The aggregate value of this Multiple Award Task Order Contract (MATOC) acquisition shall not exceed $500,000,000.00 for all contracts.
The government contemplates award to two (2) or more but not-to-exceed fifteen (15) offerors, and shall reserve the right to make additional awards to offerors whose proposals fully comply with the submission instructions and offer the best value. The period of performance (POP) for all contracts resulting from this solicitation shall consist of a base period from date of award (to be determined) five-year maximum term.
The guaranteed minimum amount for each resultant award is $1,000.00 for the life of the contract, inclusive of options.
The MINIMUM ordering limit per task order is $2,000.00. The MAXIMUM ordering limit per task order is $20,000,000.00.
This acquisition shall be a 100% set-aside for Service-Disabled Veteran-Owned Small Businesses (SDVOSB) in accordance with Public Law 109-461. In accordance with VAAR 819.7003,offerors must be Center for Veterans Enterprise (CVE) verified SDVOSBs at the time of offer, at award, and through duration of any awarded contract and / or task order.
The applicable North American Industry Classification System (NAICS) code incorporated into this solicitation is 236220.
The small business size standard is $45,000,000.00.
This is a competitive acquisition that shall utilize a Tradeoff Process in accordance with FAR 15.101-1.
This acquisition features a "seed" project with a magnitudeIAW VAAR 836.204(f)(2) Between $2,000,000 and $5,000,000.
A bid bond in the amount of 20% of the $5,000,000.00 magnitude limit is required. ***NOTE: YOU MUST PARTICIPATE IN THE PROPOSAL PROCESS OF THE SEED PROJECT (Project #549-22-231) TO BE CONSIDERED AS AN AWARDEE FOR THE MATOC.***
A pre-proposal conference is scheduled for 05/07/2024, at 10:00 AM (CST) at the Dallas VA Medical Center 4500 S.
Lancaster Rd, Dallas, TX 75216. Detailed information, to include plans and specifications for the seed project shall be furnished via email. Offerors shall request these plansand specifications via email from Horacio.Fernandez@va.gov.

A.5 STATEMENT OF WORK
Multiple Award Task Order Contract Veterans Service Integrated Network 17
A. GENERAL INFORMATION
1. Title of Requirement: Multiple Award Task Order Contract (MATOC)
This procurement effort is for construction and two-phase design-build services at Veterans Integrated Service Network (VISN) 17 station locations including, but not limited to, North Texas Veterans Health Care System (NTX) Dallas, TX, , Central Texas Veterans Health Care System (CTX) Temple, TX, South Texas Veterans Health Care System (STX) San Antonio, TX, Valley Costal Bend Veterans Health Care System (VCB) Harlingen, TX, and all connected community based outpatient clinics (CBOCs). Contractors are expected to have the capability and qualifications to provide a wide array of construction services at locations specified.
The MATOC will require contractors to furnish all labor, materials, equipment, and expert supervision needed to accomplish the work in accordance with the Description/Specifications/Statement of Work provided with each task order under the assigned North American Industry Classification System (NAICS) code. Task Orders (TO) will vary in size and dollar amounts. TOs shall include, but are not limited to general construction categories which include maintenance, repair, alteration, mechanical, electrical, heating/air conditioning, demolition, painting, paving and earthwork, carpentry, concrete, roofing, site work, excavation, interior renovation, carpet-window and door installation, electrical, steam fitting, plumbing, exterior and interior painting, plaster/stucco, demolition, masonry or metal stud and sheetrock work, installation of acoustical ceilings and light fixtures, HVAC installation and flooring installation. Work may involve some or all the above elements of work.
2. This requirement consists of establishing a MATOC resulting the award of two (2) or more Indefinite-Delivery Indefinite-Quantity (IDIQ) contracts with each IDIQ contract having a base period of five (5) years. These awardees will then be eligible to submit proposals in response to solicitations issued to the MATOC contractors. General construction requirements are delineated in the project specifications for the IDIQ contract and supplemented by individual TOs. The contractors shall provide all resources necessary to accomplish the deliverables described in this Statement of Work (SOW) and TO specific SOWs, specifications, and project drawings except as may otherwise be specified.
3. The period of performance for the MATOC IDIQ contract will have a five-year base period. The total guaranteed minimum quantity of service that the Government will acquire under the IDIQ contract is $2,000.00, which also represents a bona fide need of the current fiscal year. The guaranteed minimum award amount is for the entire contract duration. Firm‐fixed price TO will be negotiated for this contract. The MATOC TOs shall have a minimum value of $2,000.00 and a maximum value of $20,000,000.00 and no dollar limit per year up to a cumulative (all IDIQs inclusive) maximum of $500,000,000.00 for the entire MATOC IDIQ contract term.
Task orders shall have defined periods of performance. Funded TOs shall have a separate Notice to Proceed (NTP) issued to commence construction activities.

The MATOC is a competitive Indefinite Delivery/Indefinite Quantity (ID/IQ) construction and two-phase design build acquisition based on general specifications contained in the Statement of Work (SOW) within each Task Order. Work to be performed shall consist of, but not be limited to, all phases of general construction, alteration, maintenance and repair of commercial and institutional buildings including mechanical, electrical, heating/air conditioning, demolition, painting, paving and earthwork, carpentry, concrete, roofing, site work, excavation, interior renovation, carpet/window/door installation, electrical, steam fitting, plumbing, exterior/interior painting, plaster/stucco, demolition, masonry or metal stud and sheetrock work, installation of acoustical ceilings and light fixtures, HVAC/Flooring installation, and other commercial and institutional construction related work required to support the Department of Veterans Affairs Medical Facilities in VISN 17.
4. Hours of Work and Scheduling: All work will be done during the normal work week Monday through Friday, except holidays, 7:00 AM to 4:30 PM unless otherwise scheduled, or identified in the TO SOW. Work will be scheduled through the Contracting Officer’s Representative (COR). Any contractor request to work outside the normal hours will be requested from the COR at least 48-hours in advance.

Note: Any of the above holidays falling on Saturday will be observed on the preceding Friday; holidays falling on Sunday will be observed on the following Monday. Contractor’s days to perform are reflected in the Performance Work Statement/Statement of Work.
B. CONTRACT AWARD MEETING
The contractor shall not commence performance on the tasks in the MATOC contract or for each subsequently issued TO SOW until the CO has conducted a kickoff meeting or has advised the contractor that a kickoff meeting is waived.
C. GENERAL REQUIREMENTS
1. All written deliverables shall be phrased in layperson language. Statistical and other technical terminology shall not be used without providing a glossary of terms.
2. Where a written milestone deliverable is required in draft form, the VA will complete their review of the draft deliverable within 10-business days from the date of receipt. The contractor shall have 7-business days to deliver the final deliverable from date of receipt of the Government’s comments.
D. SPECIFIC MANDATORY TASKS AND ASSOCIATED DELIVERABLES
1. Description of Tasks and Associated Deliverables: The MATOC contractor(s) shall be responsible for the construction (including new work, additions, alterations, maintenance, and repairs) of commercial and institutional related structures. The primary NAICS code for the MATOC award is 236220 Commercial and Institutional Building Construction. NAICS Code 236220 has a Small Business Size Standard of $45M.
2. All work described above shall be completed in accordance with the drawings and specifications for the individual task order projects.
E. SCHEDULE FOR DELIVERABLES
1. The contract requires that the MATOC contractors submit, within ten (10) calendar days of NTP for each awarded TO, a schedule showing the order in which the work will be performed under the TO, including but not limited to, manpower and trade. The actual work elements to be accomplished will be recorded on the schedule. Develop schedule using the Critical Path Method (CPM), FAR 52.236-15 Schedules for Construction Contracts. The schedule will be submitted to the CO through the COR for approval.
2. In the event the contract is modified, changing the work, adding, or deleting work, or changing the completion date, a revised schedule will be submitted.
F. CHANGES TO STATEMENT OF WORK
Any changes to this SOW shall be authorized and approved only through written modifications to the TO by the CO. A copy of each modification will be kept in a project folder along with all other products of the project. Costs incurred by the contractor through the actions of parties other than the CO shall be borne by the contractor. Any discrepancy between the IDIQ contract or TO SOWs drawings and specifications, the specifications shall govern over the drawings and SOW, and the drawings shall govern over the SOW.
G. REPORTING REQUIREMENTS
1. The contractor shall provide the COR with daily written progress reports (daily logs). These are due to the COR by the second workday following the end of each work week, throughout the TOs project duration.
2.The Contractor or Superintendent shall attend a weekly or bi-weekly meeting that will be conducted by the CO and COR as required by TO. The purpose of this meeting is to review the progress of the project and outstanding issues. Meeting notes will be taken by the Contractor and provided to the COR and CO.
3. The COR is required to provide quarterly progress reports to the CO by the fifth workday of the new quarter. This report shall also identify any problems that arose, along with a statement explaining how the problem was resolved. This report shall also identify any problems that have arisen but have not been completely resolved, with an explanation.
H. TRAVEL
Contractor shall be responsible for their travel costs, as well as all subcontractors.
I. GOVERNMENT FURNISHED PPOPERTY/EQUIPMENT (GFP/GFE)
The IDIQ contract does not have any GFP/GFE pre-designated for provision on a temporary or permanent basis to MATOC contractors. As each subsequently developed project requiring a task order is finalized Government shall evaluate its need to furnish any GFP/GPE.
J. CONTRACTOR EXPERIENCE REQUIREMENTS
1. The contractor must inform the task order project COR when personnel are removed from the contract for any reason.
2. If a key person becomes unavailable to complete the contract, proposed substitutions of key personnel shall be made to the COR and CO.
3. Contractor employees shall not be considered government employees for any purpose under this contract.
K. CONFIDENTIALITY AND NONDISCLOSURE
1. The preliminary and final deliverables, and all associated working papers, application source code, and other material deemed relevant by VA which have been generated by the contractor in the performance of this contract and subsequently issued TOs, are the exclusive property of the U.S. Government and shall be submitted to the CO at the conclusion of the contract.
2. The CO will be the sole authorized official to release, verbally or in writing, any data, draft deliverables, final deliverables, or any other written or printed materials pertaining to this contract or subsequently issued TOs. No information shall be released by the contractor(s). Any request for information relating to this contract or its subsequently issued TOs, presented to the contractor, shall be submitted to the CO for response.
3. Press releases, marketing material, or any other printed or electronic documentation related to this project, shall not be publicized without the written approval of the CO.
L. CONTRACTOR WORK SITE EMPLOYEE ACCESS/BEHAVIOR
1. Contractor personnel shall present a neat appearance and be easily recognized as contractor employees. Example: wearing of distinctive clothing such as uniform, badges, patches, etc.
2. All contractor personnel working onsite at the VA facility shall check in and out with the VA Police of the respective VA facility. All security/access issues shall be addressed by the Onsite Contractor Project Manager. The Project Manager shall provide the Agency a list of all employees requiring access to Agency space. All contracted personnel must complete any required security checks and obtain an Agency security badge for access to all spaces. All contracted personnel are required to wear identification (I.D.) badges issued by the VA Police always on the Agency’s grounds. Contract employees shall always wear contractor badge, so it is visible to VA staff members.
3. The contractor shall be fully responsible for compliance with all VA, local, state, and Federal environmental/occupational safety laws, rules, and regulations. The contractor shall follow life and safety codes and take necessary actions to avoid conditions that may be hazardous to the health and safety of hospital personnel, patients, and contract employees. The contractor is responsible for meeting all applicable OSHA and VA guidelines for safe working processes; example: lockout/tagout. All work for the duration of the contract and individually issued task order shall be performed by certified trained technicians.
4. It is the responsibility of the Contractor’s personnel to park in the appropriate designated parking areas when parking areas are designated by the VA. Parking information is available from the Agency’s police station. The Agency shall not validate or make reimbursement for parking violation of the Contractor’s personnel under any circumstances.
M. TASK ORDER ISSUANCE PROCEDURES
1. GENERAL
a. When the Government has a need for an order, the Government will issue a solicitation using the procedures outlined in FAR 16, but may employ the procedures of FAR 13, 14 or 15 as deemed necessary. If the TO will include design build services, the solicitation will be issued using the procedures outlined in FAR Subpart 36.3 - Two-Phase Design-Build Selection Procedures. Selection onto the MATOC IDIQ constitutes phase 1 of the solicitation. The TO solicitation is phase two of the two-phase procedure.
b. TOs will be awarded on Standard Form 1442.
c. The Government will not be obligated to reimburse the contractor for work performed, items delivered, or any costs incurred, nor shall the contractor be obligated to perform, deliver, or otherwise incur costs, except as authorized by duly executed TOs.
d. Each TO shall include as a minimum:
(i) Date of order.
(ii) Contract number and order number.
(iii) Contract item number and description, quantity, and unit price or estimated cost.
(iv) Delivery or performance schedule.
(v) Place of performance.
(vi) Any packaging, packing, and shipping instructions.
(vii) Accounting and appropriation data.
(viii) Method of payment and payment office.
e. Modifications to TOs will be issued on Standard Form (SF) 30.
f. MATOC contractors are expected to have the capacity and qualifications to meet a wide array of construction projects in all the identified locations. Each MATOC contractor is required to make a good faith effort to submit offers on all solicitations. MATOC contractors are required to contact the CO within two days of notification if they cannot participate in the walk through or submit an offer and shall provide justification for not participating.
g. In accordance with FAR 16.505(a)(10), no protest under Subpart 33.1 is authorized in connection with the issuance or proposed issuance of an order under a TO Contract except for a protest on the grounds that the order increases the scope, period, or maximum value of the contract; or a protest of an order valued more than $10,000,000.
2. COMPETITION
a. Competition for issuance of TOs is limited to those awardees under this contract. All awardees will be given a fair opportunity to be considered for each TO unless the CO applies one of the exceptions noted below. Upon determining the need to issue a TO, all awardees will be considered equally against the stated criteria.
b. Unless one of the exceptions noted below applies, each TO will be awarded, because of competition to the contractor whose offer is the most advantageous to the Government considering the criteria specified.
c. The CO reserves the right to make award of a TO without competition based upon:
(1) One of the circumstances described below:
i. The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
ii. Only one awardee can provide the supplies or services at the level of quality required because the supplies or services ordered are unique or highly specialized.
iii. The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
iv. It is necessary to place an order to satisfy a minimum guarantee.

-- Services --
Provide:
1. Professional construction services to include but not limited to:
a. Site investigation – assess property for demolition, civil work, mechanical work, electrical work, grading, excavation, layout planning, construction.
b. Convert approximately 12,000+ sq. ft. in sections A, C, and D in building 71 into Veteran Service Organization (VSO) ready areas. The section 71A will be occupied by Mental health, section 71C-A will be Hotdesking, 71C-B by Texas Veteran Commission (TVC) and building 71D by Disabled American Veterans (DAV). Section 71B called Methadone is not part of scope of work.
The building is experiencing different water penetration issues both from underground and from the roof.
The project shall be done in phasing because the Mental Healthcare people working in section 71A will still occupy the building during the construction.
The existing flat roof over 71B will be removed and replaced with a pitched roof. The pitched roof will comprise of wood trusses spanning between the existing load bearing walls. The new roof will be enclosed with plywood. The valleys between the existing roofs and the new roof are framed to provide slope for drainage. The existing load bearing walls are used to support the new roof trusses.

GENERAL:
4. Dallas VAMC intends to issue a construction service contract. The project consists of:
a. The Contractor shall provide all labor, transportation, materials, equipment, and supervision required to renovate the Bldg. 71 according to the design and specifications as required by the Dallas VA Healthcare System, located at 4500 S Lancaster Rd, Dallas, TX, 75216.
SPECIFICS:
5. Architecture.
a. The Contractor shall demo the existing spaces according to demo plan and provide new layout outlined in new construction drawings and specifications.
b. Contractor shall provide The Americans with Disabilities Act (ADA) compliant ramps on each entrance of building according to design.
c. Contractor shall construct the new roof structure over existing roof according to the design.
6. Mechanical.
a. Contractor shall procure and carefully replace 9 existing Air Handling Units (AHUs) and turn in the existing AHUs and ancillary parts to VA for alternate use. Contractor shall make full effort to remove existing AHUs without damaging and handle carefully to avoid damage to any of the parts.
b. Contractor shall provide new AHUs for section C and D per the design.
c. Contractor shall secure the existing ducting indicated to keep for reuse in demo plans and install new ducting per the new design.
d. Contractor shall procure and install the selected or similar AHUs in project book to meet the design criteria.
7. Electrical
a. Contractor shall evaluate existing conditions and protect existing lighting controls and switches during construction and re-use controls in new lighting scope.
b. Contractor shall provide new Ground Fault Circuit Interrupter (GFCI) receptacles per design.
c. Contractor shall provide new electrical lines to new mechanical/plumbing and electrical equipment per the specifications and design.
d. Contractor shall provide new power, voice/data outlets in all areas per design and specifications.
e. Provide power to new HVAC equipment and fan coil units and provide new panel using 250A braker from existing distribution board DP-71A per design.
8. Plumbing
a. Contractor shall demo and remodel per the design and specifications.
9. Structural
a. Contractor shall remove the existing flat roof over 71B area and replace with pitched roof.
b. Contractor shall provide new pitched roof per the design and specifications.
10. Additional responsibilities.
a. The Contractor shall use environmentally friendly products whenever possible.
b. The Contractor shall provide a daily report any day that they work for the duration of the project. Daily report shall have details of man hours, personnel/sub and detail of work performed at the least.
c. The Contractor shall only use products suitable for the job conditions. Manufacturer’s instructions and recommendations shall be followed for all products used.
d. The Contractor shall adhere to all safety control measures while performing work.
e. The Contractor shall be responsible to maintain and upkeep their staging area.
f. The Contractor shall provide their own dumpster and dispose of all damaged items, removed items, and debris created from the construction and demolition in every aspect of this project.
Other Specifics:
11. Contractor will submit before and after pictures of the area and building.
12. Contractor will submit picture in between each phase (e.g., digging trenches to install cables, installing fixtures, paving, demo of electrical/plumbing and roof etc.).
13. Contractor will ensure value engineering is included in this project to maintain approved budget.
14. Contractor will submit revised project schedule with each invoice.

Expectation: Contractors will make site visits as necessary to survey existing conditions.
15. Make site visit as required to determine existing as-built conditions affecting this project.
a. Provide any structural, architectural, electrical, and mechanical investigation work of existing area necessary to ensure the accuracy of the design.

Specification: The VA Master Construction Specification contains work procedures and material requirements designed to meet regulatory compliance requirements. Whenever possible, the Master Construction Specification must be used as the basis for the project designs.

18. Work is to be performed on Monday to Friday at 9:00AM - 4:30PM. Contractor access will be provided during this time, except special federal holidays unless discussed and approved by the COR ahead of time. Weekend work is not approved unless previously discussed and authorized by COR.
Deliverables:
19. The Contractor will submit a daily log, sign-in sheet, pictures, work performed each time services is rendered.
20. The Contractor shall submit a report for each shipment of construction debris, the weight by type, shipment date, destination, and whether the debris is to be recycled/reclaimed or disposed to the COR. Types include asphalt, concrete, lumber, metal, dry wall, etc.

Contractor Personnel:
21. The Contractor shall be responsible for employing qualified personnel to perform the work specified in this SOW. The Contractor shall make sure that subcontractor and employees have proper documentation to authorize personnel to work in the United States of America. The Contractor shall maintain the personnel, organization, and administrative control necessary to ensure that the work delivered meets the contract specifications and requirements.
22. The Contractor is required that all subcontractor or employees have been screen by the Dallas VAMC Healthcare System. All personnel are required to wear a VA government furnished badge. All contractor and subcontractor are required to wear a government and company furnish badge while performing services under this contract. The badge will contain a personal picture, name of employee, and Contractor's name. Badges shall be worn on the outer garment attached to the outer shirt or jacket pocket by a button or clip or worn around the neck secured by an appropriate identification card lanyard.
23. Government issued identification badge remains the property of the Government and shall be returned to the issuing office or other designated Government personnel upon transfer of Contractor employees from the contract.
24. The contractor shall insure that employee or subcontractor have valid driver license when driving a vehicle on property.
Management:
25. All information generated in performance of this contract becomes property of the Government and must be surrendered upon request and/or completion of the contract. The Contractor must protect against the destruction and/or misplacement of all information produced under this contract, unless directed under local policy to destroy. This includes both hard and soft copies of data.
26. The Contractor shall not release any information (including photographs, files, public announcements, statements, denials, or confirmations) on any part of the subject matter of this contract or any phase of any program hereunder without the prior written approval of the COR.
27. Contractor personnel or subcontractor shall conduct themselves in a professional manner (i.e., timeliness, communication; spoken and written etc.). The CO may require the Contractor to remove from the job site any employee working under this contract for reasons of suspected misconduct, a suspected security breach, or suspected to be under the influence of alcohol, drugs, or any other incapacitating agent. Contractor employees shall be subject to dismissal from the premises upon determination by the CO that such action is necessary in the interests of the Government. The hospital director or designated representative has the authority to bar individuals from the Government facility. The removal from the job site or dismissal from the premises shall not relieve the Contractor of the requirement to provide sufficient personnel to perform the services as required by this performance work statement. The Government shall not reimburse the Contractor for travel and other expenses associated with the removal of personnel.
28. Contractor personnel are not authorized to carry or possess personal weapons to include, but not limited to, firearms and knives with a blade length more than three inches, while assigned under this contract.
Safety/Security Requirements:
29. The Contractor shall comply with all applicable federal, state, and local laws and ensure performance is secure while protecting material, equipment, and supplies from damage and loss. The Contractor shall ensure that employees or subcontractor have the proper Personal Protective Equipment (PPE) for the job. Government security personnel shall have the express right to inspect for security violations at any time during the term of the contract.
30. All work performed under this contract will be in accordance with VHA Directive 7715(1), Safety and Health During Construction Activities Policy 138-80-16 (7715(1)_D_2023-06-22.pdf). Provide a written certified statement indicating that the construction project meets the life safety code requirements. For those maintenance and repair projects where the life / safety code requirements are not applicable, a written statement shall also be provided accordingly.
31. The Dallas VAMC Safety Officer and COR shall have full authority to see that the contractor obeys all safety rules and regulations relative to the fulfillment of this contract.
32. Provide all necessary barricades / signage where required.
33. Isolate the area to prevent the spread of debris into adjacent space and maintain the area negatively pressurized when required.
34. See Appendix A for additional requirements.
Work Attire and Appearance:
35. Contractor personnel shall present a professional appearance commensurate with standards delineated for Government civilian personnel acting in similar capacities.
Personnel Qualification:
36. The Contractor shall be responsible for employing technically qualified personnel to perform the work specified in this SOW and authorized to work in the United States. The Contractor shall maintain the personnel, organization, and administrative control necessary to ensure that the work delivered meets the contract specifications and requirements. The work history of each contractor employee must contain experience directly related to the task and functions he/she is intended to perform under this contract. The Government reserves the right, during the life of the resulting contract, to request work histories on any contractor employee for the purposes of verifying compliance with the above requirements; additionally, the Government reserves the right to review resumes of contractor personnel proposed to be assigned. Personnel assigned to, or utilized by, the Contractor in performance of work shall be fully capable of performing the requirements contained in the SOW in an efficient, reliable, and professional manner.
37. Contractor shall provide an on-site supervisor who speaks English.
38. Personnel should be properly trained for safety and performance of their respective duties.
39. Appropriate safety equipment shall be furnished by the Contractor-to-contractor personnel or subcontractor and shall be used as prescribed by OSHA Standards.
40. The Government reserves the right to review Contractor personnel qualifications. Upon request, resume shall be provided to the CO prior to clearance approval, for review and acceptance by the COR. The intent is verification purpose and not for the Government to become the hiring authority.
41. Contractor and all contractor employees must have taken the OSHA Certified 30/10-hour construction safety course and show documented proof. The contractor shall designate a “competent person” in accordance with 29 CFR 1926. 32(f) which states, “One who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous or dangerous to employees and who has authorization to take prompt corrective measures to eliminate them”. The contractor shall instruct each of his employees in the recognition and avoidance of unsafe conditions and the regulations applicable to this work environment to control or eliminate any hazards or other exposure to illness or injury.
Non-Personal Service Statement:
42. Contractor employees performing services under this order will be controlled, directed, and always supervised by management personnel of the contractor. Contractor management will ensure that employees properly comply with the performance work standards outlined in the SOW. Contractor employees will perform their duties independent of, and without the supervision of, any Government official. The tasks, duties, and responsibilities set forth in the contract may not be interpreted or implemented in any manner that results in any contractor employee creating or modifying Federal policy, obligating the appropriated funds of the United States Government, overseeing the work of Federal employees, providing direct personal services to any Federal employee, or otherwise violating the prohibitions set forth in Parts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). The Government will control access to the facility and will perform the inspection and acceptance of the completed work.
-- Damages/Insurance --
Damages:
43. The Contractor is liable for all damages to Government equipment, property; utilities, etc., located at the site (e.g., sprinkler heads, ceiling tiles, manholes, fire hydrants, vehicles, windows, etc.) caused by the Contractor, its employees, or its subcontractors. The Contractor shall immediately report all damages to the COR and shall provide the CO and COR, a written report, within 24 hrs. The report shall include What occurred, who was involved, when it occurred (Time/Date), where did it occur, why it occurred, how it occurred, and the proposed means to repair or replace.
44. Contractor is to maintain free and unobstructed access to facility emergency services and for fire, police, and other emergency response forces in accordance with NFPA 241.
Appendix A
North Texas VA Health Care Systems Construction Safety Accident Prevention Plan Requirements
Prior to commencing work contractors must submit for approval Accident Prevention Plan. The prime contractor will write this plan for the specific work and hazards of the contract and implementing in detail the requirements for safety and occupational health. This plan shall be reviewed and found acceptable by Government personnel prior to initiation of work at the job site. The plan shall be developed by qualified personnel and shall be signed by a competent person AND a representative of management.
The prime contractor shall integrate all subcontractor work activities into the Safety and health Program, make the program available to all contractor and subcontractor employees and ensure all subcontractors integrate the provisions of the plan into their work activities.
The prime contractor shall integrate in their safety plan a requirement that all subcontractor lead personnel attend a onetime facility construction safety orientation.
