About this file

This is Amendment #1 to Invitation to Bid (ITB) #13797 issued by the State of Tennessee Department of Mental Health Substance Abuse Services through Western Mental Health Institute (WMHI) in Bolivar for a five-year contract to supply soft drinks, water, and sports drinks. The amendment clarifies delivery requirements and operational procedures through responses to bidder questions. The solicitation encompasses ten line items of beverages including cola-flavored drinks, diet cola, lemon-lime carbonated drinks, diet lemon-lime drinks, Dr. Pepper-flavored drinks, diet Dr. Pepper, sports drinks, orange juice, prune juice, and bottled water from acceptable brands including Coca-Cola, Pepsi, Dr. Pepper, Sprite, Gatorade, and Powerade or equivalents. Delivery is required to WMHI's warehouse at loading dock #2 with specific packaging requirements ranging from 12 to 46 ounces per bottle. The original bid submission period closed January 20, 2026, at 2:00 p.m. CST, with the contract term spanning five years and an optional 180-day extension under the same terms and conditions.

The maximum contract liability is estimated at $299,480 for the entire five-year period on a firm fixed-price basis, with prices remaining firm for the first 365 days and potential adjustments thereafter based on independently verifiable cost increases. The amendment specifies that delivery frequency shall not exceed one time per week with a minimum of two times per month, with suppliers responsible for dropping pallets without requiring unloading or stacking services. This is a new contract with no incumbent, and a company website is not a mandatory requirement. Bidders must be registered with the Tennessee Supplier Portal, comply with Tennessee Department of Revenue registration requirements, provide proof of tax registration, submit non-debarment certifications, and comply with the Iran Divestment Act. The awardee will be required to provide a Certificate of Insurance according to contract terms and conditions Section 7.37. The state reserves the right to award to the lowest-cost responsive and responsible bidder and maintains the authority to terminate the contract for convenience with 30 days' written notice or immediately for cause.

QUESTION / COMMENT STATE RESPONSE

1 I see in the documents the total liability is $299,480. Is this for the entire five year contract?

This is the estimated 5-year total.

2 What frequency of delivery are you requiring, we are in that area twice per week?

Maximum of one time per week, minimum of 2 times per month.

3 Do we drop a pallet and leave or do we need to actually unload and stack?

Drop pallet and leave.

4 Is our normal delivery truck acceptable or do we have to send a special independent delivery truck?

WMHI has a dock area where the items can be unloaded. It can accommodate most delivery trucks.

5 Is there an incumbent for this contract? If so, what was the award amount?

No, this is a new contract.

6 Is a company website mandatory prior to the award notification? Or will this exclude or penalize a company because they are not in full compliance?

A company website is not a requirement of this procurement.

7 Is a Certificate of Insurance(COI) needed during the select process?

The awardee will need to provide a copy of their COI according to the terms and conditions Section 7.37.

8 How many times month will the supplies be delivered to the Mental Health Institute?

See response to question #2.
