly submitted to the contracting officer by an end user or prior client. As such, no PPQs are to be submitted with an offerors proposal. As a result, PPQs received directly from end user or prior client will not be included into the page limitations. PPQs received directly from an offeror as part of their proposal will count toward the page limitations.
72. For the Seed Project, can the site superintendent be the “Competent Person” (SSHO) for safety if they have 30 hr. OSHA training?
Yes, for the seed project.
73. Can the Site Superintendent be the Quality Control person for the Seed Project?
Yes, for the seed project.
74. The solicitation is asking for resume information for the quality control personnel. Is the government looking for information about individuals that will be working on this specific seed project task order?
No, the resumes are not seed project specific. The intent of the resumes are to identify the construction capabilities of the provided personnel and how they will be best utilized to obtain successful MATOC Task Order completion. The personnel provided during the initial receipt of proposals for the seed project do not necessarily need to work on future task orders; they may be substituted with personnel that meet or exceed the capabilities with the approval of the CO.
75. Where will the designated parking area be for workers accessing the construction site?
Parking is available in nearby Parking Garage Bldg 28. The COR will attempt to block off a designated park spot near Bldg 17 for the site superintendent if space is available.
76. Will the Owner accept the use of the industry leading Procore Project Management software as the primary submittal and data tracking tool for this project?
Yes, the VA is willing to use Procore or similar type software under this MATOC. Software and submission process will need to be approved by COR and Contracting.
77. How soon after award is NTP expected to be issued? This project includes a long lead item (Generator) that will need to be submitted and approved which could take several weeks before the order is placed. Electrical equipment lead times can be as long as 10 months.
The issuing of the Notice to Proceed (NTP) will be discussed at the pre-construction conference. Ideally, we would like to issue the NTP within 30 days but if certain material has a long lead time then we can discuss the option of an administrative NTP to allow for the ordering of materials with long lead times with the expectation a “work/boots on ground/performance” NTP to be issued after the equipment/material arrives.
78. Does the Government have a fire alarm servicer that they currently work with? What is the name and contact information of the person or persons that will need to be coordinated with for security and fire alarm and suppression systems work and/or disruptions?
ADT is our fire alarm servicer.

Curtis Ladner Enterprise Service Manager curtisladner@adt.com C: 228-209-1634 O: 504.821.9725

79. Due to current potentially significant tariffs being placed on the importation of building materials such as wood or steel by the current Presidential Executive Branch, if a tariff is placed after bid time and before award will the government consider a price escalation on a contract value for products such as steel or wood should the executive branch levee tariffs effecting such materials? Most of these materials would still have been Buy American compliant as the tariffs would increase pricing on all steel or wood materials, regardless of origin.
No; however, in the event there is an executive directive mandating an economic price adjustment, we will consider a possible price escalation on a case-by-case basis.
80. As a result of the effect of COVID-19 throughout the U.S., and the resulting Federal, State and local governments’ responses / requirements of safe distancing and potential advocations of working remotely and/or complete organization closures, please advise how the Government intends to address delays resulting there as it pertains to the current solicitation schedule for this and all future projects.
Contracting will work with contractors on a case-by-case basis due to the unknown impacts associated with COVID 19.
81. Will pay applications for materials secured on site or in a bonded warehouse be approved for payment?
The Government prefers to pay for installed materials/equipment but will consider paying for stored materials on a case-by-case basis.
82. Due to the current economic inflation, Will the government reduce the amount of time that contractors must hold their numbers to 60 days? By reducing the inflation risk, the government will avoid escalations costs that general contractors and subcontractors must account for.
No, the Government is not in a position to reduce the 120-calendar day timeframe.

83. Will the government consider the inclusion of an Economic Price Adjustment Clause in accordance with Federal Acquisition Regulations (FAR), Subpart 16.203 "Fixed-price contracts with economic price adjustment" and the related contract clause language in FAR 52.216-2, 3, 4? We believe such a clause is appropriate for the followings reasons:

· The contract involves an extended period of performance with significant costs to be incurred beyond 1 year after contract award begins due to long lead materials;

· The contract amount subject to significant fluctuations in price is substantial; for example: electrical wiring has had significant price fluctuation and the wiring on this project may not begin for up to 6 months while the generator is procured, and

· The economic variables for labor and materials are too unstable to permit a reasonable division of risk between the Government and the contractor, without this type of clause.

No, the Economic Price Adjustment Clause will not be included; however, in the event there is an executive directive mandating an economic price adjustment, we will consider a possible price escalation on a case-by-case basis.

84. The scope of work states that the contractor is responsible for moving any equipment furniture and supplies and then shall re install it post completion. Can a detailed list of whats currently in the building be provided for pricing?
For the seed project, there is no detailed list of existing equipment to be moved/re-installed. As demonstrated at the respective site visit, the amount of equipment to be moved is minimal.
85. Performing the electrical scope as detailed has impacts to existing finishes within the building. Can more detail be provided of existing conditions; specifically, sheets with section cuts through the building to show ceiling heights, a current reflected ceiling plan, and a current finish schedule?
As-built drawings are minimal outside of original drawings and the updated floor plan which were included in the solicitation and or amendment.
86. The duration of the project is listed as 120 days. This is not enough time to perform the directed scope of this project. Can duration be extended to 270 days?
For proposal preparation and submission, the contractors proposal should include a site-specific schedule outlining work to be completed within the stated 120-day performance period.
87. The solicitation document titled Seed ICRA designated a Class 3 requirement. Please confirm that this standard will be applied to the bldg 17 renovation. It does not appear that this reno is of a clinical space. Please advise.
The ICRA provided in this solicitation is for “Contracting/Pricing Purposes Only” and reflects the highest possible classification for this project as a general guide. The official ICRA permit will be issued after award and will be project specific. The ICRA is developed based on the contractor’s feedback, type of work activities being performed, and areas where work is performed. The project will most likely have several ICRA’s issued (Class 1, Class 2 and potentially Class 3). Contractor is only required to adhere to the ICRA classification they are issued, and the classification can be lowered/downgraded as construction activities become less evasive and generate less dust. Proposal should price accordingly.
88. The base solicitation has a specification 220511 common work for plumbing. Please confirm if there is plumbing work on this project? None is shown on the project plans.
The natural gas piping includes elements of plumbing as does the new back flow preventer in the basement.
89. Sheet AR 1 appears to be the only new plan sheet released for this project. This page has the modern layout for the first floor. Can the current layout of the existing second floor be released via addendum? Please advise.
Yes. See attached Bldg 17 Floor Plan published with Amendment 0004 and is labeled as 36C25622R0030 B17 Floor Plan.
90. Is there an electrical sheet that can be released via addendum that matches the current layout? The "historic" electrical sheet still shows a billiard room and a library on the first floor. Please advise.
Unfortunately, there is not an updated electrical plan reflecting the current layout. Most of the wiring is original to the building with the exception of the office areas on each wing of building.
91. Is this project sales tax exempt? If the project is sales tax exempt can the government provide a sales tax exemption certificate?
This project is not tax exempt and is subject to the 3.5% Mississippi Contractors Tax.
92. It appears that the only difference in the dwgs released in the original solicitation and the docs re issued via addendum 1 is the deletion of the scope item of replacing all exterior windows. Is this accurate? Please confirm.
This is correct. Window replacement is not part of this project.
93. Sheet AR 1 note 10 notes to relocate an existing mini split ac system. Can a specification be provided for this item? Or at least a product description? Please advise.

112. In accordance with 13 C.F.R. § 125.8(e), please confirm that the government will accept the experience from either member of an SBA approved Joint Venture to meet the requirements of the solicitation?
Yes, the government will accept experience from either member of a joint venture and the joint venture itself.

113. It is becoming increasingly difficult to obtain Past Performance Questionnaires from Contracting Officers on a project-by-project basis, especially when they have already filled out a CPARS evaluation for us. In light of this, will the VA accept completed CPARS evaluation forms in lieu of the provided PPQ?

42.1501 General.

(b) Agencies shall monitor their compliance with the past performance evaluation requirements (see 42.1502), and use the Contractor Performance Assessment Reporting System (CPARS) metric tools to measure the quality and timely reporting of past performance information. CPARS is the official source for past performance information.

114. Can CPARS be submitted in lieu of PPQs?
Although there is reference to Exhibit B to be submitted with Volume III, It is required that the PPQs (Exhibit B) are directly submitted to the contracting officer by an end user or prior client. As such, no PPQs are to be submitted with an offerors proposal. As a result, PPQs received directly from end user or prior client will not be included into the page limitations.
