About this file
This is a Scope of Work document issued by the State of Utah Division of Purchasing on behalf of the Division of Wildlife Resources for an Invitation for Bid (IFB) for forestry and land management services in the Wasatch National Forest. The project, designated Bid #JH27-112, involves cut and pile services across approximately 115 acres of conifer-encroached wetland habitat along 3.5 kilometers of the Provo River and its tributaries in Summit and Wasatch Counties, east of Kamas, Utah. The work includes thinning standing dead trees and conifer trees under 12 inches in diameter breast height, spacing remaining conifers at least 20 feet apart, and creating hand piles of specific dimensions (8x8x8 to 12x12x12 feet) with strict placement restrictions. A mandatory in-person site visit is scheduled for September 22, 2026, at 10:00 AM at Soapstone Area Parking Grounds, with attendance required for all authorized bidder representatives. Participation is limited to prequalified contractors only. The project performance period is 60 calendar days from the official Notice-to-Proceed, with work to be completed between October 1 and November 30, 2026, and final invoices required by December 6, 2026.
Bidding will be conducted on a per-acre price basis, with the total bid price including all labor, equipment, materials, mobilization, and operating costs, with no fuel surcharges or price adjustments permitted. Contract award will be made to the lowest responsive and responsible bidder meeting experience and equipment requirements. One lump-sum payment will be issued following successful final inspection, with partial payments requiring written pre-approval. The contractor is responsible for all equipment transportation, site access restoration, environmental compliance, and hazardous material management. Equipment must be identified in the bid submittal, and subcontractors require written pre-approval from the Project Manager. The contract includes provisions for minor change orders (up to 10 percent acreage adjustments) and major change orders (exceeding 10 percent), with total change order payments capped at the per-acre bid price multiplied by 10 percent of untreated acreage. No government property will be furnished, and the contractor must maintain on-site supervision, comply with all state and federal regulations, and allow public access throughout project execution.

SECTION III - ADDITIONAL REQUIREMENTS
Environmental Considerations
• Cleanup: Project sites shall be cleaned up, and all refuse removed by the Contractor in accordance with State, Federal, and local laws at the Contractor's expense. Access roads damaged by the Contractor shall be restored to pre-work conditions.
• Vehicles: Use of 2-wheel and 4-wheel vehicles is prohibited off-road within project areas.
• Hazardous Materials:
1. Use of hazardous materials or petroleum products requires compliance with all State and Federal regulations, including having Safety Data Sheets (SDS) on hand and using required Personal Protective Equipment
(PPE).
2. On-site disposal of hazardous materials or waste (including hydrocarbons) is prohibited and will subject the contractor to reclamation and soil disposal costs.
3. Incidental (de minimis) leaks from fittings, gaskets, or hoses are considered normal operational losses. Continual leaks will be noted on inspection reports and require immediate maintenance.
4. Draining engines or hydraulic systems on-site is permitted only if fluids are fully captured, containerized, and removed from public lands for proper disposal.
Public Access
Access into and through the project site shall remain open to the public at all times.
Roadways must be kept free of contractor vehicles, tools, and debris.
Security of Equipment and Property
The Contractor may leave equipment at the work site at their own risk. The Contractor is solely responsible for equipment protection against loss, theft, or damage.
Crew Supervision
1. The contractor shall designate one English-literate supervisor who will remain on site during operating hours. Supervisors must be identified during the pre-work conference. Designation changes must be submitted in writing at least 24 hours in advance.
2. The supervisor must actively direct the crew by inspecting work, correcting improper methods, and providing instruction.
3. Emergency transportation must be provided by the Contractor on site at all times.
Work Camps
Work camps may be established only in locations authorized in advance by the Project Manager and Government staff. Camps must be maintained in an orderly, sanitary manner. All refuse must be removed prior to final payment.
Work Hours
Work hours are limited to between one-half hour before sunrise and one-half hour after sunset. Work in darkness is allowed only if equipment is equipped with sufficient exterior lighting and approved in writing by the Project Manager. Weekend or holiday work requires mutual agreement between Contractor and Project Manager.
Work Schedule
The work schedule shall be submitted during the pre-work conference.
Delays
The contractor is expected to complete all performance in a timely manner regardless of other workloads. Delays may be excusable if caused by acts beyond control without fault or negligence (e.g., acts of God, sovereign State acts, fires, floods, epidemics, quarantine, strikes, freight embargoes, or unusually severe weather).
"Unusually severe weather" refers to conditions outside normal seasonal patterns (e.g., a severe storm significantly worse than the seasonal baseline). Standard seasonal fall/winter snow or wind storms do not constitute unusually severe weather.
Project Meetings
Pre-Work Conference
• Location: Project site or as determined by the Project Manager.
• Notification: Held prior to start of work; contractor will be notified of date and time.
• Attendance: Contractor, subcontractors, and key coordination personnel must attend.
• Presentation: Contractor must explain planned procedures and submit the work schedule.
Progress Meetings
• Location: Project site or as determined by the Project Manager.
• Notification: May be called by either Project Manager or Contractor with required attendance specified.
Fire Danger Season
If work continues during declared fire danger periods, the Contractor must comply with all state fire prevention laws and special directions issued by the Project Manager.
Preservation of Historical and Archeological Data
If potential scientific, pre-historical, historical, or archeological data is discovered, the Contractor must immediately notify the Project Manager and pause operations at that location. Contract time and pricing may be adjusted if delays or scope changes are ordered. This clause must be included in all subcontracts involving terrain work.
Protection of Cultural Resources
Protected historic or prehistoric sites (under the Antiquities Act, NHPA, and ARPA) will be identified on the ground by the Government. The Government reserves the right to modify or cancel the contract to protect cultural resources.
If an unidentified site is encountered, operations near the site must halt immediately and be reported. The Contractor shall bear evaluation and restoration costs if damage occurs due to contractor operations.
Notice to Proceed
Receipt of the contract or purchase order by email constitutes a Notice to Proceed (NTP) unless notified otherwise. Delayed NTPs may be issued for adverse environmental conditions.
Contract Performance
Work must begin within 7 calendar days of the NTP effective date and proceed without delay. Extended performance windows are intended only for contractors managing multiple state contracts simultaneously and require written pre-approval. Once on site, work must be completed within the 60-day performance window.
Inspection
• Surveillance Plan: Government staff will periodically inspect completed acres and provide quality guidance during operations. The Contractor maintains responsibility for quality control.
• Final Inspection: Contractor must provide at least 3 working days' notice prior to completion so a final inspection can be scheduled.
• Deficiencies: Contractor must correct identified deficiencies prior to re-inspection.
Acceptance
If quality falls below contract specifications, written notice will be provided. Continued non-compliance may result in a Suspension of Work order (contract time continues to run) or required rework of unsatisfactory acres.
Payment
One lump-sum payment will be issued following successful final inspection. Partial payments are generally not considered and require written pre-approval prior to invoice submission.
Winter Stoppage
The contract may be halted at any time due to frozen ground or winter conditions. The State may pay for completed work and cancel the remainder or issue a resumption order in the spring.
Change Orders
Minor Change Order
A written modification adjusting acreage or parcel configuration by up to 10% of the original project area. Unit prices remain unchanged, and work areas added/exchanged will share similar characteristics and access.
Major Change Order
Negotiated amendments for changes exceeding Minor Change Order criteria (e.g., acreage reductions >10% or drastic terrain changes). May allow per-acre unit price adjustments or mobilization cost coverage, subject to Division of Purchasing approval.
Change Order Limitations
Total payments under Change Orders cannot exceed the liability cap:
Per-Acre Bid Price × (10% of Untreated Acreage) = Maximum Cap
• Example 1: $50 per acre bid price × (10% of 500 acres untreated) =
$2,500 Maximum
• Example 2: $250 per acre bid price × (10% of 1,250 acres untreated) =
$31,250 Maximum
Change orders cannot exceed the total approved contract price.
