About this file

This document is a Request for Proposals (RFP) for a federal contract opportunity to expand the sterile processing service space at the Department of Veterans Affairs Kansas City VA Medical Center.

The RFP seeks proposals for a firm fixed-price contract to perform construction work on this project, with an extended proposal due date of November 1, 2024. The contract will be awarded using a best value tradeoff source selection process, with technical factors like past performance, experience, qualifications, safety, and quality management being significantly more important than price. Key technical requirements include meeting sterile processing specifications for mechanical, plumbing, and electrical systems, as well as coordination with ongoing medical center operations. Interested offerors must provide detailed technical and pricing proposals addressing the stated evaluation criteria. Subcontractor qualifications are also a critical factor, particularly for the mechanical/HVAC work.

As part of making the assessment, a best value analysis will be performed determining whether exceeding the minimum requirements at an associated price provides the best value to the Government.

As a basis for award, trade-offs between price and non-price factors are permitted. THEREFORE, THE

GOVERNMENT RESERVES THE RIGHT TO AWARD TO OTHER THAN THE LOWEST

PROPOSED PRICE. However, the degree of importance of price as a factor in determining award could become greater depending upon the equality of the offers evaluated in the non- price factors. The greater the equality of offers within the non- price factors, the more important price becomes in selecting the best value to the Government.

Award for all the work. The Government intends to award one firm fixed price contract as a result of this solicitation. Offers received for less than the stated number of items listed in the schedule will be considered ineligible for award. The Government intends to evaluate offers and award a contract without discussions with offerors; therefore, the offeror’s initial offer should contain the offeror’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

6. Special Contract Requirements:

a. Special Note regarding FAR 52.229-3: Federal, State and Local Taxes:

Offerors are hereby notified that all state and local sales or use taxes for construction materials must be included in their bid or proposal price. It is solely the responsibility of the offeror to include all other applicable taxes in their bid or proposal price as well. The Government has determined that for this acquisition it cannot take advantage of any sales or use tax exemptions that may be available to it under applicable state law. Under no circumstances will any Contractor be designated as an agent of the Government for purposes of any tax exemption, nor will the Government authorize any Contractor’s use of any tax exemption directly applicable to the Government under this procurement.

A price change request upon award relating to the inclusion of state and local sales or use taxes will not be accepted.

b. SUBSTITUTIONS OF SUBCONTRACTORS AND / OR KEY PERSONNEL

When an offeror submits its proposal in response to this Request for Proposals, and key personnel who are proposed to work on the project are required to be submitted, those personnel who are offered must be the same personnel who will actually perform on the project. If, during performance of the contract, it becomes necessary for the contractor to substitute personnel for one of those whose qualifications were the basis for evaluation of the offer and award of the contract, the contractor shall submit to the Contracting Officer the same information that was required in the initial proposal regarding the proposed substitute employee. The Contracting Officer shall have the right to review the qualifications of the proposed substitute employee and to approve or disapprove his or her qualifications. If the proposed substitute employee's qualifications are disapproved by the Contracting Officer, the contractor will propose another employee who does possess equivalent qualifications.

c. SAFETY OR ENVIRONMENTAL VIOLATIONS AND EXPERIENCE MODIFICATION

RATE:

All Bidders/Offerors shall submit the following information pertaining to their past Safety and Environmental record: see Appendix 2. Information shall contain, at a minimum, a certification that the bidder/offeror has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any EPA violation(s) in the past three years. Appendix 2 shall be submitted as part of Part 1, The Technical Proposal package.

All Bidders/Offerors shall submit information regarding their current Experience Modification Rate (EMR) equal to or less than 1.0. This information shall be obtained from the bidder’s/offeror’s insurance company and be furnished on the insurance carrier’s letterhead.

Self-insured contractors or other contractors that cannot provide their EMR rating on insurance letterhead must obtain a rating from the National Council on Compensation Insurance, Inc.

(NCCI) by completing/submitting form ERM-6 and providing the rating on letterhead from NCCI. Note: Self-insured contractors or other contractors that cannot provide EMR rating on insurance letterhead from the states or territories of CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR shall obtain their EMR rating from their state-run worker’s compensation insurance rating bureau.

A Determination of Responsibility/ Responsiveness will be accomplished for the apparent awardee prior to processing the award. The above information, along with other information obtained from Government systems, such as the OSHA and EPA online inspection history databases will be used to make the Determination of Responsibility/Responsiveness. Failure to affirm being within the guidelines above or failure to submit the required information will result in a determination of “Non-Responsibility” or “Non-Responsive” for the bidder/offeror. NOTE:

Any information received by the Government that would be cause for a negative Determination of Responsibility will make the bidder/offeror ineligible for award.

This requirement is applicable to all subcontracting tiers, and prospective prime contractors are responsible for determining the responsibility of their prospective subcontractors.

VA Project Number: 589-22-885 (Spur # 2205)

Supplemental Feedback per KCVA as numbered by above Spur Design’s Responses:

1. Please advise what phases/scopes will be required to be completed afterhours

KCVA: This applies when the area under construction is in or adjacent to a patient care area.

These areas include, but are not limited to: ICU’s, Audiology, Dental, ENT, Optometry/Ophthalmology, and Surgery/PAC (post-anesthesia care). Areas where this will likely be less of an issue is the basement and mechanical space on the 4th floor.

• Heavy, and Possibly Moderate, Demo – Walls, flooring, and any saw cutting/boring for thru-floor penetrations necessary for new MEP systems.

• Steel Erection – Welding, hammering members into place, drilling anchors into existing concrete, etc. This is amplified given the locations of steel members being erected, next to occupied spaces.

• Framing – Specifically, sill track where connections are shoot into the floor.

• Floor Prep – For any concrete prep that requires grinding/buffing/etc. to clean the concrete for flooring.

• MEP Connections – Shutdowns for any connections to adjacent systems.

• Fire Suppression – Drain downs of adjacent areas to connect new piping.

For any work that will cause elevated noise or vibrations in surrounding/adjacent spaces, note the information below:

• Quiet Hours Days/Times (<60 dB):

o Daily, 2000 (8:00 pm) until 0700 (7:00 am)

• Low Noise Days/Times (60-70 dB or up to 85* dB for less than 10 seconds):

o Daily, 0700-2000

• Moderate Noise Allowed Days/Times (70-80 dB or up to 85* dB for 10-20 seconds):

o Possibly 1200-1300, but will coordinate if we need to utilize this time o 1300-2000, after lunch until quiet hours o Weekends and Federal Holidays

• Elevated Noise Allowed Days/Times (>80 dB for more than 20 seconds):

o 1600-2000, after regular clinic hours until quiet hours o Possibly 1200-1400, but will coordinate if we need to utilize this time o Weekends and Federal Holidays

• Vibration Allowed Days/Times:

o 1600-2000, after regular clinic hours until quiet hours o Weekends and Federal Holidays

* Note: 85 dB is the threshold for starting to cause harm when exposed for 8+ hours, see NIOSH table below.
