About this file

This is a Performance Bond template for Public Works Contracts over $100,000 issued by Harris County, Texas, required pursuant to Texas Government Code 2253.001, et seq. The bond applies to the Drainage Improvements in the Bear Creek Village Subdivision – Stage B (2018) project for Harris County Precinct 4, funded through FEMA. The document establishes the bonding requirement for the principal contractor and the surety company obligated to Harris County, securing performance and compliance with all contract provisions.

The bond specifies that the principal and surety are jointly and severally liable to Harris County for the full contract amount. Should the principal fail to comply with contract provisions or default on performance, the surety has five business days following written notice from the County to assume control of the contract and complete the work in accordance with contract specifications, or forfeit all rights to do so. The bond is conditioned on full compliance with all terms and provisions of the underlying contract, and the surety remains obligated regardless of whether the County provides notice of any default, neglect, or omission by the principal. The bond must be executed and approved by the Harris County Commissioners Court prior to contract execution.
