About this file
This is Amendment 0002 to a federal solicitation (36C25926R0047) for the Miles City VA Campus Demolition project. The amendment provides responses to a comprehensive list of 182 frequently asked questions and adds FAR clause 52.222-90 (Addressing DEI Discrimination by Federal Contractors) to the solicitation. The Department of Veterans Affairs, Veterans Health Administration, Veterans Integrated Service Network 19, based in Greenwood Village, Colorado, is seeking a Service-Disabled Veteran-Owned Small Business (SDVOSB) contractor to demolish 15 structures (12 buildings and 3 structures) comprising approximately 158,000 gross square feet across a 14.5-acre Miles City, Montana VA campus. The project is valued between $10 million and $20 million and will be awarded as a firm-fixed-price lump sum contract (CLIN 0001, unit = Job) under NAICS code 238910 (Site Preparation Contractors), with a 365-day period of performance beginning upon notice to proceed.
The scope encompasses complete demolition and removal of all buildings, structures, utilities, underground storage tanks (three diesel USTs currently containing approximately 6,000 gallons of fuel), two water wells (depths 200 and 180 feet), 25 underground sanitary sewer system manholes, hazardous materials abatement (asbestos in Buildings 2 and 3, lead-based paint, PCBs), site restoration with topsoil placement and grass seeding to a 50 percent waste diversion goal, and utility disconnections coordinated with City of Miles City (water/sewer) and Montana-Dakota Utilities (gas/electric). Critical schedule constraints include restrictions on demolition of Buildings 1 and 15 (occupied nursing home) until tenant relocation, estimated December 2026/January 2027, with potential no-cost time extensions if transition delays occur. A bid bond of 20 percent or $3 million (whichever is less) and performance/payment bonds are required. The SDVOSB awardee must self-perform at least 25 percent of the work under the 75 percent limitations on subcontracting clause (NAICS 238910 specialty trades category). Contractors must submit proposals including four volumes (technical, management, past performance, and price), schedule compliance using Precedence Diagramming Method (PDM), and a phasing/demolition sequencing plan for COR/CO approval prior to notice to proceed.

All other terms and conditions remain unchanged.
Miles City VA Campus Demolition A.1 52.222-90 Addressing DEI Discrimination by Federal Contractors
(a) Definitions. As used in this clause- Program participation means membership or participation in, or access or admission to: training, mentoring, or leadership development programs; educational opportunities; clubs; associations; or similar opportunities that are sponsored or established by the contractor or subcontractor.
Racially discriminatory diversity, equity, and inclusion (DEI) activities means disparate treatment based on race or ethnicity in the recruitment, employment (e.g., hiring, promotions), contracting (e.g., vendor agreements), program participation, or allocation or deployment of an entity's resources.
| (b) | In connection with the performance of work under this contract, the Contractor agrees as follows: |
| (1) | The Contractor will not engage in any racially discriminatory DEI activities; |
| (2) | The Contractor will furnish all information and reports, including providing access to books, records, and accounts, as required by the Contracting Officer, for purposes of ascertaining compliance with this clause; |
| (3) | In the event of the Contractor's or a subcontractor's noncompliance with this clause, this contract may be canceled, terminated, or suspended in whole or in part, and the Contractor or subcontractor may be declared ineligible for further Government contracts; |
| (4) | The Contractor will report any subcontractor's known or reasonably knowable conduct that may violate this clause to the Contracting Officer and take any appropriate remedial actions directed by the Contracting Officer; and |
| (5) | The Contractor will inform the Contracting Officer if a subcontractor sues the Contractor and the suit puts at issue, in any way, the validity of this clause. |
| (6) | The Contractor recognizes that compliance with the requirements of this clause are material to the Government's payment decisions for purposes of 31 U.S.C. 3729(b)(4). |
| (c) | The Contractor must include the substance of this clause, including this paragraph (c), in subcontracts at any tier, including those for commercial products and commercial services, except those where the place of delivery or performance is outside the United States. |
(End of clause) Miles City Questions
1. I have downloaded the documents for this project. I do not see any plan pages. The spec manual TOC lists 00 01 15 List of Drawing Sheets, that page is not in the manual. Are there plan pages? Please see attachments below that were provided in Amendment 0001.

2. Given the pre-solicitation, is this going to be a SDVOSB set-aside? This requirement is a SDVOSB set-aside. Please see Amendment 0001.
3. The LOS Certification checks the “Service” box so wanted to clarify that this wouldn’t fall under General Construction or Specialty Construction? If under Service, which excludes construction, the 50% to SDVOSB would apply? Please see updated attachment “852.219-75 VA Notice of Limitations on Subcontracting”, which has been corrected to reflect the clause currently in the solicitation with the “Specialty Trades” block checked. Please see updated form attached to amendment 1.
4. Do you by chance have an interested vendors list for the Miles City VA Demo? There is not an interested vendor list for this solicitation at this time. The site visit attendance roster will be posted after the site visit has been completed which will list all attendees of the site visit.
5. Can you tell me why this is posted on an SF33 and not an SF1442? This action is being solicited as a service in accordance with RFO 37.701-1 and not construction. Construction solicitations were exempt from the Uniform Contract Format(UCF). As this is being solicited as a service, no exception exists and the UCF is being used. As such, this solicitation is using the SF33.
6. What is the magnitude range for this project? The VA magnitude for this project is between $10,000,000 and $20,000,000. Please see Amendment 0001.
7. This appears to be set-aside for SDVOSB, but that is not clearly stated under Classification on the SAM posting. Please confirm. Yes, this requirement is a SDVOSB set-aside. Please see Amendment 0001.
8. Do you have As-Built Drawings available for these buildings? Please see as-built drawings posted within amendment 0001.

9. Is the bid bond required? We only have payment and performance bonding at this time, and don't have the cash follow at this time to put up 20% bid bond. In accordance with RFO 28.101(a), bid bonds are required when performance and payment bonds are required. Therefore, a bid bond of 20% or $3,000,000.00, whichever is less, is required(RFO 28.101-2(b)). Please see attached clause RFO 52.228-1 which is provided in full text with this amendment.
10. Please confirm this project is set aside for SDVOSB as it states on SAM. It is not indicated in the solicitation document. Please see question 2 and Amendment 0001
11. What is the valuation range for this project? Please see question 6 and Amendment 0001.
12. This is a large project to have past performance of this magnitude. Can building demolition and civil past performance projects be provided separately, which if combined, would meet the past performance requirement for a job of similar magnitude? Please provide “Past Performance” as per the solicitation outlined within Section L “Instructions, Conditions, and Notices to Offerors” and Section M “Evaluation Factors For Award”.
13. Are there liquidated damages for this project? No
14. What are the requirements for landscape/seed maintenance upon project completion, if any? Per SOW Section 3.2(e): After demolition, disturbed areas shall be leveled with friable topsoil which shall be placed and spread to the height of the surrounding area and seeded with grass seed mixture to match surrounding vegetation followed by an application of straw mulch and any other necessary erosion control best management practices to prevent erosion until growth and coverage is achieved. Any trees that are damaged by the Contractor shall be repaired and treated accordingly. All broken limbs shall be sawed off evenly and cut faces painted with an appropriate compound. All repairs and treatments shall be done in accordance with the forestry regulations of the authority having jurisdiction and at Contractor's expense. On completion of work, leave site in clean condition.
15. Can this work be done during normal working hours? Yes. All scheduled work shall be coordinated with and approved by the COR.
16. I see you posted the Miles City, MT VA demolition as a service, not as a specialty trade contractor. We understand that demolition contractors are normally listed under a specialty trade. Could you please clarify this for us? Please see question 3.
17. What are the square footages for Buildings 15, 17, 18, 19, and 20? The appendix lists only 10 of the 12 buildings with confirmed SF.
Square footages of building: 15 (17,709 GSF), 17 (Switchgear Structure), 18 (Generator Structure), 19 (Generator Structure), and 20 (4,193 GSF).
18. The SOW references "12 buildings" but Appendix A lists 15 building numbers (1, 2, 3, 4, 5, 6, 7, 8, 10, 13, 15, 17, 18, 19, 20). Are all 15 structures in scope, or only 12? Which are excluded? None are excluded. All 15 structures within the campus are in scope to be demolished (12 Buildings and 3 structures).
19. What are the approximate square yardages of asphalt and concrete paving to be removed? No quantity is provided in the SOW. Approximately one mile but needs to be verified by Contractor.
20. Are any site fences, gates, light poles, flag poles, or exterior signage included in the demolition scope? Yes, completely demolish and remove the buildings, structures and utilities, including all appurtenances within the footprint.
21. Are the underground utility vaults, manholes, and hand holes to be removed entirely or just capped at grade? Yes, the sewer line shall be traced to the manhole and plugged its entrance to the manhole. Removed utilities shall be terminated in a manner conforming to the nationally recognized code covering the specific utility and approved by the Contracting Officer Representative (COR) and Contracting Officer (CO).
22. Are as-built or construction drawings available for any of the buildings, particularly Building 1 (1948 hospital) and Building 15 (Nursing Home)? These would significantly affect demolition methodology and pricing. Yes, see answer to question 8.
23. What is the confirmed square footage and number of stories for Building 15 (Nursing Home)? Building 15 is 17,709 GSF and is a one-story bldg.
24. Does Building 1 have a full basement or only a crawl space? The SOW mentions "crawl space basement" but the Phase 2 ESA references basement areas — please clarify depth and extent. Yes, bldg. 1 has a 1,482 GSF basement (boiler room) and crawl space (5’9” height) @ 7’ pit depth.
25. Are there any known tunnels, utility corridors, or below-grade connections between buildings? Yes, from old boiler plant to the main facility (bldg. 1).
26. Is the boiler in Building 10 still pressurized or in service? No, Boiler is not in service. Who is responsible for decommissioning it prior to demolition? Boiler has already been decommissioned.
27. Where exactly are the three USTs located on site? The SOW says "locations are noted on drawings" but no drawings with UST locations were included in the solicitation package. USTs are located next to the old boiler house (bldg. 10), and drawings are hereby included with this amendment.
28. Are the USTs currently in service or have they been taken out of service? If out of service, when were they last used and have they been pumped down? They are still in service (currently used as backup for the boilers). Tanks have ~6,000 Gal of diesel fuel remaining.
29. Has any soil sampling been conducted around the UST locations? If so, are those results available? Any known petroleum-impacted soil would significantly affect disposal costs. See Phase II Environmental Site Assessment Report. For remediation requirements, review 02 65 00 Underground Storage Tank Removal specifications.
30. The Phase 2 ESA was conducted in 2019. Has any additional environmental investigation or remediation occurred on the campus since then? No additional environmental investigation or remediation has occurred on the campus since the Phase 2 ESA was conducted in 2019. Are there any open regulatory cases with MT DNRC or MT DEQ? No open regulatory cases with MT DNRC or MT DEQ.
31. Were any PCB-containing electrical transformers or capacitors identified during the 2019 abatement? Are any still on site? Per Phase I Environmental Site Assessment, the eight pad-mounted transformers, owned and serviced by Montana-Dakota Utilities, were observed throughout the site. The transformers have been tested for PCBs and PCBs were not found. Some transformers contain mineral oil which may contain PCBs. While these transformers do not presently contain PCBs, historically the transformers may have contained PCBs. Montana-Dakota Utilities maintains responsibility for the transformers, and if the transformers were “PCB contaminated,” Montana-Dakota Utilities is not required to replace the transformer fluids until a release is identified. However, evidence of current or prior releases was not observed in the vicinity of the electrical equipment during the site reconnaissance.
32. Are there any known or suspected areas of fill soil, buried debris, or prior demolition material on the 14.5-acre site? – There are not known or suspected areas of fill soil, buried debris, or prior demolition material on the 14.5-acre site.
33. Have any of the site utilities already been disconnected or capped? If so, which ones? No site utilities have been disconnected.
34. Who are the utility providers for gas, electric, water, and sewer serving this campus? Water & Sewer - City of Miles City. Gas & Electric - Montana-Dakota Utilities. Has the VA already initiated disconnection requests with any of them? No disconnection requests have been submitted for any of the utilities.
35. Is the electrical service fed from a VA-owned transformer or a utility-owned transformer? This determines who is responsible for removal.
The eight pad-mounted transformers are owned and serviced by Montana-Dakota Utilities.
36. Are there any active utilities (water, sewer, electrical) that must remain live and in service for any portion of the POP — for example, to serve adjacent VA facilities or the street? Yes, depending on exact start date some of the buildings will still be used by VA staff & patients. Utilities for those buildings shall remain active until complete move to new Nursing Home (Dec 2026 / Jan 2027). A phase plan is required after contract award and before Notice to Proceed (NTP) will be given. Even with an approved performance schedule/phase plan approval to demo specific buildings/areas shall be granted by the COR or CO.
37. What is the firm or committed date for the Nursing Home (Building 15) operations to transition off-campus? "Tentatively October 2026" creates significant schedule and pricing risk for the prime. An exact (firm) date cannot be provided at this time. Construction of the new nursing home is scheduled for completion October 2026, then relocation of equipment. We estimate Dec 2026 / Jan 2027 for complete transition. It is the VA’s intention to keep the contractor working on smaller buildings first, until complete relocation of nursing home.
38. If the Nursing Home transition is delayed beyond October 2026, will the government grant a no-cost time extension to the POP? Will delay damages apply? Yes, a no-cost time extension to the POP (period of performance) will be granted. Any “delay damages” will be a case-by-case basis depending on exact circumstances.
39. Once the Nursing Home vacates, will the Government provide written notice to the prime to proceed with demolition of Buildings 1 and 15, or is a separate NTP issued? A single Notice to Proceed will be issued. Contractor shall provide COR with performance schedule that includes phasing of each demolition building/area. Even with an approved performance schedule/phase plan approval to demo specific buildings/areas shall be granted by the COR or CO. See Deliverables 7.0 within SOW.
40. Will the prime have 24/7 site access, or are work hours restricted (e.g., weekday daylight only)? Prime will have 24/7 site access. County might have restriction on hours of operation due to noise. Contractor will be responsible for investigating requirements for noise disruption within the community.
41. Is there a designated staging area and laydown yard for contractor equipment and materials? What is the approximate size and location? No designated staging area identified at this time. Contractor to determine and submit location to COR for approval.
42. What haul routes are approved or preferred for debris trucks leaving the site? Are there any weight-restricted roads or school zones to avoid? Location of disposal site, length of haul, weight restricted roads, and/or school zones shall be the Contractor's responsibility.
43. Are there any active VA operations, neighboring facilities, or occupied buildings adjacent to the demolition site that require noise, dust, or vibration restrictions? There is a residential area adjacent to the VA campus. Noise, dust, or vibration restrictions might apply. It is the Contractor’s responsibility to determine.
44. Is the site fully fenced, or will the contractor be required to install a full perimeter fence as part of the work? Contractor will be required to install a full perimeter fence as part of the work.
45. Is there a preferred or VA-approved landfill or recycling facility for demolition debris in the Miles City area? Location of disposal site and length of haul shall be the Contractor's responsibility. Contractor is responsible for all coordination with selected disposal facilities.
46. The SOW requires a 50% diversion rate — is this a hard contractual requirement with a penalty, or a goal? How will compliance be measured and documented? It is a goal. Per SOW, unless state or local regulations require a higher percentage, the Contractor should strive to achieve end-of-project diversion (recycling non-hazardous construction and demolition waste) rate / goal of 50 percent by weight of total non-hazardous solid waste generated by the work and practice efficient waste management in the use of materials in the course of the work. Contractor shall use all reasonable means to divert construction and demolition waste from landfills and incinerators. It will be documented by reviewing the Manifests for Disposal of Materials (Deliverable).
Here is an example:
For a demolition project, proper documentation and management of manifests for disposal of materials is critical to ensure compliance with local, state, and federal regulations—especially when handling hazardous or regulated waste. Here’s how you typically document manifests for disposal:
1. Identify Types of Waste Segregate materials: Separate hazardous waste (asbestos, lead, PCB, etc.), non-hazardous construction & demolition (C&D) debris, recyclable materials, and universal wastes.
Characterize waste: Based on local/state/federal regulations (e.g., Resource Conservation and Recovery Act [RCRA]) and laboratory analysis as needed.
2. Use the Correct Manifests A. Hazardous Waste:
Use the EPA Uniform Hazardous Waste Manifest (form 8700-22).
Required for any hazardous waste leaving the site.
B. Non-Hazardous Waste / C&D Debris:
Some states require tracking forms or manifests for large quantities—even for non-hazardous waste. Landfills and recycling facilities may provide their own receipt or manifest.
C. Special Waste: Items like asbestos, batteries, fluorescent bulbs, etc., require specific disposal documentation (accompanying paperwork/manifests).
3. Complete Manifest Forms For each waste shipment:
Generator Information: (the demolition site) Name, address, EPA ID (if applicable) Transporter Information: Company name, license number, contact info Waste Description: Type, quantity, containers, waste codes Destination Facility: Name, address, permit number Signatures: Generator, transporter, and receiving facility must all sign Dates: Date of shipment, date received Tracking Number: Each manifest has a unique ID
4. Retain Documentation Keep copies of all signed manifests, receipts, bills of lading for at least 3 years (federal minimum); longer if state law requires.
Update project waste log with waste streams, quantities, dates, destinations, and manifest numbers.
File with project records and make available for inspection as required by regulations or per contract.
5. Reconcile & Finalize Ensure you receive signed copies back from receiving facilities (confirming proper acceptance and disposal/recycling).
Retain these final, fully executed manifests as proof of compliance.
6. Reporting Some projects require annual waste reports (e.g., to the EPA or the state environmental agency).
Summarize manifest info: quantities, destinations, recycling rates, etc.
Example Table Entry for Waste Manifest Log:
| Date | Manifest Number | Waste Type | Quantity | Transporter | Destination | Notes |
| 6/1/2024 | 0023421 | Asbestos | 2,000 lbs | XYZ Trucking | ABC Landfill | Asbestos Manifest attached |
| 6/2/2024 | -- | Mixed C&D | 5 tons | DEF Hauling | City Transfer | Disposal ticket attached |
47. What is the disposal requirement for the diesel fuel in the three USTs? Can it be returned to the VA, or must the contractor arrange licensed disposal? Fuel disposal is the responsibility of the Contractor. Fuel can be salvaged and used by the Contractor once the ENTIRE facility has been released for demolition or disposed of at the Contractor’s discretion by a licensed professional.
48. Is this a firm fixed-price lump sum contract, or will any elements be priced as unit-price line items with quantity adjustments? The government intends to award a firm-fixed-price contract. Progress payments approved as job progresses.
49. Will the government provide a government cost estimate or any budget guidance prior to proposal submission? No, no cost estimate or budget guidance will be provided. Please see question 6 for project magnitude.
50. Is there a bid bond requirement, and if so, what percentage? The solicitation references FAR 52.228-1 but does not state the required percentage. Please see answer to question 9. RFO 52.228-1 is provided in full text with this amendment, see attached.
51. Will there be any option periods or the possibility of additional scope beyond the base demolition? No, there is only 1 line item. The government only intends to award the base bid as indicated by line item 0001 in the solicitation. At this time, there are no option periods or any additional scope anticipated beyond the scope indicated in the statement of work.
52. Will there be any option periods or the possibility of additional scope beyond the base demolition? There is only 1 line item. The government only intends to award the base bid as indicated by line item 0001 in the solicitation. At this time, there are no option periods or any additional scope anticipated beyond the scope indicated in the statement of work.
53. Is this solicitation open to 236220? No. As per Section B.1 Price/Cost Schedule of the solicitation, the NAICS code is 238910 - Site Preparation Contractors.
54. We respectfully request consideration of revising the solicitation to a 236-series NAICS code, which carries a $45 million size standard. NAICS code shall remain as 238910 - Site Preparation Contractors. NAICS code shall remain as 238910 - Site Preparation Contractors.
55. The Statement of Work indicates that foundations are to be demolished to one foot below grade “except for piles.” Please confirm:
a. Do any buildings contain driven piles or deep foundations? Both, Please reference as-builts. Bldg. 1 has deep foundations and pile footings.
b. Is pile removal explicitly excluded from the scope of work? Yes, unless they are one foot above existing basement soil elevations.
c. If pile removal is excluded, please identify known locations. Refer to the as-built drawings.
56. Please clarify whether demolition of sidewalks, paved areas, and asphalt parking surfaces is required only where directly associated with demolished structures, or across the entire campus.

There is one temporarily out of use fiberglass reinforced plastic 2,000-gallon diesel UST with double-walled steel piping and release detection located adjacent to the north of Building 10.
116. In the SOW it states that the foundations are to be taken down to 1-foot BGS, do the basement floors get fractured for drainage and backfilled? If basement floors will not be entirely removed (i.e., they remain in place, but below 1' BGS), best practice and environmental regulations require that they be fractured or perforated for proper drainage and to avoid perched water.
After fracturing, these slabs are typically backfilled with clean soil or aggregate up to final grade. If a slab is left in place below the removed structure, it should be fractured/perforated, and the site should be backfilled to promote proper drainage, settlement, and to prevent future land-use issues.
117. Where is the friable backfill intended for use? Refer to Specifications SECTION 31 20 11 “EARTHWORK.” After demolition, disturbed areas shall be leveled with friable topsoil which shall be placed and spread to the height of the surrounding area.
118. Is there a specific soil spec for backfill material/ topsoil for site restoration? Specifications Sections 32 91 13 Soil Preparation and 32 05 33 “Common Work Results for Landscaping” are relevant specs.
“Topsoil shall be natural, fertile, friable soil typical to the locality, capable of sustaining healthy plant growth, free of subsoil, debris, toxic substances, and stones over one inch in diameter.”
