About this file
This document contains instructions for completing Form 1295, the Certificate of Interested Parties, as required by Fort Bend Independent School District (FBISD) in connection with a fencing installation, repair, and services contract opportunity in Texas. Form 1295 must be completed electronically through the Texas Ethics Commission's online filing application, printed, signed by an authorized agent of the business entity, and submitted with the vendor's proposal. FBISD is required to comply with House Bill 1295, which amended the Texas Government Code Section 2252.908 to mandate disclosure of interested parties before entering into contracts. An "interested party" is defined as any person with a controlling interest in the business entity or who actively participates in facilitating or negotiating contract terms, including brokers, intermediaries, advisers, or attorneys.
All vendors, regardless of whether interested parties exist, must complete and submit Form 1295 with their proposals. The form requires vendors to provide their business name and location, identify FBISD as the governmental entity, include the project number and title, and list any interested parties along with their location and nature of interest. The completed form must include a certification of filing with a unique certification number and an unsworn declaration executed by the authorized agent under penalty of perjury. The form example provided shows a declaration executed in Fort Bend County on June 5, 2022, with Peter James identified as the authorized agent. Vendors experiencing difficulties completing the form electronically on the Texas Ethics Commission website should notify FBISD's buyer immediately.
