The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

If the Offeror communicates in its proposal any qualifications, exceptions, exclusions, or conditions to the proposed prices in the Offerors proposal documents, the Contracting Officer may reject the proposal and exclude the Offeror from further consideration.

2. Gender: Whenever the feminine gender is used in this solicitation and contract documents, it shall be considered to include masculine.

(a) As prescribed in Federal Acquisition Regulation (FAR) Part 42.1502, the Department of Veterans Affairs (VA) evaluates contractor past performance on all contracts that exceed $700,000 and shares those evaluations with other Federal Government contract specialists and procurement officials. The FAR requires that the contractor be provided an opportunity to comment on past performance evaluations prior to each report closing. To fulfill this requirement, VA uses online databases located at the Contractor Performance Assessment Reporting System (CPARS) website; to include the Construction Contractor Appraisal Support System (CCASS), the Architect-Engineer Contract Administration Support System (ACASS), and the Federal Awardee Performance & Integrity Information Retrieval System (FAPPIS). This site is maintained by the Naval Sea Logistics Center. The CPARS database shared information which is available to all Federal agencies.

(c) For contracts with a period of one year or less, the contracting officer will perform a single evaluation when the contract is complete. For contracts exceeding one year, the contracting officer will evaluate the contractor’s performance annually. Interim reports will be filed each year until the last year of the contract, when the final report will be completed. The report shall be assigned in CPARS to the contractor’s designated representative for comment. The contractor representative will have thirty days to submit any comments and reassign the report to the VA contracting officer.

(d) Failure to have a current registration with the CPARS database, or to reassign the report to the VA contracting officer within those thirty days, will result in the Government’s evaluation being placed on file in the database with a statement that the contractor failed to respond.

Evaluation will take place in the highest tier for which the requirement is met. For example, a VOSB concern will only be evaluated in tier 2 and likewise, a Small Business concern will only be evaluated in tier 3. The tier chart is as follows:

Tier
Socio-economic Group
Tier 1
SDVOSB
Tier 2
VOSB
Tier 3

(1) Offers, if any, submitted by SDVOSB concerns. If no offers were submitted by SDVOSB concerns, or if no offers are found to be technically acceptable, the Contracting Officer will withdraw the SDVOSB set-aside, and proceed to the next tier set-aside for VOSB concerns.

VOLUME I, TECHNICAL FACTORS.

DEFINITIONS

Recency: “Recent”, for the sake of this solicitation, refers to construction project/contract work experience performed in the last five (5) years (between 2015 to 2020). Projects may be completed or “well underway”. A "well underway" construction project is at least 50-percent complete at the time of proposal submission.

Relevancy: “Relevant” experience is defined as construction contracts of a similar size (exceeding $15M in construction costs) and comparable level of complexity to the Ohio Western Reserve National Cemetery, Phase 3 Project. Relevant complexity aspects include:

· VA/NCA National Cemetery projects

· State/local/private cemetery projects

· Golf courses, national, state and regional parks, multiple sports-fields complexes or multi-phased recreation-oriented land development projects of 10 acres or larger

5.0 EVALUATION FACTORS

Technical qualifications evaluation factors consist of: (1) Past Performance, (2) Relevant Experience, and (3) Construction/Project Management.

FACTOR 1 - PAST PERFORMANCE

The Government will utilize the Past Performance Information Retrieval System (PPIRS) as a source for past performance data. The focus of the Government's PPIRS query will be for construction projects recently completed or “well underway” within the past 5 years.

Offerors shall provide the following.

1. Offerors shall submit Past Performance Questionnaire (PPQ) Forms (See Attachment 9) for no less than THREE (3), and no more than FIVE (5), construction contracts or “well underway” contracts. Each submitted Past Performance contract must meet Recency and Relevancy definitions as described in solicitation section entitled “TECHNICAL EVALUATION RATING DEFINITIONS”. Offerors shall have their project reference fill out a PPQ Form and email them directly to the Contracting Officer on or before the closing date of the RFP. For the Government to solicit candid, fair comments, the Government will not release the PPQ Form to the Offeror. The Offeror may supplement the PPQ with additional information at their discretion.

If a completed past performance evaluation is available in CPARS, it shall be submitted with the proposal for each project referenced for Past Performance. If there is not a completed past performance evaluation available in CPARS, then the Offeror shall submit a Past Performance Questionnaire (PPQ) (reference Attachment 9) for each project referenced for Past Performance. The Offeror shall notify their client that the PPQ shall be submitted via email to the Government’s point of contact, Athena.jackson@va.gov.

2. A listing of (no less than THREE (3), and no more than FIVE (5)) past performance project names and current points of contact (name, phone number, and email address) so the TEB may contact them directly if need be. Offerors are responsible for ensuring that the telephone numbers provided for the owner’s representative provided are accurate and that the representative is aware that the TEB may be contacting them regarding the questionnaire and the Offeror’s past performance.

Past performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. It considers each offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the contract requirements. One past performance recency rating and one past performance relevancy rating will be assigned for each offeror after evaluating the offeror's recent past performance, focusing on performance that is relevant to the contract requirements. (see FAR 15.305). There are three aspects to the past performance evaluation:

Recency: Each contract will be assigned a rating of Recent or Not Recent.

Relevancy: Each project submitted for evaluation will be assigned a Relevancy Rating factor from the Past Performance Relevancy Rating Chart, identified in Section 9.0, Factors to be Evaluated.

Quality: “Quality” refers to how well the contractor performed on the recent and relevant past contracts. This process gathers and evaluates information from customers on how well the offeror performed those past contracts. The TEB shall identify the summary performance rating for each contract and identify, in narrative format, all past performance information that would bolster or diminish the Government’s confidence in the offeror’s ability to perform work on this contract.

MINIMUM REQUIREMENTS: Offeror provides Past Performance Questionnaires for at least three (3) completed construction contracts or “well underway” projects that are recent and relevant as defined in the TECHNICAL EVALUATION RATING DEFINITIONS for which the customer indicates that their overall satisfaction with the Offeror’s performance is Satisfactory or better.

NOTE: If no recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, Past Performance will be identified as a Neutral with a Rating of Acceptable.
