About this file
This document is an Addendum to Federal Acquisition Regulation (FAR) clause 52.212-2 for Evaluation of Commercial Products and Commercial Services for a janitorial services contract at Fort Harrison. The Department of Veterans Affairs will award the contract based on an evaluation of technical capability, past performance, and SDVOSB (Service-Disabled Veteran-Owned Small Business) certification, with price being the most significant factor. The solicitation (36C10D25Q0125) allows for potential contract extensions of one to six months, with option pricing to be determined at the time of exercise, and does not obligate the government to extend the contract.
The evaluation methodology emphasizes that technical and past performance considerations are less important than price, and the government will select the most advantageous quote considering these factors. The contract will be binding upon written notice of award to the successful offeror, with the ability to accept part or all of an offer before the specified expiration time. The specific set-aside for Service-Disabled Veteran-Owned Small Businesses (SDVOSB) indicates a preference for qualifying vendors in the contract award process.

52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers to determine the governments Best Overall Value:
TECHNICAL CAPABILITY
PAST PERFORMANCE
SDVOSB IN SBA VETCERT
FORMAL CERTIFICATION OF VAAR 852.219-75
PRICE
Technical and past performance, when combined, are less important to price.
(b) Options. For purposes of award of this task order, the Government intends to evaluate the option to extend services under FAR 52.217‐8 as follows: The evaluation will consider the possibility that the option can be exercised at any time and can be exercised in increments of one to six months, but not for more than a total of six months during the life of the task order. The evaluation will assume that the prices for any option exercised under FAR 52.217‐8 will be those rates in effect under the task order each time an option is exercised under this clause. The evaluation will therefore assume that the addition of the price or prices of any possible extension or extensions under FAR 52.217‐8 to the total price for the basic requirement and the total price for the priced options has the same effect on the total price of all quotes relative to each other, and will not affect the ranking of quotes based on price, unless, after reviewing the quotes, the Government determines that there is a basis for finding otherwise. This evaluation will not obligate the Government to exercise any option under FAR 52.217‐8.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
