Type of Contract
Are the national contracts for the Med Surg items that the VA will be establishing the same national contracts being used for the VA's Med Surg Prime Vendor program?
No.

In the current contract the cost recovery fee is applied to only the Other Government Agencies. Can you please confirm the intent is to apply this fee to all PPV facilities?
No that was in error. The cost recovery fee only applies to the Other Government Agencies at a rate of 0.25% rather that the prior stated 0.5% in the initial solicitation.
B4 and under pricing

Please confirm that the cost recovery fee is expected to be included within the distribution fee submitted on the pricing proposals?
No that was in error. The fee shall be imbedded in the price of all products purchased by the OGA participants. The PPV shall make the appropriate provisions in the automated order system to include cost recovery fees in the acquisition price field which appears in all order-entry and confirmation modules.

Can the VA confirm that the PPV must supply vials and caps from the VA's National Standardization contractor, Berry Plastics, despite the items not being included in Table 2 (medical/surgical items)? If yes, can the PPV select which negative distribution fee would applies? If the selection is not up to the PPV, which fee will apply?
This is correct – the PPV must supply vials and caps awarded via national contract. The negative distribution fee that applied to med surge items would apply to the vials and caps.

The DSCSA does not require suppliers to transmit lot and expiration data in the Transaction Information or Transaction History until November 2023. Please confirm that at the start of performance the PPV contractor must have a system for capturing this data for transmission on invoices and reports provided to the PPV users.
Although the DSCSA does not require this information to be transmitted, the Act does state that if this information is provided, the Dispenser has a responsibility to track. Since the PPV contract requires this information to be provided, pharmacy must track, so this data is needed as part of the report.

I-4(j)
Please confirm that the PPV contractor is required to extend to the customer the price in effect on the day of order placement irrespective of subsequent price changes that take place on the date the item is invoiced or shipped.
This understanding is correct.

I-10(d)
Please confirm that the PPV's ordering system must prohibit all VA and committed OGA accounts from ordering mandatory source items until the account selects one of the four reasons for ordering an alternate product? Further, the PPV must capture these sales with the justifications and create a report for the VA.
The intent of I-10(d) is to allow for the facilities to override the lock-out when needed for one of the 4 reasons outlined. The PPV is responsible for tracking when the lock out is overridden so that this is captured in procurement related reports, but the PPV is not responsible for tracking the reason that the lock out is overridden.

I-18(e)
This provision requires the PPV to invoice for drop shipments within 7 days of delivery. The PPV doesn't know when the items were delivered or whether the customer accepted the delivery. Is it sufficient if the PPV invoices the customer within 7 days of being invoiced by the supplier?
Yes

none
Please confirm that VAAR 852.232-72, Electronic Submission of Payment Requests, only applies to transactions with VA accounts.
Yes, that is correct.
