About this file
This is a Procurement Certification for Disclosure of Lobbying Activities form issued by the State of Florida Department of Transportation for federal-aid contracts, ensuring compliance with 49 CFR Section 20.100(b). The document applies to the City of Fort Myers' NRCS Emergency Watershed Protection Grant project (ITB 25-092), which solicits a Construction Manager to perform comprehensive stream debris and sediment removal across multiple waterways in Lee County, Florida. The scope includes non-vegetative and vegetative debris removal, underwater debris removal, sediment transport, and Ballard bank repair across multiple canal systems including Billys Creek, Eastwood Golf Course Canal, and L-3 Canal. The solicitation was released on October 15, 2025, with a pre-submittal meeting scheduled for October 22, 2025, and proposals due on November 17, 2025. Bidders must be registered in SAM.gov and demonstrate comprehensive federal, state, and local compliance certifications.
The certification requires prospective participants to confirm that no federal appropriated funds have been or will be paid to influence federal agency officers, Members of Congress, or Congressional employees in connection with the contract award. Any non-federal funds used for lobbying activities must be disclosed on Standard Form-LLL in accordance with Section 1352, Title 31, U.S. Code, with penalties of $10,000 to $100,000 for non-compliance. The form mandates that all lower-tier subcontracts exceeding $100,000 include identical certification language and disclosure requirements. The project funding is provided through the NRCS federal grant, and contractors must comply with federal regulations including Buy America provisions, Anti-Lobbying certifications, E-Verify requirements, Davis-Bacon wage standards, and MBE participation goals of 5% for minority and women-owned businesses.
