About this file
Truth in Negotiation Certification
This is a Truth in Negotiation Certification document issued by the Florida Department of Transportation (FDOT) for professional services contracts exceeding the Category Four threshold established under Florida Statutes Section 287.017. The certification applies to lump-sum or cost-plus-a-fixed fee contracts and must be executed by the Consultant and submitted with the Technical Proposal as prescribed in the contract advertisement. The document requires consultants to certify that all wage rates and factual unit costs supporting project compensation are accurate, complete, and current at the time of contracting.
The certification establishes that the original agreement price and any additions shall be adjusted to exclude any significant sums by which FDOT determines the agreement price was increased due to inaccurate, incomplete, or noncurrent wage rates and factual unit costs. All agreement adjustments must be made within one year following the end of the contract, with the contract end date defined as the later of the final billing date or acceptance of work by the Department. The Consultant must sign and date the certification form, confirming their understanding of these terms and obligations.
