EMSL maintains AIHA Environmental Lead Laboratory Accreditation Program (ELLAP) accreditation number 157245.

The analytical results indicate that white painted plaster walls in Restroom A260a contain 480 parts per million (ppm) lead (0.048% by weight), while tan painted drywall at the doorway of Room A224 showed no detectable lead above the analytical detection limit (<80 ppm). The report emphasizes that OSHA standard 29 CFR 1926.62 applies to any concentration of lead above the limit of detection, and contractors must be made aware of lead-containing surfaces to ensure compliance with applicable federal and state regulations and VA project specifications. The sampling was limited in scope to prominent, readily accessible painted surfaces likely to be impacted by the renovation and should not be assumed to represent all painted surfaces in the facility; untested surfaces must be presumed to contain lead unless laboratory analysis determines otherwise.

Terracon Consultants, Inc. (Terracon) appreciates the opportunity to submit this letter report to Levin Porter Associates Inc. (Client) regarding the lead analytical result for limited paint sampling for the above-referenced project at the Cincinnati VA Medical Center (CVAMC). We understand that this survey was requested for the purpose of a planned renovation regarding impacts to various chilled water supply and return lines at various locations throughout the hospital.

Terracon representatives Mr. Lemuel Weyer and Mr. Michael Sulken conducted the limited paint sampling on July 9, 2020. Sample collection was performed using a clean straight-edge razor to remove paint from designated surfaces. Collected paint samples were placed in sealable containers, labeled with unique sample numbers, and submitted under chain of custody to EMSL Analytical Inc. (EMSL) of Indianapolis, Indiana. Paint chip samples were submitted for analysis by Atomic Absorption Spectroscopy (AAS) per EPA Method SW846/3050B/7000B. EMSL is accredited for lead in paint analysis by the American Industrial Hygiene Association’s (AIHA®) Environmental Lead Laboratory Accreditation Program (ELLAP), accreditation number 157245.

Lead Paint Analytical Results Summary Given that most of the project work would appear unlikely to involve painted elements, Terracon only collected two (2) paint samples for lead-content analysis. These samples pertained to painted drywall (tan) and painted plaster (white) walls. The analytical results indicated that the white painted plaster walls contain 480 parts per million (ppm) lead and the tan painted drywall walls were none detected (above the analytical detection limit). If white painted plaster walls are impacted by the project, contractors should be aware and take the appropriate precautions to comply with OSHA regulations and VA project specifications.

Regulatory Summary Occupational Safety and Health Administration (OSHA) standard, 29 Code of Federal Regulations (CFR) 1926.62 (Lead in Construction), does not reference a specific concentration of lead in a surface coating for applicability of the aforementioned regulation. The requirements under OSHA 29 CFR 1926.62 are applicable to any concentration of lead found above analytical limit of detection (LOD). When disturbed, paints containing lead in any concentration represent an airborne exposure hazard that could exceed the OSHA legally enforceable action level (AL) or permissible exposure limit (PEL). Contractors that bid or conduct work activities that will disturb surfaces with analytically-confirmed lead-containing paint should be made aware of those so that they can plan for proper compliance with applicable federal and state regulations, and any applicable Client specifications. Additionally, contractors should be aware that any untested paint surfaces should be assumed to also contain lead unless sampling and analysis refute lead-content.

Closing This sampling event was conducted for project specific areas. The sampling was of a limited nature specific to prominent and readily accessible painted surfaces that may be impacted by renovation and may not have included every painted surface (any untested painted components must be assumed to contain lead unless sampled and laboratory analysis determines otherwise). The sampling was conducted in a manner consistent with the level of care and skill ordinarily exercised by members of the profession currently practicing under similar conditions in the same locale. The results, findings and recommendations expressed in this letter report are based on conditions observed during the sampling event. This letter report has been prepared on behalf of and exclusively for use and reliance by the Client and is not a bidding document. Contractors or consultants reviewing this limited sampling report must draw their own conclusions regarding whether further investigation or remediation is deemed necessary. Terracon does not warrant the work of regulatory agencies, laboratories, or other third-parties supplying information, which may have been used in the preparation of this report.
