Description of Modification Continuation Page

... which apply to GSA-owned and managed federal buildings and courthouses have necessarily included specific references to, and language in compliance with, Executive Order 13706. How is the government going to ensure all contractors are in compliance with Executive Order 13706 in their proposal pricing in order to ensure the Government is setting a fair landscape for competition? Will the Government assert and confirm that it is the Union's intent that the recently signed MOU for 56 hours (7 days) per year for "Personal Time Off" constitutes the Executive Order 13706 Paid Sick Leave and that the employees will not expect Paid Sick Leave to be in addition to the Personal Time Off stipulated in the MOU? Please note that this is a Material Circumstance with a significant effect upon the pricing proposal. In the absence of clarification, we will be forced to propose a price that includes an additional 7 days of compensation for each employee which could have a detrimental effect to our fair opportunity to receive an award if in the evaluation in a Lowest Price Technically Acceptable acquisition not all vendors propose at least the same minimum requirements for compensation due to obscurity surrounding the Paid Sick Leave versus the "Personal Time Off".

Answer 1: It is the Government's understanding that the CBAs (and associated MOU) meet the requirements of Executive Order 13706 regarding sick leave/paid time off.

Question 2: The Wage Determinations dated 11/02/2020 include a CBA signed on 8/28/2020. The Wage Determination dated 10/19/2020 includes a CBA signed on 10/2/2020. The two CBAs include different rates yet cover the same buildings which creates a pricing impossibility for vendors other than the incumbent. The incumbent contractor has an unfair advantage in that they know which rates to use in their pricing. Would the government please re-issue corrected Wage Determinations so that all vendors can fairly propose a price for the services requested?

Answer 2: The CBAs included with the RFP package are correct. Although there are multiple CBAs covering one building, each CBA covers different types of employees. See the table in section B.4 of the PWS for additional details.

Question 3: RFP Section C.6.1 Maintenance Standard notes Infrared Surveys shall be conducted every three years (commencing in the base year and again in option period three, six, and nine) to include all switchgear, Motor Control Centers, disconnects, distribution panels, transformers and bus duct and all other critical asset as stipulated by NFPA 70B. A copy of the infrared survey report shall be submitted electronically to the CO or his/her designee with findings and recommendations. Switch gear testing shall be conducted during the same time frame as the infrared testing and shall meet the requirements of NFPA 70B. Periodic circuit breaker testing shall be accomplished for brakers 400 amperes and above. Lower amperes breakers shall be tested as deemed necessary by the contractor, but at no additional cost to the government. GSA wants the Switch Gear Maintenance performed on the same schedule as the Infrared Maintenance, per C.6.1?

Answer 3: Confirmed, as stated in the referenced section, switchgear testing is to be completed on the same schedule as the infrared survey.

All other terms and conditions of the solicitation remain the same. A signed copy of this and all solicitation amendments must be submitted with your proposal package.
