About this file

This is a Performance Bond form for the St. George Cemetery Plaza construction project (Inquiry No. 26-298) involving the City of St. George, Utah, a contractor, and a surety company. The bond secures the contractor's faithful performance of all duties, undertakings, covenants, terms, conditions, and agreements under the construction contract for the cemetery plaza project, including a one-year guaranty period following project completion. The surety agrees that changes, extensions of time, alterations, or additions to the contract terms or work specifications shall not affect its obligation on the bond, and the surety waives notice of any such modifications. The bond protects the City from all costs and damages resulting from the contractor's failure to perform and requires the contractor to indemnify and reimburse the City for any expenses incurred in remedying defaults.

The penal sum of the performance bond is left blank in this template form and must be completed upon execution. Per the related solicitation requirements, 100% payment and performance bonds are required for this project. The surety company executing the bond must appear on the U.S. Treasury Department's most current list (Circular 570 as amended) and be authorized to transact business in Utah. The bond date must not be prior to the contract date, and if the contractor is a partnership, all partners must execute the bond. The bond remains in full force and effect until all contract obligations are satisfied and protects any beneficiary whose claim may remain unsatisfied even after final settlement between the City and contractor.
