About this file

This Scope of Work document outlines requirements for portable toilet rental and service contracts administered by the State of Utah Division of Purchasing for use across five regions of Utah. The contract is designed to serve eligible users including state government departments, institutions, agencies, political subdivisions such as colleges, school districts, counties, and cities, as well as authorized nonprofit organizations and federal agencies. The awarded contractors will provide full-service portable toilet units and related products or services from their price lists and catalogs. The contract term is five years, with the current portfolio consisting of four contracts generating approximately $100,000 in average annual sales, primarily from state agencies and higher education institutions.

Pricing is detailed in Attachment C and represents maximum pricing guaranteed for a minimum of 12 months. An administrative fee of 0.25 percent applies to the contract. Contractors may request price adjustments after the initial guarantee period if the request is submitted at least 30 days in advance and includes market analysis or objective supplier documentation, provided the adjustment does not increase profit margins beyond original contract levels. All pricing requests require approval from the Division of Purchasing Contract Manager. Portable toilet units must comply with Utah R317-550 regulations and industry standards, featuring minimum 60-gallon waste reservoir capacity for standard units and 30-gallon capacity for accessible units. Contractor responsibilities include weekly servicing, maintenance of ADA-compliant units comprising at least 5 percent of units at any location, 24-hour delivery and removal response times, four-hour emergency response times for major issues, and maintenance of current Liquid Waste Operator Permits with proper waste disposal documentation and manifests.

This contract does not guarantee any sales.

b. Any awarded contract may be modified to incorporate new technology and technological upgrades related to the Scope of Work throughout the term of the contract.

2. ANTICIPATED PRODUCTS / SERVICES, & BACKGROUND

a. It is anticipated that the awarded contractors will provide portable toilet rentals and services to Eligible Users and any other products and services the Contractor offers on their price list and/or catalog.

b. The current portfolio has four contracts. The primary users are state agencies and higher education. The average annual sales are approximately $100,000.

3. SCOPE OF WORK

a. The Contractor will provide full-service portable toilet units. Each unit must be of sound, non-absorbent, and durable construction (e.g., polyethylene).

b. The Contractor will comply with Utah R317-550 and industry standards for high-traffic use, making certain that a standard toilet unit has a minimum waste reservoir capacity of 60 gallons (exceeding the standard 45-gallon baseline for better service longevity). Accessible toilet units will require a minimum waste reservoir capacity of 30 gallons.

c. The Contractor will have each unit equipped with:

i. Functional toilet seats with lids.

ii. Dual tissue paper holders (fully stocked).

iii. Separate and sufficient ventilation for both the cab and waste reservoir to prevent odors.

iv. Interior coat hooks and mirror (standard in modern "full-service" units).

v. Hand sanitizer dispensers (minimum 800ml) or integrated hand-wash sinks.

d. Accessibility (ADA): All wheelchair-accessible units must meet ADA Standards for Accessible Design, including a minimum 60-inch turning radius, reinforced grab bars, and "no-step" ground-level entry. At least 5% of units at any single location should be ADA-compliant.

e. The Contractor will adhere to the following service & maintenance requirements:

i. Weekly Servicing: Units must be serviced at least once every seven (7) calendar days. Service includes:

(a) Complete evacuation of waste.

(b) Scrubbing and sanitizing all interior surfaces (walls, floors, seats, and urinals).

(c) Refilling deodorizing solution (blue liquid) with seasonal adjustments (anti-freeze additives for Utah winter months).

(d) Restocking all consumables (paper, sanitizer, soap).

f. The Contractor is responsible for maintaining units free of "objectionable odors." Units that remain foul-smelling after service must be replaced or deep-cleaned within 24 hours.

g. The Contractor is responsible for wind & safety securing: Per Utah R392-400, each unit must be secured against vandalism and adverse weather (high winds common in Utah canyons/valleys) using tie-downs, anchors, or weighted "stakes" as appropriate for the surface.

h. The Contractor is to adhere to the following response times & operations:

i. Delivery/Removal: Respond to requests for additional units or removal of existing units within 24 hours.

ii. Emergency Service: Respond to "tip-overs" or major leaks within 4 hours of notification.

iii. Responsibility: The Contractor is responsible for all routine repairs. The State may allow reimbursement for damage caused by documented vandalism or extreme negligence by the Purchasing Entity, provided a police report or incident log is submitted.

i. The Contractor must adhere to Utah Code R317-550: All operations must comply with "Rules for Liquid Waste Operations."

i. The Contractor must maintain a current Liquid Waste Operator Permit issued by the local Health Department having jurisdiction.

ii. All waste must be disposed of at a facility approved by the Utah Division of Water Quality or the local health department. The Contractor must maintain Waste Manifests and provide them to the State upon request.

iii. The collection vehicles must be watertight, equipped with self-priming pumps, and labeled with the company name and tank capacity in U.S. gallons.

j. The Contractor must follow Additional State Cooperative Requirements as follows:

i. Placement Strategy: For construction or long-term sites, units must be placed within 200 feet of work areas (OSHA 29 CFR 1926.51) and on a level, accessible surface for service trucks.

iii. Documentation: The Contractor shall maintain a service log inside each unit (or a digital equivalent accessible via QR code) showing the date and time of the last three services.

k. The Contractor may require the Eligible User to provide information to set up a charge account with them (i.e., credit application). In such cases, the Contractor must not require the Eligible User to sign any agreement or application that contains additional terms and conditions.

4. PRICING INFORMATION

a. Pricing options will be provided in Attachment C.

b. The Contractor may only charge fees detailed in Attachment C. Any fees not listed cannot be charged to an Eligible User.

c. Percentage discounts, if any, will be provided in Attachment C and guaranteed for the life of the contract. Percentage discounts are considered a minimum percent discount.

d. Prices are guaranteed for at least 12 months and are considered maximum pricing. After the price guarantee period is over, the Contractor may submit a request to amend the contract pricing if the following conditions are met:

i. The price guarantee period has been met.

ii. The request is made at least 30 days in advance.

iii. The price adjustment must not produce a higher profit margin than the original contract pricing.

iv. The request includes a thorough market analysis (e.g., data from the Producer Price Index) or documentation with objective data from the Contractor’s suppliers of materials or products, and pricing adjustments.
