About this file

This is an amendment to an invitation to bid (ITB #13797) issued by the State of Tennessee Department of Mental Health Substance Abuse Services for Western Mental Health Institute (WMHI) in Bolivar. The procurement seeks a five-year contract for the supply of soft drinks, water, and sports drinks, including ten distinct line items such as cola-flavored carbonated drinks, diet cola, lemon-lime drinks, Dr. Pepper-flavored beverages, sports drinks, orange juice, prune juice, and bottled water. Acceptable brands include Coca-Cola, Pepsi, Dr. Pepper, Sprite, Gatorade, and Powerade, with equivalent products permitted. Bid submissions were accepted through January 20, 2026, at 2:00 p.m. CST. Delivery is required to the WMHI Warehouse/Procurement Department at loading dock #2, with delivery frequency specified as a maximum of one time per week and a minimum of two times per month. Suppliers must drop pallets and leave rather than manually unload and stack items. Standard delivery trucks are acceptable provided WMHI's dock area can accommodate them.

The contract carries a maximum estimated liability of $299,480 for the entire five-year term, with pricing submitted on a firm fixed-price basis. Prices remain firm for the first 365 days with potential adjustments thereafter based on independently verifiable documentation of cost increases. This is a new contract with no incumbent. Bidders must register with the Tennessee Supplier Portal and comply with Tennessee Department of Revenue registration requirements. The awardee must provide a certificate of insurance according to the contract's terms and conditions. A company website is not a mandatory requirement for bid consideration. The state reserves the right to award to the lowest-cost responsive and responsible bidder and maintains the ability to terminate the contract for convenience with 30 days' written notice or immediately for cause.

Any restatement of ITB text in the Question/Comment column shall NOT be construed as a change in the actual wording of the ITB document.

QUESTION / COMMENT STATE RESPONSE

1 I see in the documents the total liability is $299,480. Is this for the entire five year contract?

This is the estimated 5-year total.

2 What frequency of delivery are you requiring, we are in that area twice per week?

Maximum of one time per week, minimum of 2 times per month.

3 Do we drop a pallet and leave or do we need to actually unload and stack?

Drop pallet and leave.

4 Is our normal delivery truck acceptable or do we have to send a special independent delivery truck?

WMHI has a dock area where the items can be unloaded. It can accommodate most delivery trucks.

5 Is there an incumbent for this contract? If so, what was the award amount?

No, this is a new contract.

6 Is a company website mandatory prior to the award notification? Or will this exclude or penalize a company because they are not in full compliance?

A company website is not a requirement of this procurement.

7 Is a Certificate of Insurance(COI) needed during the select process?

The awardee will need to provide a copy of their COI according to the terms and conditions Section 7.37.

8 How many times month will the supplies be delivered to the Mental Health Institute?

See response to question #2.

2. ITB Amendment Effective Date. The revisions set forth herein shall be effective upon release. All other terms and conditions of this ITB not expressly amended herein shall remain in full force and effect.
