ANNUAL ASBESTOS SURVEILLANCE REPORT

COMPLETED FOR THE

GENERAL SERVICES ADMINISTRATION – SAFETY/FIRE

PROTECTION/ENVIRONMENTAL BRANCH

A Federal Occupational Health (FOH) Contractor Representative Lisa Swain, MPH, CSP, performed a limited walk-through Annual Asbestos Visual Surveillance Check as required by the General Services Administration (GSA) for their owned facilities. Bulk or air samples were not collected. Compliance with GSA contract safety and health requirements, listed on the attached checklist, was determined for Operations and Maintenance (O&M) and Custodial contractors. As indicated by GSA instructions, only spaces listed on Table A were visually checked. During the surveillance check, observations of any potential damage to the asbestos-containing materials (ACM) was noted and recorded. If any imminently dangerous conditions had been observed they would have been immediately reported to the FOH Representative, GSA Customer Service Center Manager, and GSA Safety and Environmental Management Branch Representative in accordance with GSA established procedure.

The GSA Form 3614, GSA Notice of Unsafe/Unhealthful Workplace Conditions, was completed for any potential deficiencies and provided to the GSA Building Manager.

One GSA Form 3614 may list multiple violations. An opportunity to correct violations, if any, would be given to the GSA employee or representative during the inspection.

Those violations corrected are noted in the text of the report.

The FOH Contractor Representative used the GSA ACM Checklist for fiscal year 2019, which was approved by GSA for consistency purposes and to ensure the required information was obtained at this facility. The checklist and 3614 forms, if any, are attached to this report as supporting documentation.

This report is based on personal observations during the surveillance check and from conversations with on-site personnel. Not all possible hazards and conditions may have been identified during this brief inspection, because not all spaces were inspected (per GSA), conditions may be hidden or inaccessible and changes in equipment, regulations, operations and personnel may not be known at the time of the inspection.

The report contains the following GSA required sections: Building Descriptions, General Findings, Comments and Concerns, Action Items, 3614s, Form 3559, Corrected Items and Other.

Note: The FOH Contractor Representative designated in this project is an employee of H,S&E Resources, Inc. which has performed the services indicated in this report.

Nothing in this report is intended nor should be interpreted as establishing any form of employment or contractor relationship between the FOH Contractor Representative and General Services Administration, Federal Occupational Health, U. S. Public Health Service, or any division, agency, or contractor thereof.

Reports and other publications issued by the Environmental Health Services program of the Federal Occupational Health (FOH) were prepared under procedures established by FOH, which were designed to assure the technical competency of the persons or organizations under contract to FOH. In addition, reports and other publications were reviewed internally by one or more FOH technical staff, and all comments were addressed to the satisfaction of the issuing office, prior to dissemination.

I. BUILDING DESCRIPTION

The Golden Collum FB-CT (FL0057ZZ) is a four-story facility constructed in 1961. It has a gross area of 68,822 square feet. Three floors are above ground and one below. There is a mezzanine between the first and second floors.

The exterior surface of the building is composed of form stone. The floors are constructed with concrete beams and solid slabs. The general construction type of the building is a skeleton steel frame with reinforced concrete. The interior of the building is predominately plaster, wallboard, cement block and slab. The roof is composition built up.

The prominent features of this building are an automatic elevator that services all floors, an outdoor parking area located on the north side of the facility and offices throughout the building. There are two stairways located in the central East Side of the building, adjacent to the elevator and in the northwest portion of the building.

Mechanical systems of this facility include a boiler room and air conditioning equipment room in the basement, two mechanical equipment rooms on the mezzanine level, a mechanical equipment room, cooling tower and elevator machine room on the roof of the structure. The facility has 7 AHU’s. Four new AHU’s and an outside air unit were located in the mezzanine. These units handle the 1st and 2nd floors.

The facility has been renovated and ACM has been removed. The full scope of renovations and abatement is unknown. Construction/renovation occurred during the FY2011 survey on the 2nd floor of the US Marshals space.

New AHU’s were installed in FY2016-2017 in the Penthouse (2 units) and one unit each on the 3rd floor and basement. This installation reportedly abated all ACM in the Penthouse. Further, ACM black mastic had been removed from Rooms 235-239, and small sections of white duct mastic was removed in the basement hall near the maintenance office and basement restroom.

Sections of various ACM had been abated on the 3rd floor in 2017. Reportedly, VAT will remain under carpeting. Construction was ongoing during the survey, however this “abate only where necessary” locations on the 3rd floor will make it difficult to determine abatement locations as well as where ACM remains in future surveys.

Abatement of window glazing was conducted in the chiller room when a window was removed.

A new roof was installed in 2019.

Due to the extensive renovations and abatement projects the FOH Representative recommends a new ACM survey.

II. GENERAL FINDINGS

An Annual Visual ACM Surveillance Check of the Golden Collum Federal Building/Courthouse was conducted by a Contractor Representative of the Federal Occupational Health (FOH), Lisa Swain, MPH, CSP. The Annual Visual Surveillance check was conducted on October 10, 2019. Mr. Richard Hearne, the GSA Building Manager and the O&M representative accompanied the inspector during this surveillance check.

The overall building Risk Assessment Code (RAC) is 3. Significant deficient findings (RAC 1 or 2) were not identified during this surveillance. Seventeen (17) citations were issued during this visual surveillance of which all seventeen (17) are repeat deficiencies. Corrective measures were not taken during this surveillance.

Damaged ACM was observed in the following locations:

Minor cracks observed on ACM TSI in Rooms B-01, B-04, B-14, B-01, B- 11, B-06, basement men's restroom, and B-15. Suspect mold on TSI in Rooms B-14 & B-15. Piping associated with tank in B-06 has minor damage.

Most ACM floor tile throughout the building is dull and scuffed. Floor tile in the 3rd floor custodial closet is in poor condition.

Otherwise, the remaining ACM observed during this building re-surveillance survey was in good condition.

This is a contractor-operated facility. Katmai is the O&M and custodial contractor.

Inaccessible spaces – The following spaces were not accessible during the visual surveillance: 3rd Floor USMS space and 3rd floor communication closet and chase closet 321. As previously noted, tenant spaces were not intentionally inspected.

New suspect ACM was not identified during this inspection. Suspect materials must be treated as asbestos until sampled and analyzed. Suspect materials are noted in in blue font in the attached table.

The Annual Visual ACM Surveillance Spreadsheet, Table A, was taken from the previous annual visual surveillance report and used to prepare for this surveillance check.

Any additional information obtained by the FOH Contractor Representative during this surveillance check was added to the table. The FOH Contractor Representative did not conduct any asbestos sampling or measure ACM quantities other than noting if ACM was removed since the last surveillance. The FOH Contractor Representative may note suspect materials that were not previously identified or tested and listed them in the spreadsheet (Table A) as suspect with recommendations for testing. Findings are located in the attached table.

Three attachments are associated with this report: 1) An annual surveillance table, 2) Checklist and Form 3614 and 3) Form 3559.

III. COMMENTS AND CONCERNS

Following is a list of comments and concerns in conducting the annual visual surveillance inspections:

Due to various construction projects from 2011 to present, the exact locations of ACM is unknown. As a result, Table A may not fully represent the locations and condition of remaining ACM. Further, most room numbers have changed and abatement documents are not on site for review. As noted above, the FOH Representative recommends a new asbestos survey for the building.

Minor/Moderate cracks observed on ACM TSI in Rooms B-01, B-04, B-14, B- 01, B-11, B-06, basement men's restroom, and B-15. Suspect mold on TSI in Rooms B-14 & B-15. Piping associated with tank in B-06 has minor damage.

Most ACM floor tile throughout the building is dull and scuffed. Floor tile in the 3rd floor custodial closet is in poor condition.

Labels missing on ACM pipe elbows, white duct mastic and black duct mastic above ceiling tiles. The ACM could potentially be disturbed during work operations above the suspended ceiling.

The O&M contract has the following nine asbestos O&M contract requirements:

1) at least one O&M asbestos trained worker/supervisory person onsite; 2) annual fit tests; 3) annual medical exams; 4) the EPA asbestos O&M document;

5) The NIBS O&M book (either available onsite or access to); 6) Asbestos repair equipment onsite; 7) written respirator program; 8) written medical surveillance plan; 9) written protective equipment plan. The O&M contractor had not met these requirements, with the exception of providing the 16-hour training.

However, the refresher training has not been provided in the past two years. As a result, the 16-hour training may no longer be valid.

The annual notification letter regarding current location, status and condition of asbestos within the building had not been provided by GSA to the tenants and contractors.

The Custodial contractor had not provided the required annual asbestos refresher training.

A contractor notification and sign-in sheet regarding the presence of ACM within the building was not present and implemented by the O&M contractor.

The GSA building manager had participated in the GSA online asbestos awareness training.

ACM records onsite were incomplete.

Not all the TSI could be inspected because it was in pipe chases, under carpeting or above ceilings.

IV. ACTION ITEMS

Due to the various construction projects, the FOH Representative strongly recommends an AHERA survey to identify the remaining types and locations of the ACM in the building.

Abate/repair damaged ACM insulation noted above in accordance with State and Federal guidelines.

Maintain wax coating on all ACM floor tile. Low speed buffers/scrubbers and non-abrasive pads must be utilized on ACM floor tile.

Label ACM to alert contractors working in this space of the presence and location. Maintain labels and signs on all accessible TSI.

Ensure sampling, abatement and disposal documents for renovation projects are on site and available for review.

Maintain asbestos containing building materials in good condition.

Ensure only trained and properly equipped personnel perform maintenance on ACM.

Ensure GSA Building Managers participate in the GSA online asbestos awareness training.

Require O&M and Custodial contractors to meet all requirements of the asbestos O&M portion of contract and annually document all training.

Distribute the annual notification letter concerning location and condition of ACM to building occupants and contractors.

GSA should ensure that the custodial staff possesses the requisite training and that they are aware of the following: 1) ACM is present in the building, 2) Annual asbestos refresher awareness training is required and must be documented each year, 3) Cleanup of any suspect ACM material is prohibited and 4) The use of HEPA vacuums for routine cleaning is contract-required.

Ensure contractors sign and date a form regarding notification of the presence of ACM before allowing any contractor to commence work within the building. This document demonstrates communication between the contractor and GSA regarding ACM and procedures for working around ACM.

GSA should ensure that agencies hiring contractors also provide notification.

Any changes to the quantity and condition (including repairs and removal) of ACM in the facility should be incorporated into GSA’s Operations and Maintenance (O&M) plan. Abatement documents must be maintained on-site. Maintain a copy of all inspection reports to clearly show the current status of ACM at this facility.

The facility should review the attached updated spreadsheet (Table A) ACM Surveillance Table for accuracy and use it to record all changes in ACM amount, location, condition, etc. This summary table will be requested during all future inspections and be audited.

Sample and analyze suspect ACM and new floor tiles and mastic before performing any renovation or demolition or obtain documentation from the manufacturer stating that their product contained no asbestos. Maintain records in the asbestos file to be used for future inspections and surveillances. GSA should request that all records regarding renovations be forwarded on a timely basis.

Test all previously identified suspect mastic-containing materials by TEM prior renovating any areas.

Any new or future renovation or remodeling must have a letter from the architect and/or contractor stating no ACM building products were reinstalled.

Otherwise all building materials must be considered Suspect ACM and be tested for asbestos before being disturbed. GSA must perform a pre-renovation check as per the GSA asbestos policy.

Suspect ACM must be treated as ACM until sampling and analysis is completed.

Asbestos Free stickers should be placed on all reinsulated items that once housed asbestos to visually show that ACM is no longer present.

Carpet may have been installed over VAT in several spaces. If carpet is adhering (glued) to floor tiles, carpet removal must be considered an abatement project.

Sample and analyze suspect ACM PRIOR performing any renovation or demolition. Maintain records in the asbestos file to be used for future inspection and surveillances.

IV. 3614’s

1. Repeat - Minor cracks observed on ACM TSI in Rooms B-01, B-04, B-14, B- 01, B-11, B-06, basement men's restroom, and B-15. Suspect mold on TSI in Rooms B-14 & B-15. Piping associated with tank in B-06 has minor damage.

Abate damaged TSI or repair immediately. Maintain in good condition. The O&M contract limits repairs to 3 linear/square feet. Cumulatively, the FOH Representative estimates that the damage exceeds 3 SQ/LF and abatement/repairs should be contracted to asbestos abatement contractor.

2. The O&M contractor did not have all necessary asbestos equipment and supplies on site to conduct an O&M repair/removal action. Require contractor to maintain the necessary equipment and supplies to conduct asbestos repair/removal projects less than 3 square or linear feet.

3. Most ACM floor tile throughout the building is dull and scuffed. Floor tile in the

3rd floor custodial closet is in poor condition. Abate floor tile in custodial closet. Maintain wax seal on ACM floor tile.

4. The O&M contractor did not have documentation of refresher Asbestos

Awareness maintenance training. Provide annual Asbestos Awareness Training to O&M employees annually. Submit a copy of the training records to GSA annually.

5. The O&M contractor did not have evidence that employees have been enrolled in a medical evaluation program to determine their ability to wear a respirator. Enroll employees in a medical evaluation program and document ability to wear a respirator. Maintain a copy on site. Provide a medical clearance letter annually to GSA.

6. The O&M contractor did not have a record of Respiratory Protection training.

Train employees on respiratory protection as required by OSHA and submit a copy of the training records to GSA. Maintain a copy on site.

7. Repeat - Labels missing on ACM pipe elbows, white duct mastic and black duct mastic above ceiling tiles. The ACM could potentially be disturbed during work operations above the suspended ceiling. Label all ACM where work may be performed.

8. The O&M contractor did not have an annual respirator fit-test. Provide annual respirator fit-test. Maintain document on site.

9. Custodial contractor did not have documentation of annual refresher Asbestos

Awareness Training. Provide custodial contractor with Annual Asbestos Awareness Refresher Training.

10. Tenants, O&M and custodial contractors were not notified annually of presence, location and condition of asbestos within their building. Notify tenants, O&M and custodial contractors, other contractors in writing annually of presence, location and condition of ACM.

11. Documentation was not available notifying contractors of presence of ACM within this facility. Notify contractors of presence of ACM within their work area as per facilities Asbestos O&M program. Have contractors sign and date the document. Maintain records.

12. The O&M contractor did not have the NIBS O&M asbestos manual on site to follow in event of an asbestos incident. Require contractor to maintain a copy of this reference manual or have access to it via their company.

13. The O&M contractor did not have evidence of a written Respiratory Protection

Program. Develop, implement and update annually a written Respiratory Protection Program and submit a copy to GSA.

14. The O&M contractor did not have evidence of a written medical surveillance program. Develop, implement an annually review the written medical surveillance program. Maintain a copy on site.

15. Repeat - ACM records were not maintained in the building as required by law. Update and maintain a copy of all ACM records. This enables the building mechanic to make other contractors aware of ACM locations before they commence work. Maintain all asbestos repairs, abatement, sampling and inspection documents on site for review.

16. Abatement documents were not available for review including air monitoring and disposal records. Include all abatement/repair documents and job notes in ACM master file.

17. The O&M contractor did not have the EPA O&M asbestos guide, “Green

Book” onsite as a guide to follow in event of an asbestos incident. Require contractor to maintain a copy of this reference manual.

V. OTHER

Each facility upon receiving this updated ACM Surveillance Table A should review it for accuracy and use it to record all changes in ACM amount, location, condition, etc. This table will be requested during all future inspections and audited.

When conducting the next annual visual surveillance, please provide the GSA inspector a copy of this report so that they may verify location and condition.

Request the GSA inspector to note any additional suspect ACM. When using the previous Contract Inspector, request them to use this report and to verify discrepancies between the reports. Require all contractors to modify their surveillance report to include the attached table. All changes to condition, location, etc., should be made on this standardized spreadsheet.

The Surveillance Table is to be updated continuously. The table contains three color-highlighted areas that indicate changes in the amount, location or condition of ACM. Red indicates changes in the amount or condition of ACM. Blue denotes “suspect asbestos,” as noted by the inspector, that should be sampled and analyzed before any renovation or demolition occurs. Green indicates that suspect asbestos was determined not to be ACM or that ACM was removed.

Column 3 indicates the remaining ACM as of the last annual visual ACM surveillance inspection. In the “Condition” column, good implies no or very minor damage (i.e., less than 1 percent), fair implies between 1 and 10 percent overall damage and poor means damage greater than 10 percent overall or 25 percent localized.
