Whitpain Township Contractor Responsibility Certification Form Summary

This is a Contractor Responsibility Certification Form issued by Whitpain Township in Montgomery County, Pennsylvania, designed to establish contractor eligibility and compliance with the township's Responsible Contractor Ordinance No. 394. The form requires contractors to certify their qualifications across multiple dimensions, including possession of all required federal, state, county, and local licenses and registrations; compliance with bonding and insurance requirements; and absence of debarment, project defaults, or license suspensions within the past three years. Contractors must also attest that neither they nor their principals have been convicted of crimes relating to the contracting business within the past ten years and that they have not been found in violation of applicable laws (licensing, tax, wage and hour, prevailing wage, or environmental) resulting in fines or penalties of $5,000 or more within the past three years.

The certification establishes mandatory workforce requirements that contractors must meet or delegate to qualified subcontractors, including employment of sufficient craft labor personnel and completion of OSHA 10-hour safety training by all craft workers prior to project commencement. Critically, at least 70 percent of the craft labor workforce must consist of journeypersons, apprenticeship program graduates, or registered apprentices enrolled in U.S. Department of Labor or state-approved apprenticeship programs. Contractors must submit a list of all trades and classifications of craft employees and applicable apprenticeship program information. The form requires contractors to assign workers only to tasks within their respective trade or craft and to maintain all technical qualifications, equipment, personnel, and financial resources throughout project duration. Contractors must notify the township within seven days of any material operational changes and understand that the certification constitutes an attestation under penalty of perjury. Upon receipt of a Notice of Intent to Award, contractors must provide detailed subcontractor lists and certifications as specified in the Responsible Contractor Ordinance.
