About this file

This is an Amendment to Solicitation (Standard Form 30) for RFP 36C24926R0040 issued by the Department of Veterans Affairs Network Contracting Office 9, located in Murfreesboro, Tennessee. The amendment extends the offer receipt deadline to May 15, 2026, at 5:00 PM EDT and the vendor question deadline to May 8, 2026, at 5:00 PM EDT. Key modifications include changing the Period of Performance start date to "Time of Award," incorporating FAR Clause 52.222-90 regarding Addressing DEI Discrimination by Federal Contractors, correcting Provision 852.273 to 852.273-73 (Evaluation—Health-Care Resources), and incorporating applicable authority under Title 38 USC 8153 and FAR Parts 12 in combination with VAAR 873.

The underlying solicitation 36C24926R0040 seeks Locum Perfusion Services to support cardiovascular services at Tennessee Valley Healthcare System in Nashville, Tennessee. The contract requires one onsite contractor perfusionist for Monday through Friday workdays (excluding Federal Holidays) and one on-call perfusionist available 24/7, including weekends and holidays. The base period of performance runs from Time of Award through September 30, 2027, with four option periods extending through September 30, 2031. Evaluation will be conducted using comparative evaluation criteria emphasizing technical capabilities (personnel availability, experience, VA hospital familiarity, staffing contingencies, and company background in perfusion services), past performance (contractor's track record fulfilling similar requirements and maintaining adequate staffing), and price, with technical and past performance weighted more heavily than price. The Product Service Code is Q502 and the NAICS Code is 621999.

Samantha Shackelford Contracting Officer

C.14 52.222-90 ADDRESSING DEI DISCRIMINATION BY FEDERAL CONTRACTORS.

This clause applies to this contract and all orders issued off the contract currently in place and issued in the future.

(a) Definitions. As used in this clause—

Program participation means membership or participation in, or access or admission to: training, mentoring, or leadership development programs; educational opportunities; clubs; associations; or similar opportunities that are sponsored or established by the contractor or subcontractor.

Racially discriminatory diversity, equity, and inclusion (DEI) activities means disparate treatment based on race or ethnicity in the recruitment, employment (e.g., hiring, promotions), contracting (e.g., vendor agreements), program participation, or allocation or deployment of an entity's resources.

(b) In connection with the performance of work under this contract, the Contractor agrees as follows:

(1) The Contractor will not engage in any racially discriminatory DEI activities;

(2) The Contractor will furnish all information and reports, including providing access to books, records, and accounts, as required by the Contracting Officer, for purposes of ascertaining compliance with this clause;

(3) In the event of the Contractor's or a subcontractor's noncompliance with this clause, this contract may be canceled, terminated, or suspended in whole or in part, and the Contractor or subcontractor may be declared ineligible for further Government contracts;

(4) The Contractor will report any subcontractor's known or reasonably knowable conduct that may violate this clause to the Contracting Officer and take any appropriate remedial actions directed by the Contracting Officer; and

(5) The Contractor will inform the Contracting Officer if a subcontractor sues the Contractor and the suit puts at issue, in any way, the validity of this clause.

(6) The Contractor recognizes that compliance with the requirements of this clause are material to the Government's payment decisions for purposes of 31 U.S.C. 3729(b)(4).

(c) The Contractor must include the substance of this clause, including this paragraph (c), in subcontracts at any tier, including those for commercial products and commercial services, except those where the place of delivery or performance is outside the United States.

(End of clause)

E.7 VAAR 852.273-73 EVALUATION – HEALTH-CARE RESOURCES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government will evaluate proposals using the comparative evaluation process outlined in VAAR 852.273-73, where proposals will be compared to one another to determine which provides the best benefit to the Government. The Government reserves the right to consider a proposal other than the lowest price that provides additional benefit(s). Proposals may exceed minimum requirements of the solicitation. The Government reserves the right to select a proposal that provides benefit to the Government that exceeds the minimum requirements of the solicitation but is not required to do so. Each response must meet the minimum requirements of the solicitation. The following factors shall be used to evaluate offers:

FACTOR I – TECHNICAL CAPABILITIES The proposal will be evaluated to the extent to which it can meet and/or exceed the Government’s requirements as outlined in the solicitation and based on the information requested in the instructions to offerors section of the solicitation. Offerors will be compared against each other based on the amount of personnel the offeror is able to provide, the years of experience of offerors’ proposed personnel, proposed personnel’s knowledge/experience working in a VA hospital, and how well the contingency plan addresses providing substitutions or filling vacancies to include the timeframe they will require. • Company background including number of years of experience the company possesses providing Urology Cryoablation services and how the company proposes to meet the requirements as stated in the Performance Work Statement.

FACTOR II – PAST PERFORMANCE The past performance evaluation will assess the relative risks associated with offeror’s likelihood of success in fulfilling the solicitation’s requirements as indicated by the offeror’s record of past performance. The past performance evaluation may be based on the contracting officer’s knowledge of and previous experience with the supply or service being acquired; Customer surveys, and past performance questionnaire replies; Contractor Performance Assessment Reporting System (CPARS) at http://www.cpars.gov/; or any other reasonable basis. Offeror’s past performance comparison will be based on the offeror’s previous experience fulfilling a requirement of this size and scope, and the offeror’s past performance in ensuring all positions were filled timely and contractor personnel are rarely substituted.

FACTOR III – PRICE The prices stated in the Schedule of Services are to be all inclusive. Offeror must utilize the included Schedule of Services and include a rate for each of the listed line items. Price will be evaluated to determine the best value to the Government. The Contracting Officer will evaluate offers for reasonableness and accuracy. When combined, technical and past performance are more important than price. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(b) Except when it is determined not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are materially unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). The Government may reject any or all proposals if such action is in the Government’s interest. Additionally, the Government may waive informalities and minor irregularities in proposals received.

(c) If this solicitation is a request for proposals (RFP), a written notice of award or acceptance of a proposal, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received by the Contracting Officer before award.

(End of Provision)
