About this file

This document is Amendment 0005 to GSA Solicitation 47PB5126R0003 for Design Build Services for the Bridge of the Americas (BOTA) Land Port of Entry (LPOE) Modernization Project in El Paso, Texas. The amendment, effective September 17, 2026, consists primarily of a Questions and Answers chart addressing 35 clarifications submitted by prospective offerors regarding project scope, responsibilities, and design requirements. Key responses confirm that the Design-Builder will manage parking logistics with a minimum of 350 parking spaces during construction; the existing Low Energy Portals (LEPs) will remain in place with possible relocation by CBP's contractor; furniture, fixtures, and equipment (FF&E) under CLIN 0015 will be provided by the Design-Builder with a detailed list to be issued in the next amendment; and standby power is required for the Trusted Traveler building, FAMU/UAC, and Kennel building. The amendment clarifies scope delineation for shell versus tenant improvement work, confirms the Design-Builder's responsibility for rough-in infrastructure only for the License Plate Reader system with CBP responsible for installation, and establishes that GSA retains hazardous waste generator status for pre-existing materials.

Additional clarifications address technical requirements including Risk Category designations (mixed-risk approach required based on building function), removal and temporary storage of LPRs and RPMs by the Design-Builder with responsibility for shipping to designated vendors, fiber connection responsibility split between GSA and the Design-Builder, and confirmation that recent hydrant flow tests will be provided. The proposal due date remains October 15, 2026, and all offerors must acknowledge receipt of this amendment in accordance with Standard Form 30 instructions prior to the hour and date specified. The Contracting Officer is Marsha Howard at GSA PBS OAM Capital Construction Projects Division, Fort Worth, Texas, reachable at marsha.howard@gsa.gov or 817-505-8543.

# Reference Question Answer

## Curious if you know what the status is on the land acquisition for Viable Action Alternative 4 shown in the Final EIS? The preliminary site survey from the RFP by CobbFendley shows the site boundaries significantly different on the north side along E. Paisano Dr as well as on the southeast corner along Delta Drive and Hwy 54. Please see snip below with the FEIS on the left and site survey on the right. Any feedback would be greatly appreciated.

The site survey currently provided does not reflect the land to be acquired for Alternative 4. A separate contract has been executed to complete the ALTA Survey and Title Commitments to initiate the site acquisition process. This contract is expected to be completed by mid-September 2026. In the meantime, please proceed with incorporating the proposed land parcels that will eventually be acquired into your design concepts.

2 ##

As a follow up to the Pre-Proposal Conference and Site Visit, could the following “As-Built” or Original Construction Documents be provided for the following areas: Main Building, Headhouse, Dock Areas, Canopies, Site, including paving, Site Utilities and Electrical Utilities

As-built drawings currently available have been uploaded to the Google drive under D. Amendment 0003 File Folder named 3. As-Builts. OR Refer to Amendment 0003 response to question no. 31.

3 ##

Reference the Statement of Work, Specifications, Drawings, Exhibits and Other, page 131 or 132: According to VII. Appendix, 2. CBP Requirements, b. LPOE Funding Tool – CBP, there should be a file for this, however, it was not provided. Please either provide this, or update the Appendix to say, “not used.”

Refer to Amendment 0003 response to question no. 49.

FFE Responsibilities and Low Energy Portals (LEPs) Scope Delineation

Section II.G.15. “Vendors and Installers by other Contracts" (Page 21/132)

SOW Section II.G.15 (page 21) notes that the government will issue separate contracts for furniture, fixtures, security devices, and specialized inspection equipment (including LEPs and Z-Portals).

However, CLIN 0015 of the Price Form (page 15) outlines a base scope requirement for the DB contractor to design, purchase, install, and provide move services for CBP FF&E. Please clarify the exact scope delineation between the DB contractor's FFE procurement responsibilities and the third-party vendor installations. Additionally, please provide the specific salvage, demolition, and integration requirements expected of the DB contractor regarding the existing or incoming Low Energy Portals (LEPs).

a. The CLIN 0015 list the scope of covered products. A list of FF&E under CLIN 0015 will be provided in the next amendment. There will be furniture and equipment that CBP will contract separately (examples are Refrigerator, Freezer) items can be found in the LPOE Funding Responsibility Tool document. The file is located on the Google drive under D. Amendment 0003 File Folder named

4. LPOE Funding Responsibility Matrix.

b. The existing LEPs will remain, but could be relocated depending on DB concept design. If LEP's are required to be relocated relocation will be done by CBP's contractor.

The infrastructure will be provided by the DB contractor.

LEP command anc control center located in existing commerical area will be required to be relocated, this will be done by CBP's contratctor, but temporary infrastructure will be required by the DB contractor.

Parking Logistics

Section II.F.5 "project Stages, Phases, and Work Sequence" (Page 17/132) and Section IV.G.1.d. "Construction Services Stage" (Page 69)

SOW Section II.F.5 (page 17) requires the contractor to provide parking for current facility staff (CBP, TABC, USDA, FDA, FMCSA, and USFWS) as well as construction personnel throughout the construction period. Additionally, Section IV.G.1.d. (page 69) specifies a required minimum of 420 parking spaces during construction. Because 420 spaces is roughly equivalent to the site's entire current parking capacity, providing this full quantity on-site while simultaneously executing major building demolition, site work, and new construction presents significant spatial and logistical challenges. Please clarify the following: Does the Government or tenant agencies have a specific off-site parcel, designated lot, or dedicated on-site boundary reserved to accommodate these 420 temporary parking spaces during phased construction? If the Design-Builder is responsible for independently determining and managing temporary parking logistics within the boundaries of the project limits, can the Government confirm whether the 420-space requirement is a rigid minimum, or if a smaller quantity would be acceptable?

The Design-Builder shall be responsible for independently determining, planning, and managing all parking logistics within the limits of the project site. The Design-Builder will coordinate with the Government to validate the minimum parking requirements; however, for planning and design purposes, the Design-Builder shall use 350 parking spaces at a minimum.

Section II. Project, A. Project Description, 9. Project work items, page

Section 1.6.3.4 of the EIS states it is GSA policy to perform Lead Based Paint inspections and any abatement would be done prior to demolition. In the RFP, the Design Builder is required to inspect and abate for only asbestos . Can GSA clarify if Lead Based Paint inspections and abatement are the Design Builders responsibility?

It is the contractor’s responsibility to ensure the work environment is safe and to test for any hazardous material and/or hazardous conditions outlined in the Safety & Health Specification 01 59 50.

7 4.5.3

Per CBP 2023 4.5.3, canopies over pedestrian waiting areas and over all walkways from the border to the Main Building pedestrian processing area are to be incorporated to mitigate extreme conditions that exist along the southern border. Please clarify if a canopy is required over the entire length of the pedestrian walkway from the border to the Main Building, or can mitigation of extreme heat and sun conditions be provided by alternate methods, such as shade trees.

The actual border begins at the middle of the bridges which are owned by IBWC. GSA's property line begins at the bridge abuttment. Construction activites must be within GSA property. Canopies over pedestrian walk way needs to begin from the property line on the southend and run north to the main building. It is up to the design team to provide shade, which can be done in different ways.

8 Cover Page Price Form (page 5 of 352) Will GSA provide a separate price form to document proposed betterments?

See Amendment 0003. If any betterments or optimizations are offered, they must: Meet or exceed the minimum requirements specified in the RFP, enhance the overall quality and performance of the project, and be clearly identified as a betterment, referencing the exact minimum requirement page, document to be exceeded and be offered within the design funding limit and included inside the firm-fixed-price proposal.

9 13.2.6 Roadway Dimensions

Section 13.2.6 of the LPOE Design Standards identifies typical vehicle lengths of 20-FT for noncommercial traffic to establish the length of queuing lanes, parking bays, and waiting areas. Please provide the maximum length vehicle that is expected to pass through the LPOE (Secondary Inspection Area) that could exceed this length such as a recreational vehicle (RV) with a trailer.

A trailer or towable recreational vehicle and motor vehicle combination may not be longer than 65 feet in the State of Texas, so this will be required for only one of the lanes since this only happens periodically.

#009 Request for Historical Fire Flow Test Data: DB Statement of Work (SOW): Section 4, 2. g. (page 92/132)

The SOW indicates that "Recent flow test results have demonstrated variability in both water supply capacity and the reliability of the designated point of connection..." The D/B acknowledges its contractual responsibility to perform field testing for existing fire flows.

However, to provide additional data points for analysis in developing our design, please furnish the previous fire flow test reports and documentation referenced in the SOW.

Recent hydrant flow fest to be provided.

RFI #011 Clarification of Utility Company Fees for Permanent Electrical Transformer Re-Feeds

The project documentation notes that existing Main Building and Lane transformers (1,000kVA and 500kVA) must be re-fed or temporarily re-routed during construction phasing to maintain continuous port operations. The Feasibility Study confirms EPE performs and charges for primary work, while meeting minutes state EPE pays for work within their property. At this proposal stage, EPE cannot provide firm pricing or line-extension charges without a finalized engineering design, approved load calculations, and designated points of connection. In industry practice, utility provider scope and fees are handled via a dedicated Contract Allowance and reconciled once EPE issues formal utility design estimates. 1) Is the Design-Build Team required to include EPE utility company fees, line-extension charges, and temporary re-feed fees within its base D/B contract price? 2) If EPE fees are to be included, will GSA establish a designated Cash Allowance on the Bid Form? 3) If an Allowance will not be established, please provide EPE’s official preliminary cost estimate and utility point-of-contact details to baseline this scope.

See Amendment 0004 under Phase 2 BOTA DB Pricing Sheet Rev 9.16.2026 - Allowances

RFI #015 Clarification on Small Business Subcontracting Plan – Lower- Tier Credit Reference: 13 CFR § 125.3(a)(1)(i)(C)

Pursuant to 13 CFR § 125.3(a)(1)(i)(C), will the Government authorize the Prime Contractor to receive credit toward its small business subcontracting goals for small business concerns performing as subcontractors at any tier? Please confirm if the use of "lower-tier" small business subcontracting credit is permitted for the Subcontracting Plan required by this solicitation.

13 CFR § 125.3(a)(1)(i)(C) is an SBA Agency regulation.

Pursuant to FAR 52.219-9(l), the contractor and its subcontractors cannot take credit for awards made to lower tier subcontractors, unless the Contractor or subcontractor has been designated to receive a small business or SDB credit from an ANC or Indian tribe.

Reference the LPOE Funding Responsibility Tool issued in Addendum 1, Page 2 of 14.

The last line on that page indicates “shipping back of existing LPOE LPR’s and RPM’s; all packaging/labor/shipping will be done by CMc/DB/DBB Contractor. Coordinate with PNNL to reuse crating/materials, etc.” The documents states that these are furnished and provided by CBP-V/CBE. Please provide a quantity that are on site that need to be salvaged. Whose responsibility is it to salvage these?

The LPR's and RPMS will be removed and stored temporarly by the DB/GC. The DB/GC will be responsible to ship to ship to the designated company. Vendor will ship the new RPMS that will be installed, which the crating will need to be stored and resued on the RPMs that are removed, which will be shipped back to PNNL by the DB/GC. Refer to RPMS reference documents. It will be up to the DB/GC to get a count of the various LPR's and

RPMS.

Reference the LPOE Funding Responsibility Tool issued in Addendum 1, Page 4 of 14

The second to last line states “Contractor Network.” Could you please define “contractor” as it applies to the network system?

When DB/GC installs equipment, the DB/GC must establish a temporary network to verify the systems functions before turning over the system to the government.

Reference the LPOE Funding Responsibility Tool issued in Addendum 1, Page 4 of 14.

The last line states that the incoming fiber to the site will be furnished and installed by the GSA. Whose responsibility is the ductbank and pathways for these systems?

GSA and Agencies are responsible for the fiber connection to the port point of connection, which will be in the demarc room. It is the DB/GC responsibility for all ductbank and pathways.

Reference the LPOE Funding Responsibility Tool issued in Addendum 1, Page 7 of 14, Item “Identify Signage on the outside and inside of the Building.”

It states that these are furnished by the CBP, by typically have been furnished and installed by the DB/GC. Will CBP be furnishing the signage, or should the furnishing read “DB/GC.”?

DB/GC to provide.

Reference the LPOE Funding Responsibility Tool issued in Addendum 1, Page 8 of 14, Item “Chairs (NOT bolted down.)” It states that this is furnished and installed by the DB/GC.

This is typically furniture. Same applies for the ergonomic chairs, lateral storage and mobile storage pedestal, along with other furniture listed on page 9 at the Conference and Break Rooms, and all other “Furniture” designations in the Furniture, Fixtures or Equipment.

Is the DB/GC responsible to furnish and install the furniture stated? Yes, this is separate CLIN item that is under basebid.

Reference the LPOE Funding Responsibility Tool issued in Addendum 1, Page 10 of 14, item “Lockers – Weapon Safe”

Should this read furnished and installed by CBP instead of the DB/GC? DB/GC to furnish and install

The "C - References Folder item 2 - FMCSA Pipe Insulation Sample dated July 31, 2017 indicates underground transite pipe that contains 25% Chrysotile asbestos. Is there a survey that indicates the extent of this piping? If not, please advise to how the Proposers shall address this.

There is no additional information on the amount of insulation containing ACM. Contractor to provide unit price to remove.

20 ## Is a lead based survey available? If not, how shall this be handled by the proposers? Reference Item #6

21 General Is standby power required for the Trusted Traveler building, FAMU/UAC, and Kennel building? Yes, all buidlings will require standby power.

22 III.F. Insurance Requirements

Agreement III.F.(2) requires the Contractor’s licensed design professionals to obtain professional liability insurance in the amount of $5,000,000 per claim and GSAR 552.228-5, Government as Additional Insured, which is incorporated by reference, requires that “each insurance policy required under this contract, other than workers’ compensation insurance, shall contain an endorsement naming the United States as an additional insured with respect to operations performed under this contract.” As such, this requirement makes it so that the Government would be required to be included as an ‘additional insured’ on any required professional liability insurance policies.

Insurers do not allow owners to be included as insureds on this coverage, and the Government should not want to be an insured due to the Insured versus Insured exclusion. If the Government is listed as an additional insured, this exclusion would apply to any claims made by the Government against the policy thereby eliminating their benefit of the policy. Additionally, this could require Contractor to attempt to procure a project-specific professional liability insurance policy which would entail significant additional costs and would have very little value for money due to the Insured versus Insured exclusion. Please provide confirmation that no policy of professional liability insurance shall be required to include the Government as an additional insured. One potential contractual solution would be to amend the Agreement III.F.

(2) as follows:

(2) The Contractor shall require that the licensed design professionals it retains for the Project acquire and maintain professional liability insurance in the amount of $5,000,000 per claim and shall provide proof to the Contracting Officer. Notwithstanding anything to the contrary, no professional liability policy shall be required to include the Government as an additional insured.

Professional liability insurance for A/E services requirement falls under Agreement III.F. Paragraph (2) and is not intended to fall under GSAR 552.228-5, Paragraphs (1)(a), (1)(b) and (1)(c). No changes are being made to the Agreement.

23 II Project A. 9.

The RFP provides asbestos surveys for existing buildings and identifies additional suspected asbestos-containing materials in existing roofing systems for which further testing will be performed by the Design-Builder following award. Please confirm whether GSA will retain hazardous waste generator status for all pre-existing hazardous materials encountered during investigation, abatement, demolition, and disposal activities, including asbestos-containing materials, and whether GSA will execute required hazardous waste manifests and provide the applicable EPA/TCEQ generator identification number.

Yes, the GSA retains hazardous waste generator status for pre-existing hazardous materials encountered on its properties. GSA will provide the applicable EPA/TCEQ generator ID number.

The FMCSA Facility Design Guide, Chapter 8 (Emergency Power) references compliance with Executive Order (EO) 14057. EO 14057 was rescinded on January 20, 2025, under the White House action titled 'Initial Recissions of Harmful Executive Orders and Actions'.

Please confirm whether the requirements previously associated with EO 14057 remain applicable to this project

The reference to EO 14057 is no longer applicable. FMCSA will be removing reference in there in their next revision to the FMCSA Facility Design Guide.

27 ##

Per LPOE Design Standard Section 15.2.1, all buildings are to be assigned Occupancy Category II unless otherwise required by code.

Jacobs assumes the "Occupancy Category" refers to ASCE 7 Risk Category. Current ASCE7 and IBC do not provide specific guidance related to risk category determination for this facility type. Please confirm that Risk Category II is appropriate for all buildings and structures associated with this project

Risk Category II can not be used for all buildings. Buidlings that house critical communication and infrastructure, active command/operations centers or CBP enforcement operations are designated as Risk Category IV. Detention and Holding cells are designated as Risk Category III. A blanket risk catergory designation is incorrect, a mixed-risk category approach is standard practice for a port of entry campus.

On PDF page 42 of 10+BOTA+Phase+2+RFQ+47PB5126R 0003+Final+Amd+0002, under Quality of Design Concept > Submittal Requirements for the Design Concept Evaluation, it states: “Design Concept:

Offerors shall provide the information and generally follow the format and structure as set forth in the Statement of Work, Section VI Owner’s Project Requirements (OPR).”

While the OPR makes reference to the CBS Submittal Matrix, it does not necessarily correspond to the CBS Submittal Matrix in all instances and includes a number of items that are not required in the CBS Submittal Matrix. For example, in the OPR section on PDF 238 of the same document, there is a section referencing “Site Signage” however, details about “Site Signage” is not required as part of the Pre-Award Design Concept in the CBS Submittal Matrix. Please confirm that our design must comply with the design parameters and requirements set forth in the OPR, but that offerors should mirror the organization and submission requirements set forth for the Pre-Award Design Concept in the CBS Submittal Matrix when organizing the Quality of Design Concept section of our proposal.”

The final proposal must comply with all design parameters and requirements set forth in the Owner’s Project Requirements (OPR) (Request for Propoposal) , in addition to satisfying the requirements of the CBS Submittal Matrix.

It is ultimately up to the offeror how they choose to organize and structure their proposal submission. While offerors may mirror the organization of the Pre-Award Design Concept in the CBS Submittal Matrix for consistency, they must ensure that any additional items required by the OPR (such as the "Site Signage" details referenced on PDF page 238) are also fully addressed and included in the final proposal, even if those items are not explicitly listed in the CBS Submittal Matrix.

29 Program Clarification for TABC Duty Booths

The project scope references Texas Alcoholic Beverage Commission (TABC) duty booths with restrooms; could the Government please confirm if the quantity of three booths is a strict operational requirement, or if there is flexibility in the booth count and layout should the design team find an alternate spatial solution that satisfies TABC's operational needs?

There will be flexibility. Currently the existing LPOE has 3 booths, but only one is in operation due to personnel reduction.

30 Program Clarification for NII Operation Centers

The Program of Requirements requires three individual NII Operation Center (LEP Command and Control) spaces at 600 sf each. Are they intended to be proximate to the equipment they serve, or can they be remote or combined?

Yes, they are intended to be proximate to the equipment they serve and it is possible they will be combined.

31 Program Clarification for FAMU/UAC Detainee Restroom Spaces

The Program of Requirements for the FAMU/UAC suite currently lists 10 individual Detainee Shower and Restroom spaces (5 Male and 5 Female) at 200 SF each, totaling 2,000 net SF; could the Government please confirm if both the total quantity of units and the square footage per space are required as written, or if there is flexibility to optimize this footprint?

There will be flexibility, include CBP on response.

32 Scope Delineation for Shell vs. Tenant Improvement (TI) CLINs

The Price Form includes separate line items for Shell and Tenant Improvement (TI) construction for the Kennel Building: CLIN 0016 (Option #1A - Kennel Building Construction - Shell) and CLIN 0017 (Option #1B - Kennel Building Construction - TI); could the Government please provide a detailed scope matrix or baseline definition establishing the exact boundary between Shell scope and TI scope to ensure consistent pricing alignment across CLINs?

The information on shell and TI is defined in the pricing GSA Pricing Desk Guide 5th Edition which is included in the reference documents. .

Scope Delineation Between Base Scope and Option #2 (CLINs 0018 & 0019)

The Price Form lists Base Scope Non-Commercial Inspection to include 27 Lanes & Head House (CLINs 0004 & 0005) alongside Option #2 for 8 Additional Lanes (CLIN 0018 - Shell & CLIN 0019 - TI);

could the Government please confirm if the Base Scope requires full structural, canopy, and site infrastructure to accommodate all 35 lanes with CLINs 0018/0019 limited strictly to the fit-out of the 8 expansion lanes, or if Option #2 includes the physical structure and civil footprint for those 8 additional lanes?

Option #2 includes the physical structure and civil footprint for those 8 additional lanes.

34 Clarification of Abatement Scope Under Demolition CLIN 0014

The Price Form includes CLIN 0014 for Demolition Construction Base Scope Costs, while also listing specific line items for Environmental - Remediation (soil) and Environmental - Abatement within individual building CLIN breakdowns; could the Government please confirm if all hazardous materials abatement (including asbestos and lead) is intended to be included under CLIN 0014, or if abatement should be priced under the respective Environmental line items within the individual building CLINs?

The revised pricing sheet will be incuded in amendment #4.

The CLIN for Demolition is now CLIN #0013, which will include abatement and remediation.

Clarification of DB Contractor Scope & Responsibility for the License Plate Reader (LPR) System

The LPOE Funding Responsibility Matrix in Amendment 0003 omits the License Plate Reader (LPR) system, whereas the LPOE Funding Responsibility Tool (7/15/2026), CBP Design Standard (Section 6.2.2.

D), and ITI LBI Lane Drawings indicate LPR hardware is CBP-furnished/installed (GFE/GFI) with the DB Contractor providing rough-in infrastructure. Could the Government please confirm that the LPR system remains in scope and that the DB Contractor’s sole responsibility is limited to rough-in infrastructure with CBP or its vendors remaining fully responsible for furnishing and installing the LPRs?

Yes, LPR system remains in the scope and the DB contractor is only to provide the rough-in infrastructure.

CBP vendor will be responsible to install the LPRs.
