About this file

This is a Litigation History disclosure form required by Broward County, Florida for vendors responding to the Risk Management and Claims Administration System solicitation (Reference BLD2131488P1). The form mandates that vendors disclose all material litigation cases filed, pending, or resolved within three years prior to the solicitation response deadline, whether cases involve the vendor, its parent companies, subsidiaries, predecessors, or principals. Material cases include those related to similar work sought under the current solicitation, allegations of fraud, negligence, error, omissions, or malpractice, vendor default or termination from prior contracts, financial distress including bankruptcy or receivership, and criminal proceedings involving business-related offenses. Additionally, vendors must disclose any litigation cases between proposed subcontractors or subconsultants and Broward County within the five years preceding the solicitation response. The deadline for question submission is October 27, 2026 at 5:00 PM EDT, with proposals due November 13, 2026 at 2:00 PM EST, and an optional pre-proposal conference scheduled for October 23, 2026.

The contract structure provides for an initial five-year term with five optional one-year renewal periods. Vendors must provide complete documentation for each material case, including copies of judgments and settlement agreements, with redactions permitted only under pre-existing confidentiality agreements. For joint ventures, disclosures must encompass all entities forming the venture. Failure to disclose material cases or comply with disclosure requirements within three business days of County request may result in the vendor being deemed nonresponsive. The form contains checkbox options for vendors to declare either that no material cases exist or to detail material case information including case number, court, case type, disposition, and opposing counsel contact information. No pricing information, contract value, or set-asides are specified in the pre-solicitation notice, though OESBD procurement preferences for small business enterprises and county business enterprises apply where qualified vendors respond.
